Ordinance - 441r` 4L ORDINANCE NO.441 AN ORDINANCE OF THE CITY COUNCIL OF TAT E CITY OF WEST COVII\ , CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DE'VELOPXENT OF GERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND AMENDING SAID ORDINANCE NO.147 (Stinton). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, as amended, classifies certain • properties described as the area located at the northeast corner of Puente Avenue and Azusa Avenue, in the City of West Covina, as Zone R-A, as defined by the provisions of said Ordinance No.147, as amended by Ordinance No.325 of the City of West Covina- and 11HEREAS , the City Planning Commission of the City of West Covina has considered a precise plan for the development of the above described area, to encourage the proper utilization of such properties; and WHEREAS, the said planning Commission did on October 5, 1955, conduct a duly advertised public hearing as prescribed by law and duly considered the application of Arthur J.Stinton for a reclassifi- cation in the zoning of said property in accordance with said precise plan; and IMEREAS, by appropriate resolutions the said. Planning Commi- ssion recommended to the City Council the approval of the said plan and requested reclassification; and IffEREAS, the City Council of the City of West Covina, pursuant to law, held and conducted a duly advertised public hearing and considered said application for a recla.ssif ication in relation to the precise plan submitted concurrently therewith, and duly approved said reclassification, subject to the stipulations hereinafter enumerated. -1- • • NOW, TNERWORF, the City Council of the City .of West Covina does ordain as follows: That that certain precise plan and reclassification hereinabove described for the development of the real property as aforementioned, in the City of West Covina., heretofore approved as aforesaid by the City Planning Commission, be and the same is hereby approved, under and pursuant to the provisions of -Ordinance No.147 of the City of West Covina, as amended, for the areas hereinafter specifically described, subject to the following conditions: (1) Tha,t all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City:gineer. This to include street lights, sidewalks and sanitary sewers, if trunk sewers are available. (2) That the necessary widening of Azusa. Avenue be deeded to the City of West Covina. (3) That the professional buildings and all signs be limited to one story in height. (4) That a 2 foot buffer and 6 inch high concrete curb be constructed along the westerly side of the central parking area. (5) That a 6 foot masonry wall be constructed along the easterly property line. (6) That the curb radius at the southwest corner be shown as 30 feet. That parkways be shown as 3 feet on Azusa Avenue and 10 feet on Puente Avenue. (7) Tha.t adequate water supply and fire protection be provided as required by Ordinance No.237. -2- r (8) That all bonds, fees and deposits be posted before building permits are issued. (9) That the floor area of the apartment buildings conform to the provisions of West Covina Ordinance No.325. (10) Tha,t the Precise Plan be revised to show the following: • (a) Over-all dimensions of entire property (b) Location, by dimensions, of all the following: 1. Buildings 2. Driveways, alleys and walks 3. Parking areas and parking stalls 4. Parkways and sidewalks 5. All other proposed improvements 6. Disposition of existing buildings 7. Northerly driveway minimum 20 feet wide 8. Set-ba.ck on pump islands, minimum 15 feet (11) Tha,t all buildings be set back 25 feet from Azusa Avenue. That Section 8 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Hap of the City of West Covina, the following: The hereinafter described real property, to wit: 'The westerly 315 feet of Lot 5, Block 9 of The Phillips Tract, in the City of West Covina, . County of Los.Angeles, State of California, as per map recorded in Book 9, Page 3 et seq. of I4iiscellaneous Records in the office of the County Recorder of said County, said distances being measured along the side lines of Azusa Avenue, 66 feet wide, (formerly Sierra Street) and Puente Avenue, 66 feet wide, as shoi.m on the raa.p of said Tract. be and the same is hereby excepted from the particular zone in which said. real property has otherwise been placed and designated by the provisions of said Ordinance No.147, as amended, and all such real property and territory is hereby reclassified so as to establish -3- .J • said property and territory as a part of Zones C-1 and R-P, as shown and indicated upon said precise plan, under the provisions of said Ordinance,No.147. SECTION_ _2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina., and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
