Ordinance - 417ORDINANCE NO.417 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY,.PURSUANT.TO.SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA , AND . AMENDING ORDINANCE NO.147(American.Legion-Morgan-Hewitt). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance N0,147 of the City of West Covina, known as the Zoning Ordinance, classifies certain properties • described as the area located on the north side of Garvey Avenue between Willow and Sunkist Avenues, in the City of West Covina, as Zone R-A, with potential commercial classification or as Zone C-1, as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 4, subparagraph (1),item (3) thereof; and WHEREAS, the Planning Commission of the City of West Covina has considered the adoption of a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and • WHEREAS, the City Council of the City of West Covina did on July 259 1955, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise,c'Plan No.54 -1- for the development of the aforementioned real property,in the City of West Covina, heretofore approved and adopted by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas here- inafter specifically described, subject to the following conditions: • (1) That all street improvements outlined in Section 49 of Ordinance No.225, not installed by the State Division of Highway, including utilities being installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks. (2) That a 6 inch concrete curb be cohstructed along the east side of the west parking area and 2 feet inside the property line. (3) That all bonds, fees and deposits be posted before building permits are issued. height. (4) That all buildings and signs be limited to one story in (5) That the Precise Plan conform to the right-of-way of the • State.Division of Highways. (6) That a 6 foot masonry wall be erected along entire rear northerly line. (7) That parking slots in the westerly line be slanted on a southeast and southwest diagonal. (8) That any previously approved Precise Plan for the develop- ment of any part of this property, or the whole thereof, be and the same is hereby disapproved and rejected. -2- (9) That construction of the improvements upon said property as provided in said Precise Plan be commenced within a period of three (3) years from the effective date of this Ordinance. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, originally adopted January 21, 1948, as • amended, and the Zoning Map which is included therein and is a part thereof, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City: of West Covina, the following: The hereinafter described real property, to wit: Lots 10,11,12,13,14 and 15 of Tract No.11798 in the City of West Covina as per maps recorded in Book.220, pages 20 and 21 of Flaps filed in the office of the County Recorder of the County of Los Angeles, State of California be and the same is hereby excepted from the particular zone in which said property has otherwise been placed and designated by the pro- visions of said Ordinance No.147 and all such real property is hereby reclassified so as to establish said real property as a part of Zone C-19 under the provisions of said Ordinance No.147. • That the reclassification hereinabove provided is subject to the conditions hereinabove enumerated and to full compliance with the precise plan hereby adopted for the development of this area. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation -3 - i • published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take eff ect and be in force, ATTEST:/,V City er I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the'City Council of the City of West Covina, held on the 22nd day of August, 1955, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMES W.
