Ordinance - 405ORDINANCE NO. 405 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECIS"E PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTI"ES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND AMENDING ORDINANCE NO.147 (Drendel and Keeling). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known.as the Zoning Ordinance, classifies certain properties described as the area located on the southwest corner of Azusa Avenue and Puente Avenue, as Zone R-A, with potential commercial classification as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 4, subparagraph (1), item (3) thereof; and MHM�EAS, the City Planning Commission of the City of West Covina has considered the adoption of a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHERE -AS, the said Planning Commission did conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and • WHEREAS, the City Council of the City of West Covina did on May 13, 1955, and on other dates as appears from the minutes of the City Council meetings, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan -1- No.42, as amended, for the development of the real property located on the southwest corner of Azusa. Avenue and Puente Avenue, in the City of West Covina, heretofore approved and adopted by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, sub- ject to the following conditions: (1) That the,area for the widening of Puente Avenue and Azusa Avenue be deeded to the City of West Covina; (2) That all street improvements outlined in Section 49 of Ordinance N0.2251 including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks and to be subject to the establishment of grade of Azusa Avenue by the State Division of Highways in the event such grade be established within ninety days of the effective date of this Ordinance; (3)) That three (3) thirty (30) foot driveway entrances be allowed from Puente Avenue, and four (4) thirty (30) foot • driveway entrances be allowed from Azusa Avenue, as indicated on the Revised Precise Plan for this area hereby adopted; (4) That a two (2) year time limit on construction of foundation be placed on approval of Precise Plan No.42; (5) That no building be over one story in height; (6) That adequate water supply and fire protection be provided as required by Ordinance No.237; and (7) That all bonds, fees and deposits for improvements be posted before building permits are issued. -2- That Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, originally adopted January 21, 1948, as amended, and the Zoning Map which is included therein and is a part thereof, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: (a) The hereinafter described real property, to wit: That portion of Lot 1, Block 17, of . the Phillips Tract, in the City of West Covina, County of Los Angeles, State of California, as shown on map recorded in Book 9 at Pages 3 and 4 of Miscellaneous Records, on file in the office of the County Recorder of said County, described as follows: The southerly 260 feet, of the westerly 300 feet, of the northerly 267 feet, of the easterly 317 feet of said Lot 1, excepting therefrom the northerly 157 feet of the easterly 167 feet be and the same is hereby excepted from the particular zone in which said property has otherwise been placed and designated by the provisions of said Ordinance No.147 and all such real property is hereby reclassified so as to establish said real property as a part of Zone R-3 in order to permit the use of said property for the erection and maintenance on said property of medical and other • professional buildings only (not including business buildings permitted in commercial zones as defined and enumerated in said Ordinance No.147 as amended). (b) That the hereinafter described real property, to wit• The southerly 150 feet of the westerly 150 feet of the northerly 157 feet of the easterly 167 feet of said Lot 1 aforesaid be and the same is hereby excepted from the particular zone in which said property has otherwise been placed and designated by the -3- provisions of said Zoning Ordinance and all such real property is hereby reclassified so as to establish said property as a part of Zone C-1 under the provisions of said Ordinance No.147 and to permit the use of said property for the maintenance thereon of a filling station in conformance with the provisions of said Zoning Ordinance and as therein defined. • That the reclassifications provided in Subsections (a) and (b) of this paragraph are subject to the conditions hereinabove enumerated and to full compliance with the precise plan, as revised, hereby adopted for the development of this area. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a. hewspaper of general circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
