Ordinance - 474GRDINANCE NO.474 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A . PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO THE PROVISIONS OF.ORDINANCE NO.147 .OF THE CITY OF . I�EST COVINA , . AND. AMENDING SAID ORDINANCE NO. 147 (Anderson) . THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the -Zoning Ordinance, as amended, classifies certain properties in the City of West Covina, described as the area located at the southeast corner of Garvey Avenue and Azusa Avenue as potential Zone C-1; and WHEREAS, the City P°anning Commission of the City of West Covina has caused to be prepared a precise plan, to wit: Precise Plan No.81, for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on April 18,1956, conduct a duly advertised public hearing as prescribed by law and duly considered said precise plan; and WHEREAS, by Resolution No.368 the said Planning Commission on April 18, 1956, considered said plan and recommended to the City Council the adoption thereof, subject to the conditions in said resolution enumerated;. and WHEREAS, the City Council of the City of West Covina did on May 21, 1956,.hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan,.subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the: City of West Covina does ordain as follows: That that certain Precise Plan No.81 for the development of the real property hereinafter more particularly defined and described, in the City of West Covina, heretofore considered by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City -of West Covina, for the' area hereinafter • specifically described, subject to the following conditions: 1. That all street improvements outlined in Section 49, Ordinance No.2251 including utilities not installed by the State Division of Highways, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers. 2. That the Precise Plan conform to the proposed right-of- way of the State Division of Highways. 3. That necessary land for the street widening of Azusa Avenue shall be deeded to the City of West Covina. 4. That the front of the drive-in restaurant building shown thereon be established ninety (90)°feet from the frontage road. 5. That all exterior lighting and suitable screen -type lands - iscaping be installed and maintained in a manner eliminating any nuisance to adjacent residential property and subject to the approval of the Chief Building Inspector. 6. That adequate water supply and fire protection be provided as required by Ordinance No.451. 7. That all excavating and grading work conform to provisions of Ordinance -No.384. 8. That all bonds, fees and deposits for improvements be posted before building permits are ,issued. -2- 9. That a 6-foot masonry wall be constructed along the easterly and southerly property lines. 10. That a 2 foot buffer and 6 inch concrete curb be installed along the northerly and northwesterly property lines. 11. That the site be graded to drain to public streets. 12. . That a Precise Plan be approved for that area shown as • "Undeveloped Area", prior to issuance of building permits for that area. 13. That all buildings and signs shall not exceed one story in height except as indicated and shown on the said precise plan. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, as amended, be and the same is hereby amended by adding thereto and as a part of the Zoning Hap of the City of West Covina, the following: The hereinafter described real property, to wit: That portion of the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as shown on map recorded in Book 1, pages 43 and 44 of Patents in the office of the County Recorder of said County described as follows: Beginning at a point in the easterly line of that certain parcel of -land described in Book 4652, page 147 of deeds in the office of the County Recorder of said County, said point bears Southerly 164.55 feet from the southerly line of Arroyo Avenue, 100 feet wide, as described in deed to the State of California, recorded in Book 12122 page 118 of Official Records in the office of -the County Recorder of said County; thence Southerly, along the above described easterly line of the above described parcel of land described in Book 4652 page 147 of deeds, 455.45 feet to the southeasterly corner thereof; thence westerly along the southerly line thereof, being a point in the easterly line of Azusa Avenue, 60.00 feet wide; thence North 003915511 East, along the Easterly line of said Azusa Avenue, 80.34 feet to the northwesterly corner of that certain parcel of land described in Book 18627 page 373 of Official Records in the office of the.County Recorder of said County; -3- thence Easterly along the boundary of the last described parcel 11.67 feet to the beginning of a nontangent curve concave southeasterly and having a radius of 57 feet; thence North, northeasterly and easterly along said curve and the boundary of said last described parcel recorded in Book 18627 page 373 of Official Records, through a central angle of 90' 001 001, and a distance of 89.54 feet; thence North 890 501 091.t East tangent to said curve and along the boundary of said last parcel 83.00 feet to the • beginning of a tangent curve concave northwesterly and having a radius of 235 feet; thence northeasterly along said curve through a central angle of 390 291 0411 and a distance 161.94 feet to the end thereof; thence North 500 211 0511 East, tangent to said last mentioned curve, 190.61 feet to the beginning of a tangent curve, concave south- easterly and having a radius of 1258 feet; thence north- easterly, along said last mentioned curve, through a central angle of 100 141 59" and a distance of 225.04 feet to the point of beginning., be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this ordinance, and all such real property and terri- tory is hereby reclassified and established as a part of Zone C-1, under the provisions of said Ordinance No.147, as amended, subject, however, to all of the conditions hereinbef ore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in ,the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
