Ordinance - 468ORDINANCE NO.468 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,CALIF ORNIA.,.A`bOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO THE PROVISIONS OF ORDINANCE N0.147.OF THE CITY OF WEST COVINA,.AND AMENDING. SAID ORDINANCE NO. 147 (C.J.Hurst ,Jr) . THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain properties in the City of West Covina, described as the area located on the • southwest corner of Merced Avenue and Sunset Avenue as potential Zone C-1; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan, to wit: Precise Plan No.76 (1405), for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on March 7, 19569 conduct a duly advertised public hearing as prescribed by law and duly considered said precise plan; and "WHEREAS, by Resolution No.249 the said Planning Commission on March 7, 19569 considered said plan and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on April 9, 1956, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise planthereat and duly adopted said plan:; subject to the stipulations hereinafter enumerated: N0411 THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan No.76(1405) for the development of the real property hereinafter more particularly -1- defined and described, in the City of West Covina, heretofore considered by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the area hereinafter specifically described, subject to the following conditions: • 1. That all street improvements outlined in Section 49 Ordinance No.225, including utilities, be installed accordingly to meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers. 2. That all necessary street widening shall be deeded to the City of West Covina. height. 3. That all buildings and signs not exceed one story in 4. That all exterior lighting be installed and maintained in a manner eliminating any nuisance to adjacent residential property. 5. That adequate water supply and fire protection be pro- vided as required by Ordinance No.237 and Ordinance N0.315. 6. That all excavating and grading work conform to provi- sions of Ordinance No.384. 7. That all bonds, fees and deposits for improvements be posted before building permits are issued. 8. That a 6-foot masonry wall be constructed along the northwesterly property line and southwesterly side of alley$ when the adjoining property of the applicant is either developed or sold. -2- 9. That the site be graded to drain to Sunset and/or Pierced Avenues. 10. That the Service Station layout and driveway entrances be subject to the approval of the chief building inspector. 11. That a 5-Toot walk be shown along the driveway side of each building and that the drives be increased to a minimum • width of 24 feet. 12. That landscaping conforming to acceptable standard as established by the City Engineer be included in the new revised precise plan. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, as amended, be and the same is hereby amended by adding thereto and as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property,to wit: The northeasterly 2501 of the southeasterly 190, of Lot 128, E.J.Baldwin's 4th Subdivision in the City of West Covina,County of Los Angelest State of California, as per map recorded in Book 8, page 186 of Pups in the office of the County Recorder of said County be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this ordinance, and all such real property and terri- tory is hereby reclassified and established as a part of Zone C-1, under the provisions of said Ordinance No.147, as amended, subject, however, to all of the conditions hereinbefore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) -3- 0 • days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of 'West Covina and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
