Ordinance - 470ORDINANCE NO.470 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELO SHE TT OF CERTAIN PROPERTIES.IN SAID CITY, PURSUANT TO THE PROVISIONS OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND ABENDING SAID ORDINANCE N0: 147 (Edwards & Howard). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of ,Jest Covina, known as the Zoning Ordinance, classifies certain properties in the City of West Covina, described as the area located at Garvey Avenue and Harbert Street as potential Zone C-1; and `WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan, to wit: Precise Plan No.79 (1405), for the development of the above described area to encourage the proper utilization of such properties; and ►1HEREAS, the said Planning Commission did on March 21,1956, conduct a duly advertised public hearing as prescribed by law and duly considered said precise plan; and 11HEREAS, by Resolution No.352 the said Planning Commission on March 21, 1956, considered said plan and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and • WHEREAS, the City Council of the City of West Covina did on April 23, 1956, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: NOW"'THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan No.79 (1405) for the development of the real property hereinafter more particularly -1- defined and described, in the City of West Covina, heretofore considered by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City. of West Covina, for the area hereinafter specifically described, subject to the following conditions: • 1. That all street improvements outlined in Section 49, Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street improvements on Harbert Street and street lights and sidewalks. 2. That the Precise Plan conform to the proposed right-of- way of the State Division of Highways. height. 3. That all buildings and signs not exceed one story in 4. That all exterior lighting be installed and maintained in a manner eliminating any nuisance to adjacent residential property. 5. That adequate water supply and fire protection be pro- • vided as required by Ordinance No.451. 6. That all excavating and grading work conform to pro- visions of Ordinance No.384. 7. That all bonds, fees and deposits for improvements be posted before building permits are issued. 8. That a 6-foot masonry wall be constructed along the rear 155 feet of the easterly property line, if and when the property to the east is developed for residential purposes. -2- 9. That suitable access to the rear parking are from the north frontage road (Garvey Avenue) be provided or easements from adjacent owners for such a drive be provided in lieu thereof. Such access drive to be not less than 24 feet in width. 10. That buildings maintain a minimum set back of 15 feet from front property line on Garvey Avenue. 11. That provisions be made for removal of the storm water from subject property to frontage road. 12. That suitable landscaping be provided to the satisfaction of the City Engineer. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, as amended, be and the same is hereby amended by adding thereto and as a part of the zoning map of the City of West Covina, the following: The hereinafter described real property, to wit: Lot No.12 of Tract No.13166 recorded in Map of County Recorder's Office, County of Los Angeles, State of California be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this ordinance, and all such real property and terri- tory is hereby reclassified and established as a part of Zone C-1, under the provisions of said Ordinance No.147, as amended, subject, however, to all of the conditions hereinbef ore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published -3- once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
