AN ORDINANCE OF TH.E CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, PROVIDING.FOR THE VACCINATION WITH RABIES VACCINE
OF A LL:DOGS KEPT -OR HARBORED OR BROUGHT WITHIN THE.CITY OF
WEST COVINA, AND DECLARING THE URGENCY -HEREOF.
THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS:
SECTION.1. Every person keeping, harboring or having a
dog over the age of six (6) months in the City of West Covina,
California, shall cause such dog to be vaccinated with rabies vac-
cine within a period of six (6) weeks from the date of harboring,
keeping or having said dog within said City, or from the date the
said dog attains the age of six (6) months; provided, however,
that the aforesaid provision shall not apply so as to require the
vaccination of any dog which has been vaccinated by a person licensed
by the State of California, or of. any other state or nation, to
practice veterinary medicine where such vaccination has been completed
within the period of time as hereinafter prescribed in this Section 1.
If chick embryo vaccine was used in such vaccination, it must have
been completed within two (2) years prior to the date such dog was
kept, harbored or brought into the City of West Covina. If tissue
phenolized vaccine was used, such vaccination must have been
completed within one (1) year prior to the date such dog was kept,
harbored or brought into the City of West Covina.
SECTION 2.
(a) Every person keeping, harboring or having a dog in the
City of West Covina, California, which has been vaccinated with
chick embryo vaccine shall cause such dog to be revaccinated within
a period of not more than two years after such prior vaccination.
(b) Every person keeping, harboring or having a dog in
said City of West Covina which has been vaccinated with tissue
phenolized vaccine shall cause such dog to be revaccinated with
rabies vaccine within a period of not more than one year after
such prior vaccination.
SECTION 3. Every person practicing veterinary medicine
in the City of West Covina who vaccinates a dog with rabies vaccine
shall issue to the person keeping, harboring or having such dog
• a certificate which is signed by said veterinarian and which states
thereon the name and description of said dog, the date of such
vaccination and the type of vaccine used and shall send a duplicate
copy thereof to the City Clerk.
SECTION 4.
(a) Every person applying for a dog license whether to the
Contracting Pound Service of the City or to the City -Clerk of the
City must exhibit a certificate issued by a person licensed by the
State of California, or any other state or nation, to practice
veterinary medicine which certificate shall show that the dog for
which the license shall be issued either (1) has been vaccinated
in accordance with the provisions of Sections 1 and 2 of this Ordi-
nance, or (2) should not be vaccinated with rabies vaccine by
• reason of age, infirmity or other disability, which disability is
shown on the face of such certificate and to the satisfaction of
the person issuing the license to be in effect at the time of the
license application. A license f or such dog shall not be issued
unless and until such a certificate is so exhibited.
(b) At the time a dog license of the City of West Covina
is issued, it shall either be stamped with the date of vaccination
and the type of vaccine used as shown on said certificate, or there

shall be a vaccination tag issued by the Veterinarian at time
of vaccination or if the license is issued as the result of the
aforesaid certificate or disability, the code letter ItN" shall
be'stamped thereon to represent and mean the words "No Vaccination
Required". Either the license so stamped or the tag issued by
Veterinarian as aforesaid shall be worn at all times by the dog
• for which said license is issued.
SECTION 5.
(a) The Contracting Pound Service of the City shall cap-
ture and impound any dog found within the City limits of the City
which is not wearing a license issued by the City of West Covina,
or by any other municipality in the County of Los Angeles or by
the County of Los Angeles, and stamped as provided in Section 4 (b)
of this Ordinance.
(b) Any officer or employee of the Contracting Pound
Service and any police officer of the City of West Covina, shall
have the right to enter upon any private property or public property
in the City of West Covina in order to examine or capture any dog
• thereon or therein; provided, however, that no such officer or
employee shall have the right to enter a house which is in use as
a residence without first having secured a search warrant therefor.
(c) No dog so impounded shall be released to any person
except where there has been a performance of the following conditions:
(1) There has been presented to the Pound Master a
current license for such dog issued by the City Clerk, or if the
person keeping, harboring or having such dog is not a resident of

'the City of West Covina, such non-resident person has presented
to the Pound Master a current license conforming to this ordinance
for such dog issued by any other municipality in the County of
Los Angeles or by the County of Los Angeles;.,,
(2) Where the person keeping, harboring or having such
dog is a resident of the City of West Covina, there has been paid
• to the Pound Master the license fee for a City of West Covina dog
license as provided by law;
(3) There has been paid to the Pound Master the impound-
ing, collection and other fees as provided by law;
(4) There has been paid to the Pound Master a reasonable
fee as determined by the Pound Master for the vaccination of such
dog; provided, however, that such fee shall not exceed $5.00; or
there has been shown to the satisfaction of the Pound Master that
such dog has been vaccinated with rabies vaccine within the time
periods and according to the other requirements as prescribed in
Sections 1 and 2 of this Ordinance; or that a certificate of disa-
bility has been issued for such dog as provided in Section 4(a) of
this Ordinance; and
(5) The Pound Master has determined that such dog does
not have and is not reasonably suspected of having rabies.
(d) Within seventy-two (72) hours after the receipt of the
aforesaid vaccination fee, or as soon thereafter as possible, and
except as provided in paragraph (e) of this Section 51 the Pound
Master shall cause the dog for whom the fee has been paid to be
vaccinated by a person licensed by the State of California to practice
veterinary medicine or secure from such veterinarian a certificate
of disability for such dog. After the dog has been.vaccinated
or a certificate of disability issued and if all the conditions
of paragraph (c) of this Section 5 have been satisfied, the
Pound Master shall release such dog to the person keeping, har-
boring or having such dog or to the person making application
for the release of such dog.
(e) If the Pound Master suspects that any dog so impounded
has rabies he shall hold such dog for inspection by a health officer
of Los Angeles County. In the event that such health officer shall
determine that such dog is afflicted with rabies, it shall be dis-
posed of or confined for such time as the health officer shall
direct. In the event that such health officer suspects that such
dog may develop rabies, it shall be confined for such time as the
health officer shall direct. Whenever such health officer shall
determine that such dog does not have rabies, it shall be released
in accordance with the provisions of paragraph (c) of this Section 5.
SECTION 6. That any person violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be punishable by a fine of not more than
Five Hundred"Dollars ($500.00)9 or by imprisonment, fora period o P f
not more than six (6) months, or by,both such fine and imprisonment
in the discretion of the court.
SECTION 7. All other Ordinances or parts of Ordinances in-
consistent with the provisions of this Ordinance are hereby repealed.
SECTION 8. That the immediate adoption of this Ordinance
is urgently required for the preservation of the public peace,saf ety

and general welfare and is hereby declared to be an urgency
measure therefor, and the facts constituting such urgency are
as follows: That the program of the City involving the
vaccination with rabies vaccine of all dogs in the City of West
Covina will be actively carried out early in July, 19569 and
thereafter, and the passage of this Ordinance is essential in
• order to properly carry out the purposes of said Ordinance; that
the establishment of the regulations herein contained or the
clarification of existing regulations on this subject without
delay is required to promote and preserve the public peace, health
and safety and to effectuate the purposes of said Ordinance.
SECTION 9. The City Clerk shall certify to the adoption
of this Ordinance and shall cause the same to be published once
in the West Covina Tribune, a newspaper of general circulation
published and circulated in the City of West Covina and thereupon
and thereafter the same shall take effect and be in force.
