Ordinance - 370ORDINANCE NO, 320 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA APPROVING ANNEXATION TO, INCORPORATING IN AND 1AAKING A PIRT OF SAID CITY OF WEST COVINA CERTAIN UNINHABITED TERRITORY OUTSIDE THE SAID CITY AND CONTIGUOUS THERET02 KNOWN AS "WEST COVINA ANNEXATION DISTRICT 125." WHEREAS, under and pursuant to and in accordance with the provisions of the "Uninhabited Territory Act of 1939," as • amended, the City Council of the City of West Covina, on its own motion, has heretofore initiated proceedings for the annexation to the City of West Covina of certain uninhabited territory con- tiguous with and adjacent to the city limits of the City of West Covina in the County of Los Angeles, State of California, which certain territory is more particularly described hereinafter, and WHEREAS, prior to the initiation of said proceedings the proposal for the annexation of said territory to the City of West Covina was submitted to and reported favorably upon to the proponents thereof by the Boundary Commission of Los Angeles County with respect to the definiteness and certainty of the ® proposed boundaries thereof$ pursuant to Section 35002 of the Government Code of the State of California, and WHEREAS, said territory is uninhabited within the meaning of Section 35303 of said Government Code, and WHEREAS, said territory is contiguous to the City of West Covina and no part thereof is included within another city, and -1- WHEREAS, the City Council of the City of West Covina did at a regular meeting thereof, held on the 13th day of December, 1954, by the affirmative vote of all Councilmen, pass and duly adopt a resolution giving notice of the proposed annexa- tion, and WHEREAS, said resolution described the boundaries of said territory specifically, designated it by an appropriate name, to wit.:._ "West Covina Annexation District No. 125,11 and set and contained a notice of the day, hour and place when and where said City Council would hear protests made by any person owning real property within said territory, to wit: the 24th day of January, 1955, at the hour of 8:00 o'clock P. M. in the Council Chambers of the City Hall of the City of West Covina, 1444 West Garvey Boulevard, West Covina, California, and WHEREAS, the aforesaid time set for hearing was not less than fifteen (15) nor more than fifty (50) days from the date of the adoption of said resolution, and WHEREAS, the City Clerk of the City of West Covina has posted a copy of said resolution and notice of hearing in three (3) conspicuous places within said territory; has caused a copy of said resolution and notice of hearing to be published twice, but not oftener than once a week, to wit: on December 23, 1954 and on December 30, 1954, in The West Covina Tribune, a news- paper of general circulation published in the City of West -2- Covina; and has caused a copy of said resolution and notice of hearing to be published twice, but not oftener than once a week, to wit: on December 23, 1954 and on December 309 1954, in the Pasadena Star -News, a newspaper of general circulation published outside of the City of West Covina, to wit: in the City of • Pasadena, in the County of Los Angeles, being the county in which is located said territory, and the aforesaid posting and publica- tion was completed twenty (20) days prior to January 21+, 1955, and WHEREAS, the City Clerk of the City of West Covina has caused written notice of said proposed annexation and hearing of protests thereon to be mailed to each person to whom land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the date the pro- ceedings were initiated at the address shown on said assessment roll, or as known to said Clerk, and said notice by mail was given twenty (20) days prior to January 242 1955, and WHEREAS, no person has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk, and said City Clerk has caused the aforesaid written notice to be mailed to the Board of Supervisors of Los Angeles County twenty (20) days prior to January 241 1955, and no land within said territory is owned by any other county, and WHEREAS, there has heretofore been filed with said -3- City Clerk the written consent of the owners of all of the pro- perty within said territory that said property after its annexa- tion may be taxed equally with the property within the City of West Covina to pay the bonded indebtedness of the City of West Covina both outstanding at the date of such annexation or there- tofore authorized and to be represented by bonds of the City of West Covina thereafter to be issued, and WHEREAS, at the day, hour and place aforesaid, to wit: January 24, 1955 at 8:00 o'clock P.M., said matter duly came before said City Council at a regular meeting thereof, for hearing, and no owner of any property within said territory having filed a written protest against said annexation, and no owner of any property within said territory appearing in opposi- tion thereto, and good cause appearing therefor, NOW2 TI3EREFORE, the City Council of the City of West Covina does ordain as follows: SECTION 1. That the annexation to the City of West Covina of the territory hereinafter described, which boundary description was submitted to and duly approved by the Boundary Commission of Los Angeles County as to definiteness and cer- tainty, and which territory was designated in the resolution and notice of said Council as "West Covina Annexation District No. 125," be and the same is approved, and the territory here- inafter described be, and the same is hereby ordained to be -4- annexed to7 incorporated ins and made a part of the City of West Covina, California, and shall be taxed equally with the property within the City of West Covina to pay the bonded indebtedness of the City of West Covina outstanding on the date of such annexation for 1951 Improvement Bonds heretofore authorized and issued by the • City of West Covina or bonded indebtedness theretofore authorized and to be represented by bonds of the City of West Covina there- after to be issued. SECTION 2. The territory hereinbefore referred to7 and which is hereby annexed to and made a part and incorporated in said City of West Covina, is more particularly described as follows) to wit: Beginning at the intersection of the easterly line of the westerly 270.6 feet of Lot 2 in Block 26 of the Phillips Tract as shown on map recorded_in Book 9 pages 3 and 4 of Miscellaneous Records in the office of the Recorder of the County of Los Angeles2 with the southerly line of Workman Avenue (66 feet wide) as shown on said map; thence easterly along said southerly line to the westerly line of'Barranca Street (66 feet wide) as shown on said map; thence southerly along said westerly line to the northerly line of the southerly 313.00 feet of Lot 1 in said block; thence westerly along said northerly line to the westerly line of the easterly 288.00 feet 4of said last mentioned lot, measured at right angles from said westerly line of Barranca Street; thence southerly along said last described line to the southerly line of said last mentioned lot; thence westerly along the southerly lines of said lots 1 and 2 to above described easterly line of the westerly 270.6 feet of said Lot 2; thence northerly along said easterly line to the point of beginning. Said territory shall be designated "West Covina Annexation Dis- trict No. 125." _ -5- SECTION 1. The City Clerk shall certify to the adoption of this Ordinances and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be published once in The West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina; and thirty (30) days from and after the final passage thereof, this Ordinance shall take effect and be in force; and thereupon the City Clerk shall immediately prepare under seal a certified copy thereof, giving the date of its passage, and transmit the same to the Secretary of State of the State of California for filing, and after such certi- fied copy has been so filed, and a certificate of the Secretary of State certifying to -its filing has been received by the City of West Covina, the City Clerk shall file a copy of the map of said territory with the following: The County Surveyor of Los Angeles County; the County Recorder of Los Angeles County; the Board of Supervisors of Los Angeles County; the County Assessor of said County; the County Engineer of said County; the Board of Equaliza- tion of the State of California; and the Census Bureau of the • United States Government.
