Ordinance - 384ORDINANCE NO. 384 AN ORDINANCE OF THE. CITY COUNCIL OF THE: CITY OF WEST COVINA,. CALIFORNIA, REGULATING THE DESIGN, CONSTRUCTION,. MAINTENANCE OR:. ALTERATION OF GRADING, EXCAVATIONS. AND FILLS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND DECLARING THE. URGENCY HEREOF. THE: CITY COUNCIL OF THE. CITY OF WEST UCQVINA .DOES ORDAIN AS FOLLOWS: SECTION 1. PURPOSE. The prpose .of. this Ordinance is. to provide minimum standards for the protection oP1 fe, limb, property and public welfare by regulating and controlling the design, construction, quality of materials, us:e, location. and maintenance of grading, excavation and fill within the City of West Covina. SECTION 2'. SCOPE.. The provisions of this. Ordinance shall apply to .all new grading, excavations and fills., or changes, additions, repairs or alterations made to existing excavations or filla within the City of West Covina, unless specifically exempted under the. next section. SECTION 3. EXEMP'TIONS. The provisions of the Ordinance shall not apply to any of the. following: .a. Work in a public street,, sidewalk, alley or other public property, unle:s.s in the opinion of the Chief Building ,Inspector such work affects the • .support of structures_ or buildings regulated by the Building Code:. b. The mining, quarrying, excavating, processing, or stockpiling of rock, sand, aggregate or clay,unless, such work affects the support of adjacent or .contiguous propertyorstructures., c. Excavating or depositing any material by the City of. West Covina, its. departments or employees within the scope of thel it employment by the City. SECTION 4. RULES OF INTERPRETATION. If, two- or more. pertinent limitations are not identical, those limitations shall prevail which provide the -2- greater measure of safety to life, limb, property or public. welfare.. The permissive, provisions. of this. Ordinance shall -not be presumed, to, waive any limitations imposed by other ordinances of. the City of West Covina or laws. of .the Statd of California. But neither the is.s.uance by the City :of West Covina of a permit under the. provisions, of this Ordinance nor the. compliance with the provisions hereof, or with any additions. imposed in. • the. permit issued hereunder, shall relieve any pe:rs:on from responsibility for damage. to other persons, or property, nor impose .any liability upon the City of West Covina, for damage. to other persons or property. SECTION 5. DEFINITIONS. Wherever used in this.'Ordinance the following words, shall have the meaning indicated - BUILDING CODE: shall mean the. Building Code 1953 as.: dopted by the .City of We,st Covina. BUILDING PERMIT shall mean a permit. issued_ by the. Building De- partment for the construction, erection or,alte-ration of:.a structure or building. CHIEF .BUILDING INSPECTOR. shall mean the Chief. Building :Inspector of the City of West Covina. • CITY ENGINEER .AND. SUPERINTENDENT OF STREETS .shall. mean the City Engineer and. Superintendent -of Streets. of the City of West Covina. EXCAVATION shall mean any, act by which earth, sand, gravel, rock or any other similar material is cut. into, dug, quarried, uncovered, removed, displaced, relocated. or bulldozed and shall include .the conditions. resulting thtirefrom. ,FILL shall mean any act by which earth, sand, gravel, rock or any other material is. deposited, placed, pushed, dumped, pulled, transported or _3.. moved. to a new location and shall include the conditions resulting .therefrom. GRADE shall mean the elevation -of, the eXisting ground .s:tirface at the location of dny:.pxopos:ed excavation or fill. GRADING shall meanexcavation-ox fill or any bombination thereof, and shall include. the .conditions resulting from any excavation or fill. GRADING PERMIT shall mean any permit required by Section 7 of this .Ordinance.. • PERMITTEE; shall:mean any person to. whom a grading permit is issued. PERSON shall mean a natural, pe.rs:oh, his. heirs, executors, adminis.« trator or assigns,,., and .also. includes, a firm, partnership or corporation, its. or their successors or ass.igns., .or .the agent of any, of the aforesaid. SITE .shall mean -a .lot or parcel, of land, or a series -of lots or parcels. of land, joined together, where grading work is. continuous. and performed at the, same. time. SECTION 6. MAINTENANCE. The. ,owner of any property on which, an. excavation or fill has. been made shall maintain. in. good condition' and repair all retaining walls, cribbing, drainage structures and, other protective devices.. • SEC.TION 7. PERMITS.. WHEN REQUIRED. No person shall. commence or perform any grading, excavation or fill without there first having been. ob.- tained-a grading permit soto do from the Chief Building Inspector. A separate grading permit shall be. required for each. site. One permit may cover both an excavation and .any fill made with .the excavated materials. on the same site. One permit may, cover both an excavation and any fill. made with the excavated materials, ,on the. same situ. SECTION 8. PERMITS, EXCEPTIONS. Algrading permit shall. not -4;. be required in the following .exceptions.;. but in all other respects, the, provisions provis. w iohs of this. oirdirianpe, shall apply. A.. An excavation below finished grade for basiements and .0 f otings. of a building, swimming pool, or underground. structure authorized by a valid building permit.. This exception: shall. not affect the.applicability of this.: ordinance to, nor the requirement of grading permit for, any fill made with, the mate r ial .fr6m.suc'h'-exdaVati6.n. - A grading permit shall. not be required. for the temporary stotkpiling.on the same site of the material from s.-Lich-an.excavatioh. • SECTION 9. APPLICATION FOR PERMIT. , An appli' antlor a grad3*n'g C permit shall first file an- application therefor in,. writi3xgwith the -.Chief. Building Inspector. Every application shall: A. Describe the land on. whichthepropqs,ed work is. to be done, by lot, blo.tk,, tract, and. street- address, or similar -description that will readily identify and, definitely locate the pr6pos.6d work. Be, accompanied by plahs,- and spe-cifications., including., a contour A -5.= map showing the present contours of the land and. the proposed contours of the. land. after completion of, the proposed grading; a. plot. plan showing,the. location. of the grading, bouridaries; lot lines, neighboring public- ways. and sufficient dimensions, and. other data to show the location of all work; Said map shall. indieate, in, addition to the data on •propo.sed grade changes, all data..available on the -type of soil, details. on, drainage, structures., walls, • eribbing.;and surface pr.otections.'and larids:caping, together with estimated. dates, for ,starting and, completing the work; and such. other information that the Chief Building Inspector may require to carry out the, purposes, of this Ordinance. All plans. shall bear the riame of the person re,s.ponsible therefor and shall be submitted to the Chief Building Inspector in duplicate. C: State. the estimated date !or the starting, and completion of the grading work. D. Show the- name of the Permittee, who. shall be responsible for the correctness. of the work and for requesting the inspections. required herein.. SECTION 10_. APPLICATION FOR PPERMIT. WAIVER OF DETAILS. The. Chief Building Inspector may waive the requirement for any or all. plans. • and s.pecifications.. specified above if he finds that the information on the appli- cation is, sufficient -to show that the work will conform to. the provisionsof this, Ordinance: SECTION 1.1. PERMIT FEES. - Before. issuing any grading permit, the Chief Building •Inspector shall, collect a permit fee in .the following ,amounts: Grading Permit Fees - 500 Cubic Yards..or less. . . . . . . . . $ 8.00 500 _ 1000 Cubic Yards. or Lass.. . . . 10. 00 More than 1000 Cubic..Y.ards . . . . . 10.00 plus- $3.. 00 for each ,additional. 1000 cubic yards or major portion thereof. All'ehgineering„inspe.ction and testing fees hereinafter required by the Chief Building Inspe-ctor .shall be paid by the pe.rmittee.. SECTION 12. EXPIR:A.TION OF PERMIT. Every grading permit, shall. ex - pine by limitation and. become null. and void if. the: work .authorized by. such.permit • has not been .commenced within. 60 days -.or is not completedwithin one year from date of. issue,,, except that the Chief Building, In's.pe:ctor may, ifthe permit. holder presents- satisfactory evidence. that unusual difficulties. have: prevented work being .started or completed within- the specified. time limits,, grant a reasonable exten-- s:>ion of time on. said permit, provided that. the application for the extension of time is -made before the dateof expirationof: the permit. SECTION. 13. DENIALS. OF PERMIT. Where,.. in the opinion of the Chief Building Inspector; the work as proposed by the applicant. is likely to endanger any property or public way, he shall. deny the grading permit. Factors to be cons-ide:red in- determining probability of hazardousconditions-- slAl. include, but. not be limited to, possible saturation by -rains:,- eartbknovements, run-off, of, sur- face waters: and sub -surface donditions such -as. the stratification and faulting of • rock,nature and type of soil -or rock. . Failure of the: Chief Building Inspector to: observe or recognize: hazardous. conditions or to fail to deny the: grading permit shall not relieve the -owner or his agent for responsibility for the. condition .or damages resulting therefrom, and shall not result in the City of West Covina, its -officers or agents., being- responsible for the conditions or damages resulting therefrom. SECTION_ 14. MODIFICATION OR DENIAL IN WHOLE OR: PART OF PERMIT RIGHT TO APPEAL. M -7- (a) In, the event that the Chief Building Inspector modify or deny in whole, or in 'part, any, application, for- a permit as. provided for in this Ordinance, within five (5) days.of such action he shall notify applicant in writing by registered. United States. mail of such modification or denial,. stating the reasons. 4therefor. (b) In. the event .the Chief Building Inspector modify or deny in whole or in part. ;any application for a permit as provided for in, this. -:Ordinance, applicant may file with .the City Clerk,.a written notice of appeal to the City Council from such. • de-dsion,. Such notice of appeal must be filed within, ten, (1.0.) days, of the mailing of the notice provided for in subdivision (a) of this, section.. -.In such event the City Clerk shall set the hearing on such. appeal before the City Council for the, second, succeeding, regular meeting of.the. Council after the, date -of filing such notice. At the time applicant files such notice, he shall also file with .the. City Clerk a list of the names.: andaddresses of all owners -of, property within. a radius. of 500 feet of the propo:s,ed.exterior boundaries, of the proposed excavation,, as such names and a.ddresses,.appear on the, last equalized' assessment roll of the City. (c.) The. City Clerk shall mail, notices. of such hearing, at least ten (1.0) days before the date. set therefor, addre.ss.ed to the applicant and. to: owners. of the • property within a 5.Q0, foot radius of the exterior boundaries..of such proposed ex- cavation as their names land addresses -appear on the last assessment rolls of the City. (d) At least .ten-(10') days, before the date. Set for such hearing, the Super= intendent of Streets shall post printed copies of such notice hearing title "Notice. of Excavation" in black .letters' at least three (3) inches, in height; not more than. 300 feet apart, for a distance of at least 1000 feet from the exterior boundaries of the proposed excavation on each public street or highway approaching the am proposed excavation. (e) At the time set for such hearing the Council may summon witnesses and hear evidence relating to such. application. The. Council may continue the hearing from time _to time. At the conclusion thereof, the Council shall make its findings, thereon and may grant or deny such -application, or make such modifications. with reference thereto as it may deem fit. The. findings.. and • order of the Council, shall, be final and conclusive on applicant,. and no applicai- tion for the same purpose may be made for -one year after the date of. such findings and order. SECTION 1.5. REVOCATION OR SUSPENSION OF PERMIT. Any permit granted hereunder may be revoked only by the Council asin its dbseretion may seem reasonable and just for any reason for which .the issuance of such permit might lawfully be denied, or for any failure .to comply with any of the .terms of this' Ordinance or -of such permit. Revocation of such. permit shall_ be made only upon a hearing before the Council,. after at least five (5) days.' notice to permittee. Such notice shall be in writing mailed by registered United. States mail addressed to permittee at his business or residence address -as • stated in his, application for a permit. SECTION 1,6. REVOCATION - NOTICE. All provisions. of Section #14 for giving notices to. persons. other than permittee, hearings, findings, orders, and conclus.iveri.ess of such findings. and orders.shall apply to this section; provided, however, that the minimum time for any notice required by this section shall be five (5) days. The Chief Building Inspector or Council may suspend, any permit granted hereunder pending the hearing herein provided, where, in hisor its opinion, ME the public health, safety or welfare require it. SECTION 1.7. INSPECTIONS. a. INSPECTION BY DEPARTMENT. The Chief. Building Inspector, shall, when requested, make the. inspections hereinafter required and shall either approve that portion of the work completed, or shall notify the permit holder wherein the same fails to comply with this ordinance. Where it is found by • inspection. that .the soil or other conditions -are not as stated or shown in the application for a grading permit, the Chief Building Inspector may refuse to approve .further work until approval. is. obtained for a revised grading plan conforming ,to. the existing conditions. Plans.for grading work, bearing the stamp of approval of the Chief Building Iti.,spector, shall be maintained at the site during #he progress. of the grading ,w.ork and until the work has been approved. The permittee shall notify the Chief Building Inspector in order to obtain inspections. in accordance with the following schedule at least 24 hours_ before said inspection is J;to be made. 1. INITIAL INSPECTION. When the permittee or his agent is ready to begin work on an excavation or fill and before any grading is, started. • Z.. * ROUGH GRADING. When all rough grading has, been completed. 3. SPECIAL STRUCTURES. When. excavations, are complete forretaining and crib walls and when reinforcing steel is in place and before concrete is poured. 4. FINAL INSPECTION. When all work, including installation of all drainage and other structures has been completed. b. SPECIAL SUPERVISION. When required by the. Chief.Building In- -1A- spe.ctor,, in accordance with Section 23 of this Ordinance, inspection of corn= paction, of fills shall be done,by :a. Civil Engineer, licensed by the. State of California, o-r other approved testing agency. A report, - prepared and signed. by said engineer or testing, agency shall be -submitted to said Chief Building Inspector upon. com= pletion..of .the work, and shall show the following. 1. A contour map showing .the original,..and finish, surfaces of. .the .areas filled. • 2. The unit.. foundation bearing. value recommended on the compacted fill. 3. - A description. of the materials, used in the fill.and.the procedure of deposit and compaction, including th,e preparation, of original ground surface, before. making the fill.. 4. A plan, showing the location of tests made in the fill; together with -a tabulation, of the per cent compaction obtained in the various tests.. 5. A statement that: all work was dome iri :conformity with the provisions of this Ordinance. SECTION, 18. SPECIAL. PRECAUTIONS. If,. at any stage of the work.on an..excavation. ,or fill, the Chief .B,uildirig Inspector determines by in spe:ction .that thenature of the formatioii .is such,.that further work.a:s ',zauthorized by an existing permit. is likely to, endanger any. property or. public. way, . the Chief • Building Inspector may require as a condition to, allowing .the work to, be done; that such. reasonable. safety precautions be taken -as -the Chief Building Inspector considers advisable .to .avoid such_likelihood :of danger. ' "Special ,Precautions" may include, but shall not be limited to, s.pecifying,a. flatter exposed, slope; construction of. additional drainage_ facilitie-s; berms.,terracing, compaction or -cribbing. SECTION 1.9. GRADING CERTIFICATE:. If, upon final ixis.pection of any excavation or fill, it is found that the work authorized by the grading permit .has been satisfactorily completed in accordance with the requirements of this Ordi- nance, and. any other -requirements imposed, a gradingcertificate covering such work, and stating that the work is approved, shall, upon request, be issued to. the 'owner by the. Chief Building Inspector. The Chief Building Inspector shall have: the power to revoke any grading .certi- ficate whenever he..finds that the work..covered.by, the certificate has been materially extended'or altered, without a permit s.o-to. do, or that any retaining walls, cribbing, drainage structures, -or other protective devices as shown on the approved plans and. specifications s:ubmitted.wiih the-application..for a permit, have not been main- tained in good order. and repair. Before such revocation, the. Chief Building Inspector shall first give written notice tothe owner of the property. involved, specifying the defective condition and stating that unless such -defective condition isremedied satisfactorily, the grading certificate may be revoked. If. the defective condition is remedied, the certificate shall not be revoked. SECTION 2.0 EXCAVATIONS. NO- excavation shall be made with a. cut face .steeper in slope than one horizontal to one vertical, except under the following co.nditionsa a. The excavation is- located so that a line having,a. slope of one horizontal • toonevertical and -pas .sang through. any portion of the cut face will lieI entirely inside the: property lines of: the property or within -the property lines of any sub: - divided parcel of s.aid.'pro-perty on which said excavation is made. b. The: material. in which the. excavation, is. -made is. sufficiently stable to sustain a .slope of steeper than one horizontal to one. vertical, and a written state- ment of an independent CivilEngineer, licensed by the State of California, approved by Chief Building, Inspector and .experienced in erosion control, to that -12:- effect is submitted and approved. . The statement shall .state that the site has been inspected'and..that the deviation from the slope specified above will not re sult in property damage. c. When a. retaining wall or other approved. support is provided to support the. face or a portion of -the excavation-, the above limitations. shall apply only to. the slope. of the excavation or, fill above the.top, of the support -or- retaining wall. • The Chief Building Inspector may require an ,excavation to be made with a cut faceflatter in. slope than one horizontal to- one vertical, if he finds the material in. which the excavation isto be made unusually subject to erosion, or if other conditions make such flatter cut slope. necessary for stability and safety. Excavationsshall not extend below the angle of repose or natural slope of the soil under the nearest point of any footing, or foundation of any building or structure, unless such. -footing, or foundation is.. first properly underpinned or protected'against settlement. SECTION 2.1. FILLS. .All fillsand fill slopes: shall be constructed within the. property owned by the applicant or within the property lines of any subdivided parcel of said property. No fill, shall be made which creates any exposed surface • steeper in slope than one and'one-half horizontal to one vertical, except under the following conditions.: a. The fill, in the opinion of the Chief Building -Inspector, is located so that settlement, sliding .or -erosion of the fill material will not result in property damage or a hazard"to adjoining property, streets or buildings.. b. A. written statement from an independent Civil Engineer approved by Chief Building Inspector .experienced in.'er:osion control and licensed by the State of Calif- ornia, certifying that he has. inspected the site and. that. the proposed. deviation from the slope specified'above. will not endanger any property, or result in property damage, is. submitted to and approved by the Chief Building ,Inspector. =1.3= The Chief Building Ins.pec.tox .may require that the fill be constructed with ari,.expose,d surface flatter than one and one=half horizontgl. to one vertical, if he finds that, under the 'particular conditions; such, flatter surface is necessary for stability and. safety. SECTION 2.2. DRAINAGE.. Adequate. pr.ovis,ions shall. be made to. prevent. any surface, waters from damaging the cut face: of an, excavation_ or .the • sloping surface, :of -a. fill. All drainage. provisions.' ahall be of such design. asto carry surface waters to. the nearest practical street, storm drain or natural water course approved by the. City Engineer and, Chief Building .1nspecto.r as a safe place to deposit and receive such, waters:. The, Chief. Building Inspector may require such, drainage -structures,. or piping to: be. constructed or installed_ which, in, his. opinion, .are neces:s.ary to prevent. erosion, damage and, tosatisfactorily carry off surface, waters,. SECTION, 2.3. C.OMPACTION::OF FILLS. All. fills .intended to support buildings., structures, or where otherwise required, to be. compacted for stability of material, shall be compacted, inspected and tested, in accordancei with the follow= ing provi ions: • a.. The natural ground surface shall be prepared. by removal. of top soil and vegetation, and, if ne.c.essary, shall. be graded .to, a series, of terraces.. b. The fill shall be spread. in a. series, of layer.s., each not excedding six (6) inches. in thickness, and ,shall be compacted. by sheeps.foot. roller or other approved method after. each. layer is. spread. c. The, moisture content, of the fill. material, shall be controlled at the .time of spreading... and. compaction to. obtain, maximum density. d. The fill material after compaction shall have minimum relative density -1.4- of not less than ninety per cent (90%) of maximum density, as determined by the Modified AASHO Soil Compaction.Test, or other approved .testing method giving equivalent test. results, in all portions -of the fill requiring compaction. e. A written report of the .compaction, showing location, and depth of test holes., materials. used,. moisture: ,conditions, recommended soil bearing pressures, and, relative densityobtained from all tests,, prepared by an independent. Civil Engineer approved by Chief. Building_ Inspector, licensed. by the State of California • or other approved testing agency approved by Chief Building Inspector, shall, be submitted to. the- Chief. BuildingJns.pector for approval. The Chief Building .Inspector may require additional tests or information, if, in, his. opinion, the conditions or materials. are such that additional informa- tion is. necessary- and may modify or � delete any .of the above -listed requirements that, in his. opinion, are unnecessary. SECTION 24. R:ELATIONSHIF .OF BUILDINGS TO CUT AND' FILL SLOPES. No: building ,or structure shall be located. closer than: a. . 15 feet from the: top of a fill slope.. b-. 15feet from the toe of a cut or.fill slope. Unless retaining walls or other devices satisfactory to the Chief Building, Inspector - are provided to protect said. structures: a.nd.all other property related thereto. SECTION 25. AREA OF BUILDING SITE. ON LOTS. CREATED BY CUT AND FILL, METHODS. Each building site created by cut: and fill methods shall have: an area of at least four, thousand. (4000)square. feet; said building site shall have a. surface slope not to- exceed one vertical in each. five horizontal. feet. SECTION 26, FAITHFULPERFORMANCE BONDS a. Ifin the opinion of the Chief Building. Inspector the nature .of the work. is such- that. if left incomplete it will create a hazard to human life or endanger -15- adjoining property'or'prope.rty at a. higher or lower level,. or, any street or street improvement, ,or .any public property, the Chief. Building Inspector may,, before issuing ;the permit, require: a cash bond or surety bond in a form satisfactory to- him..az d-approved by the City Attorney, in, .the sum of one. hundred, per- cent (10016) of, the estimate. cost of_ the work :conditioned upon..the faithful performance of the work, within the. time specified by the. Chief Building Inspector or within .any ex: . tension thereof granted. by the Chief Building Inspector. SECTION 2.7. LIABILITY INSURANCE. If, in, the opinion. of the Chief B.uildiiig .Ins.peetor,the nature of the work is such, that it might create..a. hazard. to human, life. or, dndariger adjo.inixig,property or property at -a higher or lower level, or any street or street improvement, or any other public property, then. the Chief Building; Inspector. may, .before issuing the permit, require that the applicant fo:r';a permit file a certificate showing that he is, insured against claims, for damages, for -personal injury as. well as claims for property: damage. (including damage to. the. City by deposit or washing of material. ,onto: City streets,) 'which may arise, from or out of the: performance of the work, whether `ouch, performance be by himself, his. subcontractor, or anyone directly o'r indirectly employed by him, and the amount of such. -insurance shall be prescribed. • by the: Chief, Building Inspector in accordance, with the nature of the. risks. involved. Any -such insurance. shall. include protection against liability arising from completed. operations,: SECTION, 28. ' RETENTION OF PLANS. Flans. and. Specifications for grading -which, in the opinion of the Chief Building Inspector, are of sufficient size or importance,, and all plans., .specifications; and test reports, of compacted fill, designed to support a building, orother structure, shall, be permanently retained,. -16- Plans: and. Specifications for other work may be destroyed by the Chief Building, Inspector- one year -after the completing ,of the grading work. SECTION 2-9. VIOLATIONS. No: person,. firm or corporation shall con- struct, enlarge, alter, repair, or maintain any grading, excavation or fill,. or cause the same. tol be done, contrary to or -in_ violation of any provision. of this: ordinance. • SECTION 30. PENALTY. Any person. violating or­permitting,or res.pon- sible:-for the violating of any of the provisions :of. this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a. fine of not more than five hundred dollars.. ($500.. 00) -or by imprisonment in the City Jail of the City of West Covina, or in the County Jail :of. the County of. Los. Angeles., California, as the committing magistrate may direct, for a period - of not more than six (6) months., or by .both such, fine -and: imprisonment. Every such person continuing-, -committing,. or permitting the- violation of any provisions of this.. Ordinance shall be deemed guilty of a s.eparaie.•.offensefor each and. ,every -day or portion: of any: day during which any -violation. of any provisions of. this Ordinance iscommittecl or permitted. SECTION 3.1. This..
