Ordinance - 403ORDINANCE NO.403 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A . PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTI*ES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE N0.147 OF THE CITY OF WEST COVINA, AND AMENDING SAID ORDINANCE NO.147 (Britt). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of • West Covina, known as the Zoning Ordinance, as amended, classifies certain properties described as the area located on the southeast corner of Merced Avenue and Sunset Avenue, as Zone R-A, with potential.Zone C-1 classification, as defined by the provisions of said Ordinance No.147, as amended by Ordinance No.325 of the City of West Covina; and WHEREAS, the City Planning Commission of the City of West Covina has considered a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did conduct a duly advertised public hearing as prescribed by law and duly considered the application of Harry M. Britt and Olive M.Britt for a re- 0 classification in the zoning of said property under said precise plan; and WHEREAS, by Resolutions Nos.192 and 193 the said Planning Commission recommended to the City Council the disapproval of said plan and requested reclassification; and WHEREAS, the City Council of the City of West Covina, pursuant to notice of appeal duly filed hereunder, did on -1- • • September 27, 1954, hold and conduct a duly advertised public hearing as prescribed by law and considered said application for a reclassification in relation to the precise plan submitted concurrently therewith, and duly approved said reclassification, subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain precise plan and reclassification hereinabove described for the development of the real property as aforementioned, in the City of West Covina, heretofore disapproved by the City Planning Commission, be and the same is hereby approved, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, as amended, for the areas hereinafter specifically described, subject to the following conditions: (1) That the required area for widening of Sunset Avenue and Merced Avenue be deed to the City of West Covina; (2) That all street improvements outlined in Section 49 of Ordinance No.225, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers; (3) That adequate water supply and fire protection be provided as required by the provisions of Ordinance No.237; (4) That all bonds, fees and deposits for improvements be posted before building permits are issued; and (5) That all proposed street improvements including sidewalks and driveways be shownyon plan. -2- That Section 8 of Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: That portion of Lot 138 of E.J.Baldwin's • Fourth Subdivision of a portion of the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as shown on map recorded in Book 8, at Page 186 of Maps, on file in the office of the County Recorder of said County, described as follows: The southwesterly 200 feet of the south- easterly 200 feet, of the northeasterly 210 feet, of the northwesterly 220 feet of said lot be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the provisions of this section, and all such real property and terri- tory is hereby reclassified so as to establish said property and territory as a part of Zone C-1, under the provisions of said Ordinance No.147, subject, however, to the development of said property in conformance with said precise plan and subject to all • of the conditions hereinbefore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) -3- days from and after the final passage thereof said Ordinance shall take effect and be in force. • ATT`EST: City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the 27th day of June, 1955, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMES W.
