Ordinance - 445ORDINANCE NO.445 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA , CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA,AND AMENDING SAID ORDINANCE NO.147 (Victor Anderson). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. `WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, as amended, classifies certain • properties described as the area located at the southeast corner of Sunset Avenue and Garvey Boulevard, in the City of West Covina, as Zone R-A, as defined by the provisions of said Ordinance No.147, as amended by Ordinance No.325 of the City of West Covina,; and WHEREAS, the City Planning Commission of the City of West Covina has considered a precise plan for the development of the above described area, to encourage the proper utilization of such properties; and 'WHEREAS, the said Planning Commission did on October 19,1955, conduct a duly advertised public hearing as prescribed by law and duly considered the application of Victor Anderson for a reclassi- fication in the zoning of said property in accordance with said precise plan; and • WHEREAS, by appropriate resolutions the said Planning Commi- ssion recommended to the City Council the approval of the said plan and requested reclassification; and, WHEREAS, the City Council of the City of West Covina, pursuant to law, held and conducted a duly advertised public hearing and considered said application for a reclassification in relation to the precise plan submitted concurrently therewith, and duly approved said reclassification, subject to the stipulations hereinafter enumerated; -1- NOW, THEREFORE, the City Council of the City of West Covina, does.ordain as follows: That that certain precise plan and reclassification hereinabove described for the development of the real property as aforementioned, in the City of West Covina, heretofore approved as aforesaid by the City Planning Commission, be and the same is hereby approved, under and pur- • suant to the provisions of Ordinance No.147 of the City of West Covina, as amended, for the areas hereinafter specifically described, subject to the following conditions: (1) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks, sanitary sewers and storm sewer extension along Sunset Avenue to a point approximately 271 feet south of Garvey Avenue. (2) Tha,t 5 foot concrete sidewalks be constructed along Garvey Avenue (frontage road) and Sunset Avenue. (3) That adequate water supply and fire protection be • provided as required by Ordinances Nos.237 and 315. (4) That all bonds, fees and deposits be posted before building permits are issued. (5) That all excavating and grading work comply with the provisions of Ordinance No.384. (6) That a. 4 foot high chain link fence be constructed along the southerly, easterly and southeasterly property lines as shown on the Precise plan. (7) That all buildings and signs be limited to one story in height. -2- (8) That the plan conform to the right-of-way of the State Division of Highways. (9) That pump islands be set back a. minimum of 15 feet from property lines. • width. (10) That all driveway entrances be limited to 30 feet in That Section 8 of Ordinance No.147 of the City of West Covina, known as the Zoning 0rdinance, adopted January 21, 19489 be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina., the following: The hereinafter described real property, to wit: That portion of Lot 133 of E.J.Baldwin's 4th Subdivision of part of Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, a.s per map recorded in Book 89 Page 186 of Maps, in the office of the recorder of said County, described as follows: Beginning at the intersection of the easterly line of Sunset Avenue (formerly Irwindale Avenue) 60 feet wide, as described in Document No.15131-B entered.on Certificate of Title No.HE 67344 on file in the office of the registrar of titles of said County, with a line that is parallel with and distant 30 feet southerly (measured at right angles) from the northerly line of said lot: thence N 580 271 57" E. 18.56 feet to a point in a. line that is parallel with.and distant 20 feet southerly (measured a.t right angles) from said northerly line of said lot distant thereon S 880 561 30" E 15 feet from said easterly line of Sunset Avenue; thence along said la.st mentioned parallel line (being the present southerly line of Garvey Boulevard) S. 880 561 3011 E. 125 feet; thence southerly and parallel to Sunset Avenue S. 40059/1511 W. 44.70 feet thence S. 410 531 0011 W. 105.79 feet; thence N. 880 561 301t W. 76.23 feet to the easterly line of Sunset Avenue; thence along said easterly line N. 40 591 15" East 115.00 feet to the point of beginning be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the -3- provisions of said Ordinance N0.1471 as amended, and all such real property and territory is hereby reclassified so as,to establish said property and territory as a part of Lone C-2, under the pro- visions of said Ordinance No.147. SECTION 2. The City Clerk shall certify to the adoption of this ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause.the same to be published once in the West Covina Tribune, a newspaper of general circulation published and 'circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. of the City of West Covina ATTFS City Clerk I HEREBY CMTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the 12th day of December, 19559 by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMEs vv.
