Ordinance - 423ORDINANCE N0.423 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND AMENDING SAID ORDINANCE N0.147 (Gordon). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance, as amended, classifies certain properties described as the area located on the westerly side of Orange Avenue between the Freeway Underpass and frontage Road, as Zone R=A, with potential Zone C-1 classification, as defined by the provisions of said Ordinance N0.147, as amended by Ordinance No.325 of the City of West Covina; and WHEREAS, the City Planning Commission of the City of West Covina has considered a precise plan for the development of the above described area to encourage the proper utilization of such properties; and I�MEREAS, the said Planning Commission did on June 6, 1955, and June 29, 1955, conduct a duly advertised public hearing as prescribed by law and duly considered the application of F. H. Gordon for a reclassification in the zoning of said property under said precise plan; and WHEREAS, By Resolutions Nos. 269 and 270 the said Planning Commission recommended to the City Council the approval of the said plan and requested reclassification; and WHEREAS, the City Council of the City of West Covina., pur- suant.to law, held and conducted a duly advertised public hearing and considered said application for a reclassification in relation -1- to the precise plan submitted concurrently therewith, and duly approved said reclassification, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council'of the City of West Covina does ordain as follows: That that certain precise plan and re- classification hereinabove described for the development of the • real property as aforementioned, in the City of West Covina, here- tofore approved as aforesaid by the City Planning Commission, be and the same is hereby approved, under and pursuant to the pro- visions of Ordinance N0.147 of the City of West Covina, as amended, for the areas hereinafter specifically described, subject to the following conditions: (1) That all street improvements outlined in Section 49 of Ordinance N0.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks. (2) That the Precise Plan conform to the proposed right-of- way of the Division of Highways. (3) That buildings not exceed one story in height. is 4 ( ) That all signs g be limited to one story Y in height. g (5) That adequate water supply and fire protection be provided as required by Ordinance No.237. (6) That all bonds, fees and deposits for improvements be posted before building permits are issued. (7) That a Plot Plan for R-3 area be submitted for approval by the Planning Commission before building permits for said R-3 area are issued. -2- That Section 8 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: That portion of Lot 112 of E.J.Baldwin's Fourth Subdivision of the Rancho'La Puente, in the City of West Oovina,County of Los Angeles, State of California, as per map recorded in Book 8 Page 186 of Maps in the office of the County Recorder of said County, described as follows: Beginning at a point in the southeasterly line of said Lot 112, distant North 410 54' 40" East 1587.04 feet from the most southerly corner of Lot 111 of said E.J.Baldwin's Fourth Sub- division; thence North 480,071 401 West 270 feet; thence parallel with the southeasterly line of said Lot 112 North 419 53' 40" East 232.46 feet to the northeasterly line of said Lot 112; thence along said northeasterly line South 480 10' 101, East 270 feet to the most easterly corner of said Lot 112; thence along said southeasterly line South 410 53' 40":West 232.46 feet to the point of beginning. Except those portions of said land acquired by the State of California by deeds recorded on September 13,1940, as instrument No.1124 in Book 17828 page 165 of Official Records of said County and on July 10, 1953 as instrument No.3158 in Book 42186 page 308 of said Official Records. be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the provisions of said Ordinance No.147, as amended, and all such real 46 property and territory is hereby reclassified so as to establish said property and territory as a part of Zone C-1, under the provisions of said Ordinance No.147, and the -,hereinafter described real property, to wit: That portion of Lot 112 of E.J.Baldwin's Fourth Subdivision of the Rancho La Puente, in the City of West Covina,County of Los Angeles, State of California, as per map recorded in Book 8 page 186 of Maps in the office of the County Recorder., of said County, described as follows: -3- Beginning at a point in the southeasterly line of said Lot 112, distant North 410 531 4011 East 1587.04 feet from the most southerly corner of Lot 111 of said E.J.Baldwin's Fourth Subdivision; thence North 480 Oil 4011 West 270 feet to the true point of beginning for this description; thence continuing North 480 07' 40" West 446.26 feet to a line which is parallel with the southerly line of land acquired by the State of California in deed recorded in Book 17828 page 165 of Official Records of said County, and passes through the most easterly corner of said Tract No.12907, as per map recorded in Book 244 pages 16 and.17 of Maps, in • the office of the said County Recorder; thence along said parallel line North 830 161 3511 East 161.97 feet to a line which is perpendicular to the northeasterly line of said lot 112 and passes through a point in said northeasterly line, distant North 480 101 1011 West 340 feet from the most easterly corner of said Lot 112; thence North 410 49150" -,East 110.12 feet to said point in said northeasterly line; thence along said northeasterly line South 480 101 1011 East 70 feet; thence parallel to said southeasterly line South 410 53f 4011 West 232.46 feet to the point of beginning. Except those portions of said land acquired by the State of California by deeds recorded on September 13, 1940 as instrument No.1124 in Book 17828 page 165 of Official Records of said County and on July 10,1953 as instrument No.3158 in Book 42186 page 308 of said Official Records. be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the ,Zoning Ordinance, as aforesaid, and all such real property is hereby reclassified so as to establish said property and territory as a part of Zone R-3, subject, however, to the development of both said prop- erties in conformance.with said precise plan and subject to all of the conditions hereinbefore enumerated. SECTION 2.
