AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIF-
ORNIA, ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN
PROPERTIES IN SAID CITY, PURSUANT TO THE PROVISIONS OF ORDINANCE
NO.147.OF THE CITY OF.WEST COVINA,.AND AMENDING.SAID ORDINANCE NO.
147 (Sponseller_& Son). .
THE CITY COUNCIL OF THE CITY OF;WEST COVINA DOES ORDAIN AS FOLLOWS:
SECTION 1. WHEREAS-, Ordinance No.147.of the City of West
Covina, known as the Zoning Ordinance, classifies certain properties

in the City of West
Covina,
described
as the area located
on the
northeast corner of
Garvey
Avenue and
Irwindale Avenue as
potential
Zones C-19 R-3 and R-1; and
WHEREAS, the City Planning Commission of the City of West
Covina has caused to be prepared a precise plan, to wit: Precise
Plan No.44 (Revised), for the developments of the above described
area.to encourage the proper utilization of such properties; and
'WHEREAS, the said Planning Commission did on February 1, 19569
conduct a duly advertised public hearing as prescribed by law and
duly considered said precise plan; and
WHEREAS, by Resolution No.336 the said Planning Commission
on February 1, 1956, considered said plan and recommended to the
City Council the adoption thereof, subject to the conditions here-
inafter enumerated; and
WHEREAS, the City Council of the City of West Covina did on
February 14, 1956, hold and conduct a duly advertised public hearing
as prescribed by law and considered said precise plan thereat and duly
adopted said plan,subject to the stipulations hereinafter enumerated
NOW, THEREFORE, the City Council of the City of West Covina
does ordain as follows: That that certain Precise Plan No.44(Revised)
for the development of the real property hereinafter more particularly

defined -and described, in the City of West Covina, heretofore
considered by the Coty Planning Commission and by the City Council
as aforesaid, be and the same is hereby adopted as'an Official
Precise Plan, under and pursuant to the provisions of Ordinance
N0.147 of the City of West Covina, for the areas,hereinafter speci-
fically described, subject to the following conditions:
1. There shall be deeded to the City and improved a 25 foot
• lane from Broadmoor Avenue to Irwindale Avenue on the north property
line, to the satisfaction of the City Engineer.
2. There shall be constructed and maintained a 6 foot masonry
wall along the northerly and easterly line where developed as R-1
use with wall being reduced to 42 inches for all front yard set backs
as required by .applicable ordinances.
3. There shall be installed and maintained a 5 foot chain
link fence bordering south side of aforementioned 25 foot lane.
4. A 10 foot sanitary sewer and drainage easement shall be
deeded to the.City from Broadmoor Avenue to the east property line
(along north property line)..
5. The proposed layout for buildings and pump islands in
service station area shall be subject to the approval of Planning
and Safety Committee.
6. That all excavating and grading work shall conform to
provisions of Ordinance No.384.
7. All exterior lighting shall be installed and maintained
in a manner eliminating any nuisance to adjacent residential
property.

8. A floor plan and.layout showing the intended use for
all proposed buildings, with sufficient parking to be provided
as specified by Ordinance No.325 to accomodate those uses shall
be provided.
9. That all street improvements outlined in Section 49,
Ordinance N0.225, including utilities, be installed accordingly
and meet the approval of the. City Engineer. This to include curb
• and gutters on both sides of 25 foot lane, and also to include
street lights, sidewalks and sanitary sewers as required by the
City.
10. That the Precise Plan conform to the proposed right of
way of the ,State 'Division of Highways.
11. That all signs conform to the provisions of Ordinance
No.418 and be attached to buildings.
12. That adequate water supply and fire protection be pro-
vided as required by Ordinance No.237.
13. That all bonds, fees and deposits for improvements be
posted before building permits are issued.
14. That construction of the proposed development be commenced

within two (2)
years from the effective date
of this
Ordinance and
that suitable
signs be erected and maintained
giving'notice
to
adjoining residential areas of the presence of the C-2 zoning here
involved.
That Ordinance No.147 of the City of West Covina, known as
the Zoning Ordinance, adopted January 21, 1948, as amended, be and
the same is hereby amended by adding thereto and as a part of the

Zoning Map of the City of West Covina, the following:
The hereinafter described real property, to wit:
Beginning at the intersection of the easterly line of
Irwindale Avenue (60 feet wide) with a line that is parallel
with and distant 107.00 feet northerly, measured at right
angles, from the center line of Arroyo Avenue, 100 feet wide,
as shown on County Surveyor's Map No.B-596 on file in the
office of the County Surveyor of said County; thence North
40 361 0511 East 10 feet along said east line to the true
• point of 'beginning; -thence continuing North 40 361 0511 East
to a point in said easterly line distant North 40 361_0511
East 202.45 feet measured along said easterly line and southerly
prolongation from the northerly line of the 20 foot strip of
land conveyed to the County of Los Angeles by deed recorded in
Book 3404 Page 213 of Deeds, in the office of the County
Recorder of said County; thence northeasterly and tangent to
said easterly line of Irwindale Avenue along a curve concave
southeasterly having a radius of 248.52 feet through an
angle of 360 381 2711 an arc distance of 158.93 feet; thence
tangent to said.curve North 410 14t 3211 East 0.31 of a foot;
thence northeasterly and tangent to the last described course
along a curve concave northwesterly having a radius of 237.00
feet through an angle of 230 271 181t an arc distance of 97.02
feet to a point of -compound curve; thence northerly and tangent
to the last described curve along a curve concave westerly
having a radius of 87.00 feet through an angle of 630 511 4411
an arc distance of 96.91 feet to a point in the northerly line
of the land described in Certificate of Title No.A-3718 on
..file in the office of the Registrar of said County; thence
South 890 191 401t East along said northerly line to the easterly
line of the land described in said certificate; herein described
parallel line; thence North 890 19t 401, West along said parallel
line to a point thereon distant South 890 190 401 East 15 feet
from said easterly line of Irwindale Avenue- thence North

EXCEPT therefrom that portion described in the deed to the
State of California recorded in Book 45949, Page 3029 Official

be and the same is hereby excepted from the particular zone in which
such real property has otherwise been placed and designated by the
provisions of this ordinance, and all such real property and territory
is hereby reclassified and established as a part of Zone C-29 under
the provisions of said Ordinance No.147, as amended, subject, however,

to all of the conditions hereinbefore enumerated.
SECTION 2. The City Clerk shall certify to the
adoption of this Ordinance, and prior to the expiration of
fifteen (15) days from the passage thereof, shall cause the
same to be published once in the West Covina Tribune, a news-
paper of general circulation published and circulated in the
City of Ifest Covina, and thirty (30) days from and after the
final passage thereof said Ordinance shall take effect and

I HEREBY CERTIFY that the foregoing Ordinance was adopted
at ' -a regular meeting of the City Council of the City of West Covina,
held on the 26th day of March, 1966, by the affirmative vote of at
