Ordinance - 362i ORDINANCE NO.362 AN ORDINA.NCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,, CALIFORNIA, ADOPTING A..PRECISE PLAN FOR THE D1VELOPXENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT.TO SECTION 14 OF ORDINANCE NO.147 OF.THE CITY OF WEST COVINA, A.ND.A =�, DING SAID ORDINANCE NG.147 (Overholtzer- Valley Vaqueros). THE, CITY COUNCIL OF THE CITY OF WEST COVINA. DOES ORDAIN AS FOLLOWS: SECTION 1. NHEWEA.5, Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain properties described as the area located on the southeast corner of Citrus Street and Garvey Boulevard, as Zone R-A, with potential commercial classification as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 4, sub- paragraph (1), item (3) thereof; and NHER33XS, the City Planning Commission of the City of West Covina has \caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and 1,911,1REA.S, the said Planning Commission did on September 23, 1954, and October 4, 1954, conduct duly advertised public hearings as prescribed by law and duly considered the application of Mrs. '131na P.Whitcomb Overholtzer and Valley Vaqueros for a variance in the zoning of said property under said precise plan; and WHEREAS, by Resolution N0.211 the said Planning Commission on October 4, 1954, approved said application and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and -1- 4 • • WHEREAS, the City Council of the City of West Covina did on November 8, 1954, hold and conduct a duly advertised public hearing as prescribed by law and considered said application for a variance in relation to the heretofore approved precise plan thereat and duly approved said variance,.subject to the stipulations hereinafter enumerated: NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain variance hereinabove described for the development of the real property located on the southeast corner of Citrus Street and Garvey Boulevard, in the City of Nest Covina, heretofore approved by the City Planning Commi- ssion, be and the same is hereby approved, under and pursuant to the provisions of Ordinance-No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to the following conditions: (1) That the plan conform to proposed right-of-way of the Los Angeles County Flood Control District. (2) That the plan conform to the proposed right-of-way of the Division of Highways of the State of California. (3) That the right-of-way for widening of Citrus Street be deeded to the City of West Covina. (4) That all street improvements outlined in Section 49 of Ordinance No.2251 including utilities, that are not proposed for installation by the State Division of Highways, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks along Citrus Street and service road. -2- (5) That an adequate legal description be furnished. (6) That all buildings have a minimum 50 foot setback along Citrus Street..._ _ (7) That all buildings be limited to one-story and not over 25 feet in height. (8) That all advertising signs not to exceed the height of • buildings within the property. (9) That all advertising signs be set back at least 50 feet from Citrus Street and that all lighted signs face north or west. (10) That adequate water supply and fire protection be provided as required by ordinance No.237. (11) That'all bonds, fees and deposits for improvements be posted before building permits are issued. (12) That the trash areas shown on the plan be roofed over. (13) That the area be screen planted as indicated on the precise plan. (14) That the filling station site be limited to two 30 foot entrances to be removed at least 60 feet from the intersection of Citrus Street and frontage Road. • (15) That construction work on the buildings to be included in the development of this property be -commenced within two years of the effective date of this ordinance. That Section 8 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21,1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of 'Ifest Covina, the following: -3- The hereinafter described real property, to wit: Those portions of Lots 71 and 72 of Tract No.930 in the City.of West Covina as.per map recorded in Book 17 pa es 38 and 39 of Maps in the office of the ounty Recorder of the County of Los Angeles, State of California, lying between State. Highway and the proposed Flood Control Right.of Way be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said property and territory as a part of Zone C-1, under the provisions of said Ordinance No.147, subject, however, to all of the conditions hereinbef ore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the West Covina Tribune, a newspaper of general circulation published and circulated in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
