Ordinance - 440ORDINANCE NO.440 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA., CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE. CITY OF WEST COVINA, AND A11ENDING SAID ORDINANCE NO.147 (Herbert W. Ross) . THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the- City of West Covina, known a,s the Zoning Ordinance, classifies certain properties in the City of West Covina, described as the area located on the south side of Garvey Avenue between Orange and Sunkist Avenues ues as potential Zone C-1; and WHtEMEAS, the City Planning Commission of the City of West Covina has caused to be prepared a, precise plan for the development of the above described. area to encourage the proper utilization of such properties; and NHER"EAS, the said Planning Commission did.on October 5, 1955, conduct a duly advertised public hearing as prescribed by law and duly considered said precise plan; and WHEREAS, by Resolution No.298 the said Planning Commission on October 5, 1955, approved said plan as amended and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on October 24, 1955, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated.: NOW, THME EFORE, the City Council of the City of West Covina -1- does ordain as follows: That that certain Precise Plan No.53 (Revised) for the development of the real property hereinafter more particularly defined and described, in the City of West Covina, heretofore approved and adopted by the City Planning Com- mission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan,,under and pursuant • to the provisions of Ordinance No.147 of the City of West Covina, for the a.rea,s hereinafter specifically described, subject to the following conditions: (1) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, not installed by the State Division of Highways, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks. (2) That all buildings and signs be limited to one story in height. (3) That the Precise Plan conform to the right-of-way of the State Division of Highways. (4) That a 6 foot masonry wall be constructed along the westerly property line, south of the alley and the southerly property line. (5) That all exterior lighting be installed and maintained so as to eliminate any nuisance to adjacent residential property. (6) That adequate water supply and fire protection be provided as required by Ordinance No.237. (7) That all bonds, fees and deposits be posted before build- ing permits are issued. (8) That the layout of the service station buildings and -2- 4 pump islands be subject to the approval of the Building Inspector. (9) That a, 20 foot easement for alley purposes be provided and improved, extending from existing alley to, frontage road. (10) That drainage easements be provided and improved to accomodate storm water runoff. • (11) That all buildings be set back a minimum of 15 feet from front property line. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, as amended, be and the same is hereby amended by adding thereto and a,s a part of the Zoning Nla.p of the City of Nest Covina, the following: The hereinafter described real property, to wit: Beginning at a point on the southerly line of land acquired by the State of California in deed recorded in Book 17828, page 165, Official Records of said County, distant North 83' 161 3511 East along said southerly line 125.00 feet from the easterly line of Tract 12907, as per map recorded in Book 24,, pages 16 and 17 of Maps, in the office of the County Recorder of said County; thence along said southerly line North 830 161 35" East 125.00 feet; thence parallel with said easterly line South 60 431 2511 East 289.22 feet to a line which is parallel with said southerly line and passes through the most easterly corner of said Tract 12907; thence along said last described parallel line South 830 16, 35" West 125.00 feet to a line which is parallel with said easterly line and passes through the point of beginning; thence North 6 43, 2511 Nest 289.22 feet to the point of beginning; and Beginning at the most northerly corner of Tract No.12907, as per map recorded in Book 244, Pages 16 and 17 of Naps, said corner being a point on southerly line of land acquired by the State of California,, in deed recorded in Book 17829, Page 165 of Official Records; thence along said Southerly line North 830 16, 3511 Est 125.00 feet; thence parallel with the Easterly line of said Tract No.12907, South 6043,2511 East 289.22 feet to a line which is parallel with said southerly line and passes through the most easterly corner of said Tract 12907; thence along said last described parallel line South 830 161 3511 West 125.00 feet to said most easterly corner; thence along the easterly line of said Tract 12907, North 6°43 1 25" West 289.22 feet to the point of beginning. -3- s • be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this ordinance, and all such real property and territory is hereby reclassified and established as a, part of Zone C-1, under the provisions of said Ordinance No.1479as amended, subject, however, to all of the conditions hereinbefore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina. Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
