Ordinance - 371ORDINANCE N0, 171 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINAI CALIFORNIA2 AMENDING ORDINANCE NO. 147 and ORDINANCE N0. 325 OF THE CITY OF WEST COVINA, and ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN REAL PROPERTY. WHEREAS, Ordinance No. 147 of the City of West Covina, known as the Zoning Ordinance, and Ordinance No. 325 of the City of West Covina, being an amendment thereto, classify certain real property in the City of West Covina and properties to be annexed to the City of West Covina, and WHEREAS, said Zoning Ordinance, as amended, more particularly provides that any property annexed to the City of West Covina subsequent to the effective date thereof shall be deemed to be classified as 11R-1" as said classification is therein defined, and WHEREAS2 the City Planning Commission of the City of West Covina held a public hearing on October 4, 1954, at the hour of 8:00 o*clock P. M. in the West Covina City Hall on a change in or addition to said Zoning Ordinance, as amended, and • more particularly for the purpose of considering an application to permit the use of certain property for C-2 purposes and the adoption of a certain precise plan in connection therewith to encourage the proper development and utilization thereof, and WHEREAS, said Planning Commission did, on or before September 24, 1954, mail in the United States mail a written -1- notice of said hearing designating therein the day, hour and place of said meeting, to every person whose name and address appeared on the latest available assessment roll as an owner of any pro- perty within the territory covered by said proposed change and within not less than 300 feet of the outer boundaries thereof, . and further caused said written notice to be posted in the manner and within the time required by applicable laws and ordinances, and WHEREAS, -said Planning Commission after holding said public hearing, on October 4, 19542 by Resolutions 208 and 209, recommended to the City Council of the City of Truest Covina a change in or addition to the Zoning Ordinance, as amended, of the City of West Covina, to provide that in the event of the annexation of the territory hereinafter described, which terri- tory has been heretofore designated by Resolution No. 631 of the City Council as "West Covina Annexation District No. 125," the same should be established as'a part of Zone C-2 as defined therein; approved :x. said precise plan, designated Precise Plan • No. 35, and recommended the adoption thereof; recommended that said Zoning Ordinance, as, amended, be changed or added to in order to permit a height limit of eighty (80) feet, not in- cluding a basement or penthouse; and recommended that certain conditions hereafter enumerated be imposed in connection therewith, and WHEREAS, the City Council of the City of West Covina -2- held a public hearing on October 25, 1954 at the hour of 8:00 otclock P. M. in the West Covina City Hall on said changes or additions to .said Zoning Ordinance, as amended, and the afore- said precise plan and recommendations of said Planning Commission, and • WHEREAS, the City Clerk of the City of West Covina did, at least ten (10) days prior to October �59 1954, mail a written notice of said hearing designating therein the day, hour and place of said meeting, to every person whose name and address appeared on the latest available assessment roll as an owner of any property within the territory covered by said proposed change and within not less than 300 feet of the outer boundaries thereof, and further caused said written notice to be posted in the manner and within the time required by appli- cable laws and ordinances, and WHEREAS, said City Council, after holding said public hearing on October 25, 1954, at said hour and place, did declare the hearings thereon to be concluded, NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. That that certain Precise Plan No. 35 for the development of the real property hereinafter more particu- larly defined and described, heretofore approved and adopted by the City Planning Commission, or a similar plan for a mall - type regional shopping center, be and the same is hereby adopted -3- as an Official Precise Plan for the areas hereinafter specifi- cally described) in the event of the annexation thereof to the City of West Covina, under and pursuant to the provisions of the Zoning Ordinance, as amended, of the City of West Covina, and as an addition theretog subject2 however) to the following • conditions: (1) That the building at the northeast corner have a minimum set back of fifty (50) feet from Workman Avenue, one hundred fifty (150) feet minimum from Barranca Street, and fifty (50) feet minimum from the residential area to the south; (2) That a screen planting or a masonry wall be included on Workman Avenue and on Barranca Street with a masonry wall adjacent to residences unless the present residential property is developed for commercial purposes; (3) That the area for the widening of Barranca Street be deeded to the City of West Covina; • (4) That all street improvements outlined in Section 49 of Ordinance No. 225 on Workman Avenue and Barranca Street, including utilities, be installed accord- ingly and meet the approval of the City Engineer, this to include street lights and sidewalks; vided; (5) That sanitary sewerage facilities be pro- -4- (6) That adequate water supply and fire protection be provided as required by Ordinance No. 237; (7) That all bonds, fees and deposits for improve- ments be posted before building permits are issued; (8) That a height limit of eighty (80) feet, not • including basement or penthouse be permitted; (9) That the approval of said precise plan and the zoning change provided for herein shall be subject to the annexation of the area to the City of West.Covina. SECTION 2. That Section 3 of Ordinance No. 147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, as amended, be and the same is hereby further amended by adding thereto and as a part of the Zoning Map of the City of West Covina, in the event of the annexation thereof, the following described real property, to wit: The easterly 396 feet of Lot 2 in Block 26 of the Phillips Tract in the Rancho La Puente, as shown on map recorded in Book 9, pages 3 and 4 of Miscellaneous Records, Records of the County of Los Angeles, State of California, and Lot 1 in Block 26 of the Phillips Tract in the Rancho • La Puente, as shown on map recorded in Book 91 pages 3 and 4 of Miscellaneous Records, Records of said County, except the southerly 313 feet of the easterly 288 feet, measured from the westerly line of Barranca Street (66 feet wide), of said Lot 11 and said real property is hereby excepted from the particular zone in which said real property has otherwise been placed and designated by the provisions of said Zoning Ordinance, as amended, -5- • • and all such real property and territory is hereby established and shall be deemed to.be a part of Zone C-2 in the event of the annexation thereof, as said zone is defined by said Zoning Ordinance, as amended, except.that a height limit of eight (80) feet, not including basement or penthouse, shall be permitted upon said pro- perty, as aforesaid. The provisions of this Section are subject to all of the conditions hereinbef ore enumerated in Section 1 hereof. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the.City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect. ,and be in force.
