Ordinance - 446ORDINANCE NO.446 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A . PRE'CIS-E PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND -AMENDING SAID ORDINANCE, NO.147 (Van Horn.and Darby). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. NHEREAS, Ordinance No.147 of the City of West Covina, known a.s the Zoning Ordinance, classifies certain properties • in the City of West Covina:, described as the area located on the east side of Glendora Avenue between Service Avenue and Walnut Creek Parkway as potential Zone C-1; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan, to wit: Precise Plan No.61, for the development of the above described area, to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on October 19,1955, conduct a duly advertised public hearing as prescribed by law and duly considered said precise plan; and 'WHEREAS, by Resolution No.308 the said Planning Commmission on October 19, 19559 approved said plan and recommended to the City w.- 0 Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on November 14, 1955, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows; That that certain Precise Plan No.61 for the -1- development of the real property hereinafter more particularly ,,,l;,d'efined and described, in the City of ffest Covina, heretofore approved and adopted by the City Planning Commission and by the City Council a.s aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas here • inafter specifically described, subject to the following conditions: (1) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City engineer, this to include street lights and sidewalks. (2) That all buildings and signs not to exceed one story in height. (3) That a 15 foot wide driveway easement south of the six (6) parking stalls be shown on the Precise Plan. (4) That adequate water supply and fire protection be pro- vided as required by Ordinance No.237. (5) That all bonds, fees and. deposits be posted before building permits are issued. • (6) That a 5 foot walk be provided along the P g northerly side of building and that a 7 foot walk be provided along the southerly side of the building. (7) That suitable planting be provided for this area.. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, as amended, be and the same is hereby amended by adding thereto and as a part of the Zoning Xap of the City of West Covina, the following: -2- The hereinafter described real property, to wit: Portion of Lot 195 of E.J.Baldwin's Fifth Subdivision in the City of West Covina, County of Los Angeles, State of California, as per map recorded in Book 12, pages 134 and 135 of Haps, in the office of the County Recorder of said County, described as follows: Beginning a,t the most westerly corner of said Lot 195, said corner being the intersection of the northerly line of Service Avenue (60 feet wide) with the southeasterly line i of Glendora Avenue (60 feet wide); thence S 890 341 201'East along the southerly line of -said lot, 78.75 feet to the true point of beginning, said point being on a. tangent curve, concave northeasterly, having a radius of 25 feet; thence westerly and northerly along said curve, through a central angle of 127° 31' 4111, an! arc distance of 55.65 feet to a reverse curve, concave northwesterly, having a radius of 1050 feet; thence northeasterly along said curve through a central angle of 20 27' 0311, an arc distance of 44.91 feet to a reverse curve, concave southeasterly, having a radius of 500 feet; thence northeasterly along said curve, through a central angle of 60 301 471t, an arc distance of 56.84 feet; thence north 420 Olt 0511 East, tangent to the last mentioned curve, 67.59 feet more or less to a line that is parallel with, and 171.53 feet northerly, measured at right angles, from the southerly line of said Lot 195, and the true point of beginning; thence south 89' 34, 2011 East along said parallel line 42.61 feet more or less to a line that bears north 00 231 40" East and passes through a point on the southerly line of said lot 195 which bears S 890 341 20" East and distant 207.87 feet easterly from the most westerly corner of said Lot 195; thence S 00 23' 40" West, 58.00 feet; thence North 800 141 361 West 82.85 feet more or less to a point on that certain course mentioned above as North 420 Olt 0511 East • 67.59 feet more or less, said point bearing south 42001/0511 West 59.59 feet from the true point of beginning; thence North 420 Olt 0511 East 59.59 feet to the true point of beginning. be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this ordinance, and all such real property and territory is hereby reclassified and established as,a part of Zone C-1,. under the provisions of said Ordinance No.147, as amended, subject, however, to all of the conditions hereinbefore enumerated. -3- SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) • days from and after the final passage thereof said Ordinance shall take effect and be in force.
