Ordinance - 430ORDINANCE NO.430 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,CALIF- ORNIA, ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT -TO SECTION 14 OF ORDINANCE.NO.147 OF THE CITY OF WEST COVINA, AND ANENDING SAID ORDINANCE NO.147 (Lawyer) . THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. IMEREAS, Ordinance N0.147 of the City of West Covina., known as the ,Zoning Ordinance, as amended, classifies certain properties described as the area located on the south side of Francisquito Avenue between Sunset and California. Avenues as Zone R-A and Zone C-1, as defined by the provisions of said Ordinance No.147, as amended by Ordinance No.325 of the City of West Covina; and WHEREAS, the City Planning Commission of the City of West Covina has considered a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on September 6, 1955, conduct a duly advertised public hearing as prescribed by law and duly considered the application of Richard E. Lawyer for a reclassification in the zoning of said property under said precise • plan; and WHEREAS, by appropriate resolutions the said Planning Commission recommended to the City Council the approval of the said plan and request reclassification; and )MEREAS, the City Council of the City of West Covina, pur- suant to law, held and conducted a duly advertised public hearing and considered said application for a reclassification in relation 1. to the precise plan submitted concurrently therewith, and duly approved said reclassification, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain precise plan and reclassification hereinabove described for the development of the real property as aforementioned, in the City of West Covina, heretofore approved as aforesaid by the City Planning Commission, be and the same is hereby approved, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, as amended, for the areas hereinafter specifically described, subject to the following conditions: 1. That area for street widening of Sunset Avenue and Francisquito Avenue be deeded to the City of West Covina. 2. That all street improvements outlined in Section 49 of Ordi- nance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers. • 3. That the sidewalks be shown on precise plan together with dimensions of driveways and openings to parking area. 4. That a 6 foot masonry wall be constructed along the south- west and southeast sides of subject property. 5. That adequate water supply and fire protection be provided. 6. That all bonds, fees and deposits be posted before building permits are issued. 7.. That construction of mall development be started within two years. -2- 8. That developer install service road on west side of Sunset Avenue from Francisquito Avenue southerly 551 feet, as per letter agreement. 9. That service station pump island set -backs be shown as a minimum 15 feet from the property line. 10. That the parking layout conform to the requirements of isOrdinance No.325 and be subject to the approval of the Chief Building Inspector. That Section 8 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a. part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: The Northeasterly 586 feet of Lot 134 in -E.J.Baldwints Fourth Subdivision as recorded in Book 8, page 186 of Miscellaneous Records of Los Angeles County, State of California, except the Northeasterly 10 feet thereof and also except the Northwesterly 20 feet thereof be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the provisions of said Ordinance No.147, as amended, and all such real property and territory is hereby reclassified so as to establish said property and territory as a part of Zone C-11 under the provi- sions of said Ordinance No.147. ... SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation -3- • published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall. take effect and be in force.
