Ordinance - 349ORDINANCE NO.349 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A.PRECISE.PLAN FOR THE MVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT.TO.SECTION 14 OF ORDINANCE NO.147 OF.THE CITY. OF WEST COVINA, AND AMENDING SAID ORDINANCE NO.147 (Wong) THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. MEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain properties • described as the area located on the southeast side of Glendora Avenue between'Dalewood Street and Walnut Creek Parkway, as Zone R-A, with potential commercial classification as defined by the provisions of said Ordinance No.147, and particularly Section 149 paragraph 4, subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and "WHEREAS, the said Planning Commission did on September 7, 1954, conduct a duly advertised public hearing as prescribed by law and duly considered the application of Bing Tew Wong and Boy Jin Wong • for a variance in the zoning of said property under said precise plan; and -TqHEREAS, by'Resolution No.199 the said Planning Commission on September 7, 1954, approved said application and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on September 27, 1954, hold and conduct a duly advertised public -1- hearing as prescribed by law and considered said application for a variance in relation to the heretofore approved precise plan thereat and duly approved said variance, subject to the stipulations hereinafter enumerated: NOW,. THEREFORE, the City Council of the City of West Covina • does ordain as follows: That that certain variance hereinabove described for the development of the real property located on the southeast side of Glendora Avenue between Dalewood Street and Walnut Creek Parkway, in the City of West Covina, heretofore approved by the City Planning Commission, be and the same is hereby approved, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to the following conditions: (1) That all street improvements referred to in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks. (2) That the area necessary for the widening of Glendora • Avenue as shown on plan of streets and highways be deeded to the City of West Covina. (3) That adequate water supply and fire protection be provided as required by Ordinance No.237. (4) That the improvements on this property conform to the adopted Precise Plan for this area including the dedication of an alley at the rear of property, and a building setback of 60 feet. -2- (5) That all bonds, fees and deposits for improvements be posted before building permits are issued. That Section 8 of Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 19489 be and the same is hereby amended -by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: • The hereinafter described real property, to wit: The northwesterly 205 feet of the following described parcel of land: That portion of lot 170 in E.J.Baldwints Fifth Subdivision.of a portion of the Rancho.,La ]Vuente,. in the City of West Covina, as shown on map recorded in book 12, pages 134 et seq., of Maps, in the office of the County Recorder of said County,.described as follows: Beginning at a point in the northwesterly line of said lot 170, distant north 44040t east 553.21 feet from the most westerly corner of said`lot 170; thence continuing north 440 401 east 52.00 feet; thence south 450 20t east 576.80 feet to a line that is parallel with and distant 39.00 feet northerly measured at right angles from the southerly line of said lot 170; thence along last mentioned parallel line north 890 561 west 74.06 feet to a line that bears south 450 201 east from the point of beginning thence north 450 20, west..524.06 feet to the point of beginning. Excepting therefrom the precious metals and ores as excepted from the partition between John Rowland Sr. and William Workman, in the partition deed recorded in book 10 page 39 of 'Deeds be and the .same is hereby excepted from the particular zone in • which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said property and territory as a part of Zone C-1, under the provisions of said Ordinance No.147, subject, however, to all of the conditions hereinbef ore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days -3- • • from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the passage thereof said Ordinance shall take effect and be in force.
