AN ORDINA,NCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CA,LIFORNIA, REGULATING .. THE HAINTENANCE OF SWI101ING POOLS .
THE CITY COUNCIL OF THE CITY OF WEST COVINA -DOES DETERMINE AND
ORDAIN.AS FOLLOWS:
SECTION 1. That the maintenance of private swimming pools
without adequate supervision or precautionary measures constitute
a severe hazard to the health and safety of the inhabitants of the
!City of 'West Covina, and particularly to small children in the City
of West Covina. That numerous small children have been drowned
by falling into private swimming pools in the County of Los Angeles;
that many of said deaths could have.been prevented if adequate
preventive measures had been required and installed. That there
are a substantial number of privately owned swimming pools within
the City of West Covina and more..such pools are currently under
construction. That it is desirable and necessary in the interests
of the public health, welfare and safety that suitable precautions
be imposed upon the construction and maintenance,of private swimming
pools in the City of West Covina whether such pools be in existence
or are to be constructed in the.future.
SECTION 2. Every person in possession of land within the
• City of West Covina, either as owner, purchaser under contract,
.lessee, tenant or licensee, upon which is situated a swimming pool,
shall at all times maintain on the lot or premises upon which such
pool is located and completely -surrounding such pool, lot or premises,
a fence or other solid structure not less than four (4) feet in
height with no opening therein (other than doors or gates) larger
than six (6) inches square. All gates or doors opening through such
enclosure shall be equipped with a self closing and self latching

device designed to keep and capable of keeping such door or gate
securely closed at all times when not in actual use; provided,
however, that the door of any dwelling occupied by human being and
forming any part of the enclosure hereinabove required need not
be so equipped.
SECTION 3. All plans hereafter submitted to the City of
iWest Covina for swimming pools to be constructed shall show com-
pliance with the requirements of the preceding section, and final
inspection and approval of all poolshereafter constructed shall
be withheld until all requirements of the preceding section shall
have been complied with.
SECTION 4. The provisions of Section 2 shall not apply
to public swimming pools for which a charge or admission price is
required to be paid for such use thereof, nor to swimming pools
which are a part of and located upon the same premises as a hotel
or motel, during the time that the owner, operator or adult employee
of such owner or operator i.s present at and in active charge of the
premises upon whichsuch pool is located.
SECTION 5. If any section,.subsection, sentence, clause,
• phrase or portion of this Ordinance is for any reason held to be
invalid or unconstitutional by,the.decision of any court of compet-
ent jurisdiction, such decision shall not affect the validity of
the remaining portions of this Ordinance. The City Council hereby
declares that it would have adopted this Ordinance, and each section,
sentence, clause, phrase, or portion thereof, irrespective of the
fact that any one or more sections, subsections, clauses, phrases
or portions be declared invalid or unconstitutional.

SECTION 6. Any person violating or permitting or respon-
sible for the violating of any of the provisions of this Ordinance
shall be guilty of a misdemeanor, and upon conviction thereof shall
be punished by a fine of not more than Five Hundred Dollars ($500.00)
or by imprisonment in the County Jail of the County of Los Angeles,
California, as the committing magistrate may direct, for a period of
note more than six (6) months, or by both such fine and imprisonment.
Every such person continuing, committing or permitting the violation
of any of the provisions of this Ordinance shall be deemed guilty
of a separate offense for each and every day or portion of any day
during which any violation of any provision of this Ordinance is
committed or permitted.
SECTION 7. The City Clerk shall certify to the adoption of
this Ordinance, and prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be posted with the
names of the members voting for and against the same in three places
within the City, in the manner required by the laws and ordinances
in the City of West Covina, and thirty (30) days after the final
passage thereof said Ordinance shall take effect and be in force.
