Ordinance - 415ORDINANCE NO.415 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT.TO.SECTION 14 OF ORDINANCE NO.147 OF THE CITY.OF WEST COVINA, AND.AMENDING. ORDINANCE NO.147 (C.H.Beattie). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of 'West Covina, known as the Zoning Ordinance, classifies certain properties described as the area located on the southwest corner of Azusa Avenue and Rowland Avenue, as Zone R-A, with potential commercial classification as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 4, subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has considered the adoption of a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and WHEREAS, the City Council of the City of West Covina did on July 11, 19559 and on other dates as appears from the minutes of the City Council meetings, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan -1- No.41, as amended, for the development of the real property located on the southwest corner of Azusa Avenue and Rowland Avenue, in the City.of West Covina, heretofore approved and adopted by the City Council as aforesaid, be and the same is hereby adopted as .an Official 'Precise Flan, under and pursuant to the provisions of Ordinance No.147 of the City of West 91 Covina, for the areas hereinafter specifically described, sub- ject to the following conditions: (1) That the area necessary for the widening of Azusa Avenue -and the alley in the C-1 area be deeded to the City of West Covina; (2) That all street improvements outlined in Section 49 of Ordinance.No.2259 including utilities and sanitary sewers, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks. All such improvements to be subject to the establishment of grades and elevations of Azusa Avenue by the State Division of Highways provided such grades and elevations be established within ninety (90) days from the effective date of this Ordinance; 9 (3) That driveway approaches to Azusa Avenue be limited to two (2) in number, 30 feet wide, one for service station and one for parking area; (4)- That a 5 foot masonry wall be constructed along westerly boundary line.; (5) That adequate water supply and fire protection As required by Ordinance No.237 be provided; -2- (6) That all bonds, fees and deposits be posted before building permits are issued; (7) That all buildings and signs in C-1 area be limited to one story in height; (8) That a two year limit be placed on'constructions of foundations in the C-1 area; w a(9) That the area shown as proposed R-3 lots be indicated as potential Zoning R-32 and subdivision meet requirements of Ordinance No.225; (10) That a 2 foot wide buffer and 6" concrete curb be provided along the northerly and easterly boundaries of the parking area; (11) That a 5 foot masonry wall be constructed along the southerly line of the C-1 area; (12) That a 10 foot sidewalk be shown on the easterly side of the proposed commercial building and 5 foot walks on the northerly and southerly sides thereof; (13) That a 20 foot corner cut-off be shown on the south- west corner of the Service Station site; and (14) That the parking lay -out be revised to conform with the requirements of the Zoning Ordinance and to provide full circulation of traffic, subject to approval of Planning Commission prior to issuance of building permits. That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, originally adopted January 21, 1948, as amended, and the Zoning Map which is included therein and is a -3- part thereof, be and the same is hereby.amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: (a) The hereinafter described real property, to wit: That portion of Lot 1, Block 20 of the Phillips Tract of the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of Calif- ornia, as shown on map recorded in Book 9 at Pages 3 and 4 of Miscellaneous Records on.file in the office of the County Recorder of said County, described as follows: The Westerly 350 feet of the Northerly 450 feet of the Easterly 367 feet of said Lot 1, be and the same is hereby excepted from the particular zone in which said property has otherwise been placed and designated by the provisions of said Ordinance No.147 and all such real property is hereby reclassified so as to establish said real property as a part of Zone C-1; (b) That the hereinafter described real property,to wit: The Westerly 634.23 feet of said Lot 1, excepting therefrom the Westerly 350 feet of the Northerly 450 feet of the :Easterly 367 feet of said Lot 1, be and the same is hereby excepted from the particular zone in which said property has otherwise been placed and designated by the provisions of said Zoning Ordinance and all such real property is hereby reclassified so as to establish said property as a part of Zone R-3 under the provisions of said Ordinance No.147. That the reclassifications provided in subsections (a) and (b) of this paragraph are subject to the conditions hereinabove enumerated and to full compliance with the precise plan, as revised, -4- hereby adopted for the development of this area. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general • circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. i- yoof the city of Westovina ATTEST: City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the 8th day of August, 1955, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMEs W.
