AN ORDINANCE OF THE CITY COUNCIL OF THE C-TY OF WEST COVINA, COUNTY
OF LOS.ANGELES, STATE.OF CALIFORNIA,.PROVIDING-FOR THE.CONSTRUCTION
OF PORTLAND..CEMENT CONCRETE_.CURBS, GUTTERS.AND SIDEWALKS IN.CONJUNCTION
WITH BUILDING CONSTRUCTION.
THE CITY COUNCIL OF THE CITY OF WEST COVINA 'DOES ORDAINAS FOLLOWS:
SECTION 1. Purpose and Declaration of necessity.
ie . i .y Council upon investigation ana consideration has
found and determined that the lack of sidewalks in the City of West
. Covina in many instances forces pedestrians, particularly school
children to walk in the street and be subjected to the hazards of
vehicular traffic, and the lack of said walks during rainy weather
has been the indirect cause of sickness resulting from walking through
mud or water along streets or dirt sidewalks; that the lack of curbs
in the City of West Covina makes for poor drainage, puddles of water,
difficult street sweeping and the accumulation of .tfilth; and the
lack of said curbs results in no proper place for garbage and rubbish
receptacles, and subjects such containers to the hazards of vehicular
traffic and unnecessary spillage of garbage and destruction of con-
tainers, and the lack of said curbs subjects children or pedestrians
in the normal sidewalk area to accidental injury by vehicular traffic;
and that the existence of dirt sidewalks and.dirt curbs or gutters
•adjoining dwellings and buildings within the -City of West Covina, or
conversely, the lack of adequate curbs and sidewalks is hereby found
and declared to be dangerous to the public health and safety of the
inhabitants of said City.
SECTION 2. Construction of Portland Cement Concrete Curbs

Any person or persons construc`t-'ing or - arranging for the con-
struction of a building or dwelling shall also provide for the con-
struction of Portland Cement concrete curbs, gutters and sidewalks in'

accordance with the standard specifications of the City of 'West
Covina unless adequate standard Portland Cement concrete curbs,
gutters and sidewalks already exist along all street frontages ad-
joining the lot or lots on which the building or dwelling is to be
constructed, except as provided in Section 4 hereof.
• SECTION 3. Location of curbs, gutters and sidewalks.
Curbs, gutters and sidewalks shall be located within the

street -right-of-way irr-accordance with the provisions of QrddFiG ,,
No.391 of the City of West Covina (as amended) adopting -'a Master Plan
of Streets and Highways, or in accordance with a Precise Plan offi-
cially adopted in accordance with said Master Plan.of Streets and
Highways.
In no case shall a Building Permit be issued -for any structure
on -a street or right-of-way which -is not a standard width street, or
right-of-way as defined in Article III Section 2 of the Subdivision
Ordinance No,225, of the City of West Covina.
SECTION 4. ExceEtions to Portland Cement concrete curb,
gutter and sideway reguirem n1s.
The provisions of Section 2 may be modified by the City Engineer
under the 'following circumstances.-
(a) Portland Cement concrete curbs and gutters only shall
be required where the topography is such that the installation of
P,ortland Cement concrete sidewalks would be impractical in the opinion
of the City Engineer.
.,0) Portland Cement concrete curbs, gutters or sidewalks
need not be installed where the streed grade cannot readily be established
by'theCity Engineer,

(c) Where the street for practical reasons has not been
or cannot be readily graded to the established grade which would
enable proper location of curb and sidewalks.
(d) 'Where installation of Portland Cement concrete sidewalks
"would be hazardous to pedestrians because of the grade.
(e) Where parcels in residential zones are divided into one
acre or larger lots, the Portland Cement concrete curb and gutters,
or Portland Cement concrete curbs, gutters and sidewalksneednot
extend a greater distance than the sideyards or side and rear yards
in the case of corner lots as defined in the Zoning Ordinance.
(f) Portland Cement concrete sidewalks need not be installed
in single family residential zones unless shown on the Master Plan

of Sidewalks approved by the City Council.
.. .,SECTION' 5. The Building Inspector shall deny final approval
and acceptance on final public utility connections to any building
or.dwelling until said Portland Cement concrete curbs and gutters
or Portland Cement concrete curbs, gutters and sidewalks exist or
are constructed in -conformance -with standard specifications for
street improvements in the City of West Covina, or their construction
is guaranteed by cash deposited with the City of 'West Covina in a
sum determined'by the City Engineer, based upon the number
er of lineal
feet of Portland Cement concrete curb, gutters and sidewalks to be
installed, subject to the provisions of Section 4 thereof.
SECTION 6. The City Clerk shall certify to the adoption of
this Ordinanceland prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published once

in the West Covina Tribune, a newspaper of general circulation
published and circulated in the City of -West Covina, and thirty
(30) days from -and after the final passage thereof said ordinance
shall take effect and be in force.

I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meeting of theCityCouncil of the City of West Covina,
held on -the - day of October', 1956 by the affirmative vote
of at least three Councilmen, to wit. -
