Ordinance - 397ORDINANCE NO.397 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA., CA.LIFORNIA, ADOPTING A..PRECISE.PLA.N FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF.THE CITY.OF WEST COVINA., AND.AMENDING SAID ORDINANCE NO.147 (Elliott). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147-of the City of West Covina, known as the Zoning Ordinance, as amended, classifies • certain properties described as the area located on the northeast corner of Garvey Avenue and Barranca street, as Zone R-A., with potential Zone C-1 classification as defined by the provisions of said Ordinance No.147, as amended by Ordinance No.325 of the City of West Covina; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on A.pri1 4, 19559 conduct a duly advertised public hearing as prescribed by law and duly considered the application of Thompson A.. Elliott and Zillah Elliott for a reclassification in the zoning of said property under said precise plan; and 1gHEREA.S, by Resolutions Nos. 251 and 252 the said Planning Commission approved said application and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on April 25, 1955, hold and conduct a duly advertised public hearing as prescribed by law and considered said application for a 1• reclassification in relation to the heretofore approved precise plan thereat and duly approved said reclassification, subject to the stipulation hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain reclassification herein - above described for the development of the real property located on . the northeast corner of Garvey Avenue and Barranca. Street, in the City of West Covina, heretofore approved by the City Planning Commission, be and the same is hereby approved, under and pursuant to the pro- visions -of Ordinance No.147 of the City of West Covina, as amended, for the areas hereinafter specifically described, subject to the following conditions: 1. That the required area for widening of Barranca Street to an 80 foot width be deeded to the City of West Covina.; 2. That all street improvements outlined in Section 49 of Ordinance No.225, including utilities that are not proposed for install- ation by Division of Highways, be installed accordingly and meet the approval of the City Zngineer. This to include street lights and sidewalks along the service road and Barranca Street; • 3. That the boundary of the development conform P with the proposed right-of-way of the Division of Highways; 4. That access to the property be limited to the one drivway on Barranca Street 3j 5. That a 6 foot masonry wall be constructed along the northerly and easterly boundaries of the property when the property on the northerly and easterly side is developed to residential purposes; -2 - 6. That adequate water supply and fire protection be provided; 7. That all bonds, fees and deposits for improvements be posted bef ore.building permits are issued; 0 on plan; 8. That disposition of existing buildings be shown 9. That all proposed street improvements including side- walks and driveways be shown on plan; and 10. That a two (2) year time limit be placed on start of construction of buildings. That Section 8 of Ordinance No.147 of the Cityc.of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: Those portions of Lot 5 in Block 25, and of Lot 8 in Block 26 and of the vacated street lying between said Lots 5 and 8, in the Phillips Tract, in the County of Los Angeles, State of California, as per map recorded in Book 9, Pages 3 and 4 of rliscellaneous Records 141 of said County be and the same is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby reclassified so as to establish said prop- erty and territory as a part of Zone C-1, under the provisions of said Ordinance No.147, subject, however, to all of the conditions hereinbefore enumerated. -3- 0 • SECTION 2, The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be pub- lished once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. mayg, or the -ity of West Lovina A.T T:F City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the 23rd day of May, 1955, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMES W.
