Ordinance - 501ORDINANCE NO.541 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING ORDINANCE-NO.147.9 KNOWN AS THE.ZONING ORDINANCE AND THE.LAND USE PLAN THEREBY.ADOPTED,.BY THE.MODI- FICATION OF A CERTAIN.PRECISE PLAN UPON CERTAIN PROPERTY IN. SAID CITY OePietro) . THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, as amended, classifies certain properties described as the area located at '.'.1446 West Garvey Boulevard, between Conlon Street and Yaleton Street', in the City of -West Covina, County of Los Angeles, State of California, as Zone C-1, as defined by the provisions of said Ordinance No.147 thereof; and IEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a revised plan, to wit; Precise Plan No.93 (Revised) for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on April 18,1956, and thereafter conduct duly advertised public hearings as prescribed by law and duly considered said revised plan; and WHEREAS, the said Planning Commission approved said plan as revised and recommended to the City Council the revision thereof for adoption as a precise plan for the area, subject to the terms and conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on September 24, 1956, hold and conduct a duly advertised public hearing as prescribed by law and considered said revised plan thereat and duly adopted said plan: NOW, THEREFORE, the City Council of the City of West Covina -1- does ordain as follows: That that certain plan for the development of the real property located as aforesaid, heretofore approved and adopted by the City Planning Commission and by the City Council, as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of -West Covina, for the aforementioned area in the City of • 'Vest Covina, subject, however, to the following conditions: 1. That all street improvements outlined in Section 49, Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks on the Frontage Road and Harbert Street. 2. That the Precise Plan conform to the proposed right-of- way of the State Division of Highways. 3. That all necessary street widening shall be deeded..to=the City of 'hest Covina. 4. That all buildings and signs not exceed one story in height. 5. That all exterior lighting be installed and maintained in a manner eliminating any nuisance to adjacent residential property. 6. That adequate water supply and fire protection be provided • as required by Ordinance No.237 and Ordinance No.461. 7. That all excavating and grading work conform to provisions of Ordinance No.384. 8. That all bonds, fees and deposits for improvements be posted before building permits are issued. 9. That all existing buildings be removed or demolished. 10. That the layout of the parking area be subject to prior approval of the City Engineer. -2 - 11:. That the two driveway openings on Harbert Street be eliminated and that center driveway opening on Frontage Street be eliminated. SECTION 2i That the area herein referred to is more parti- cularly described as follows, to wit: PARCEL I. Lots 14 and 15 of Tract No.13166 as recorded • in B k 252, Page 49 of Maps, , in the office of the County Recorder of Los Angeles County; PARCEL 2. The northerly 253.74 feet of the southerly eet.of the westerly 229.09 feet, measured at right angles of Lot 3 of the Reichard Tract in the City of West Covina, County of Los Angeles, . State of Calif- ornia, as per map recorded in Book 129 Page 121 of Maps, on file in the office of the County Recorder of said County SECTION 3. That said Parcel 1, to wit: Lots 14 and 15 of Tract No.13166, as recorded in Book 2529 Page 49 of Maps, in the office of the County Recorder of Los Angeles County, be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the pro- visions of Ordinance No.147, known as the Zoning Ordinance, adopted January 21, 1948, as amended, and all of said Parcel I is • hereby reclassified and established as a part of Zone C-1, subject to all of the conditions hereinbef ore enumerated. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance -3- • 0 shall take effect and be in force.
