AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, GRANTING VARIANCE TO PERMIT THE MAINTENANCE OF A.
NURSERY SCHOOL UPON PROPERTY LOCATED ON THE EAST SIDE OF LARK
ELLEN AVENUE NORTH OF WALNUT CREEK WASH,IN THE CITY OF WEST
COVINA (Clifford)
THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS:
SECTION 1. WHEREAS, there was filed the petition of
Elaine Clifford requesting a variance under the provisions of
�_- Ordinance No.147 of the City of West Covina, as amended, to permit
the maintenance of a Nursery School upon property owned by the
applicant and located on the east side of Lark Ellen Avenue north
of Walnut Creek Wash, in said City; and
"WHEREAS, after due notice as required by the provisions of
Ordinance No.147 of the City of West Covina`, -public hearings were
duly held on such application by and before the City Planning
Commission and the City Council and all interested parties were
given a full opportunity to be heard; and
`WHEREAS, in the opinion of this Council the proposed vari-
ance to provide for the special use as a Nursery School of the
hereinafter described real property would not be detrimental to
the public welfare nor injurious to surrounding property and would

not adversely affect the comprehensive general plan of the City;
NOW, THEREFORE, BE IT ORDAINED that the aforesaid petition
for a variance be approved and granted and that the hereinafter
described real property be permitted to be used for a Nursery School
as provided in said Zoning Ordinance for the following reasons:
1. The variance requested by petitioner is not contrary
to good planning practice, and if permitted as herein recommended

and subject.to the conditions hereinafter enumerated, would have
no harmful effect on the properties in the same general area.
That the real property herein involved is located in the City of
West Covina, County of Los Angeles, State of California, and is
more particularly described as:
That portion of Lot 192 of E.J.Baldwin's Fifth
Subdivision of a portion of Rancho La Puente,
said lot commencing at the northwest corner of
Lot 192; thence 10 041 west"257 feet; thence
north 870 321 east 972 feet; thence north 10041
east to south line of Tract No.16952; thence
west and following boundary line of said tract
to north line of said,lot; thence west thereon
to beginning
for the purpose of the maintenance of a Nursery School, as aforesaid,
subject, however, to the following conditions:
1. That adquate fire protection be provided as required by
Fire Department Report dated December 20,1954, to -wit:
(a) Inside entrance to basement be closed.
(b) Heating, plumbing and wiring to be inspected and
approved by City Building Department.
(c) All exit doors to -swing in direction of egress.
(d) Provide fire extinguishers and hoses in kitchen
.. and other designated areas.
(e) Remove all dry leaves, vines, weeds, bushes, and
trees in all designated areas and keep clean at
all times.
(f) Provide and maintain Fire Department entrance on
Leaf Street.
(g) Provide and maintain locked gate at stairway to
second floor.
(h) Children not to be permitted in basement or second
floor of large building permitted to be used
hereunder at any time.
(i) Meet all requirements of the State Fire Marshal.

2. That the proposed right-of-way of Los Angeles County
Flood Control Right -of -Way be excluded from the subject area.
3. That the applicant request temporary access to the south
end of Leaf Street and that a dust -proof driveway there be provided.
4. That a time limit of five (5) years be placed on this
is
variance, or as long as Elaine Clifford is operator, whichever
is the shorter time.
5. That no new buildings be added to the property described.
6. That the play area be confined to the southerly portion
of the property and that the easterly 100 feet be excluded from
the play area.
7. Use for entire parcel be confined to existing buildings
as shown and indicated on plan on file.
8. Two buildings to the east be excluded from the special use
hereby granted and'the use confined only to the large building on
said property.
SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance, and prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published
once in the West Covina Tribune, a newspaper of general circulation
published and circulated in the City of West Covina, and thirty
(30) days from and after the final passage thereof said Ordinance
shall take ,effect and be in force.

I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular -meeting of the City Council of the City of West
Covina, held on the 14th day of February, 1955, by the affirmative
vote of at least three Councilmen, to wit:
