Ordinance - 420ORDINANCE NO.420 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A . PRECISE -PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY,..PURSUANT.TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND.AXENDING ORDINANCE NO.147 (Hurst)._. THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1, WHEREAS, Ordinance No.147 of the City of West :Covina, known as the Zoning Ordinance, classifies certain properties described as -the area located on the northeasterly corner of Sunset and Merced Avenues, in the City of West Covina, as Zone R-A, with potential commercial classification, as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 4, subparagraph (1), item (3) thereof; and WHEREAS, the Planning Commission of the City of West Covina has considered the adoption of a precise plan for the development of the above described area to encourage the proper utilization of such.properties; and WHEREAS, the said Planning Commission did conduct duly advertised public hearings on June 6, 1955, and June 20,1955, as prescribed by law and duly considered said precise plan; and WHEREAS, the City Council of the.;City of West Covina did on July 25,1955, and on other dates as appears'from the minutes of .the Council, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan,,subject,"to the stipulations hereinafter - enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan No.52 for the development of the aforementioned real property, in the -1- City of West Covina, heretofore approved and adopted by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West_Covina, for the areas herein- after specifically described, subject to the following conditions: (1) That all street improvements outlined in Section 49 of Ordinance N0.225, including utilities, be installed accordingly and meet approval of the City Engineer. This to include street lights and sidewalks; (2) That a 3 foot concrete block wall be constructed along t` the northeasterly property line and a 6 foot block wall be constructed along the southeasterly property line; (3) That the developer provide and maintain planting as indicated on Precise Plan; (4) That all buildings and signs be limited to one story in height;. (5) That 5 foot sidewalks be shown and constructed in park- ways on Merced and Sunset Avenues; (6) That parking areas conform to the provisions of the Zoning Ordinance and be dimensioned accordingly; (7) That adequate water supply and fire protection be pro- vided as required by Ordinance No.237; (8) That all bonds, fees and deposits be posted before building permits are issued; (9) That pump islands in service station be set back a minimum of 15 feet from property line; and (10) That a 25 foot return be shown and maintained on property line atcorner of pierced and Sunset Avenues. That Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance,originally adopted January 21, 1948,as amended, and the Zoning Nap which is included therein and is a part thereof, -2- be and the same is hereby amended by adding thereto, as a part of the Zoning Hap of the City of West Covina, the following: The hereinafter described real property, to wit: Lots 1,2,3,10,11 and 12 of Tract No.19453 in the City of West Covina as recorded in Book 551 Pages 19 to 22 of Haps in the office of the County Recorder of Los Angeles County, California • be and the same is hereby excepted from the particular zone in which said property has otherwise been placed and designated by the provisions of said Ordinance No.147 and all such real property is hereby reclassified so as to establish said real property as a part of Zone C-1, under the provisions of said Ordinance No.147. That the reclassification hereinabove provided is subject to the conditions hereinabove enumerated and to full compliance with the precise plan hereby adopted for the development of this area. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause .the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
