Ordinance - 443-41 ORDINANCE NO.443 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY ,0F WEST COVINA , CALIF- ORNIA,.ADOPTING A.PRECISE PLAN.FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO.SECTION 14 OF ORDINANCE NO.147 OF THE.CITY.OF WEST COVINA,AND AMENDING SAID ORDINANCE NO.147 (Pink). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOS ORDAIN AS FOLLOWS: SECTION 1.--WHEREAS9 Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance, as amended, classifies certain properties described as the area located on the east side of Glendora • Avenue between Service Avenue and Walnut Parkway, y in the City of West Covina., as Zone R-A, as defined by the provisions of said Ordinance No.147, as amended by Ordinance No.325 of the City of West Covina; and WHEREAS, the City Planning Commission of the City of West ., Covina. has considered a precise plan for the development of the above described area: to encourage the proper utilization of such properties; and 'WHEREAS, the said Planning Commission dial on October 5,1955, conduct a duly advertised public hearing as prescribed by law and duly considered the application of Sidney Pink for a, reclassification in the zoning of said property and for a, variance for a. "Special Use", to wit: a Theatre, in accordance with said precise plan; and WHEREAS, by appropriate resolutions the said Planning Commi- ssion recommended to the City Council the approval of the said plan and requested variance and reclassification; and WHEREAS, the City Council of the City of West Covina, pur- suant to law, held and conducted a duly advertised public hearing and considered said application for a, variance and reclassification in relation to the precise plan submitted concurrently therewith, and duly approved said variance and reclassification, subject to the stipulations hereinafter enumerated. -1- • NOW,THEREFORE, the City Council of the City of West Covina. does ordain as follows: That that certain precise plan a,nd variance hereinabove described for the development of the real property a,s aforementioned, in the City of West Covina,, heretofore approved as aforesaid by the City Planning Commission, be and the same is hereby approved, under and pursuant to the provisions of Ordinance N0.147 of the City of West Covina., as amended, for the areas hereinafter specifically described, subject to the following conditions: (1) Tha:t all street improvements outlined in Section 49 of Ordi- nance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers, if trunk sewers are available. (2) That the necessary widening of Glendora. Avenue and Valinda, Avenue and the realignment of Valinda Avenue be deeded to the City of West Covina.. (3) That 5 foot concrete sidewalks be constructed along Glendora and Va:linda. Avenues and the.rea.lighnment of Valinda.Avenue. (4) That the Precise Plan conform to the proposed right-of-way of the Los Angeles Flood Control "District. (5) That a: 2 foot buffer and a 6 inch concrete curb be constructed along the northwesterly, southwesterly and easterly property lines. (6).. That all buildings and signs be limited to one story in height. (7) That adequate water supply and fire protection be provided as required by Ordinance No.237. (8) That all bonds, fees and deposits be posted before building permits are issued. (9) That disposition of existing buildings be shown upon the -2- plan of this development. (10) That a 35 foot curb radius be provided at Glendora, Avenue and Valinda. Avenue. (11) That an additional driveway entrance be provided on Glendora Avenue at the southerly end of the parking area.. (12) That the northwest 25 foot drive on Glendora, Avenue be an exit only. (13) That the south 25 foot driveway on Valinda, Avenue be and exit and entrance. (14) That the 30 foot at the cul-de-sac at Valinda, Avenue be an exit only, (15) That full street improvements be provided in proposed realignment of Valinda. Avenue north of the 445.39 foot dimension line and improvements for 1/2 street for the remaining portion which lies south of the 445.39 foot dimension line. (16) That construction must be started within two years. That Section 8 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the • same is hereby amended by adding thereto, a.s a part of the Zoning Hap of the City of West Covina,, the following: The hereinafter described real property, to wit: That portion of Lot 195, of E.J.Baldwin's Fifth Subdivision in the City ofWest Covina, County of Los Angeles, State of California, as per ma,p recorded in Book 12, Pages 134 and 135 of Maps in the office of the County Recorder of said County, described a.s follows: -3- Beginning at the most northerly corner of said Lot 195; thence southerly along the easterly line of said Lot 195, 498.60 feet; thence westerly parallel with the southerly line of said lot 445.39 feet, more or less, to the northwesterly line of said lot; thence northeasterly along sa.id'northwesterly line of said lot to the point of beginning. Except that portion lying northerly of the southerly line of Walnut Creek Wash be and the same is hereby excepted from the particular zone in which said real property hats otherwise been placed and designated by the provisions of said Ordinance No.147, as amended, and all such real property and territory is hereby reclassified so as to establish said property and territory as a part of Zone C-1 , subject to all of the terms and conditions of the variance hereby granted and as shown and indicated upon said precise plan, under the provisions of said Ordinance No.147 as amended. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15).days from the passa.ge,thereof, shall cause the same to be published once in the 'West Covina. Tribune, a newspaper of general circulation • - published and circulated in the�City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect an d be in force.
