Ordinance - 348r ORDINANCE N0.348 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, GRANTING VARIANCE TO PERMIT THE CONSTRUCTION.AND MAINTENANCE OF AN ELECTRICAL DISTRIBUTION.SUBSTATION.UPON PROPERTY LOCATED ON.MERCED AVENUE NEAR WILLOW AVENUE IN THE CITY OF WEST COVINA (Edison). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. -WHEREAS, there was filed the petition of Southern California Edison Company requesting a variance under the provisions of Ordinance No.147 of the City of West Covina to permit the expansion of an electrical distribution substation upon property owned by the applicant and located on Merced Avenue 227 feet north- west from Willow Avenue in said City; and WHEREAS, after due notice as required by the provisions of Ordinance No.147 of the City of West Covina, public hearings were duly held on such application by and before the City Planning Commission and the City Council and all interested parties were given a full opportunity to be heard; and WHEREAS, in the opinion of this Council the proposed variance to provide for the use as an expanded electrical distribution substation of the hereinafter described real property would not be detrimental to the public welfare nor injurious to surrounding property and would not adversely affect the comprehensive general plan of the City; • NOW, THEREFORE, BE IT ORDAINED that the aforesaid petition for a variance be approved and granted and that the hereinafter described real property be permitted to be used for an electrical distribution substation purpose, as provided in said Zoning Ordinance for the following reasons: 1. The variance requested by petitioner is not contrary to good planning practice, and if permitted as herein recommended and -I- subject to the conditions hereinafter enumerated, would have no harmful effect on the properties in the same general area. That the real property herein involved is located in the City of West Covina, County of Los Angeles, State of California, and is more particularly described as. - The northwesterly 87 feet of the southeasterly 314 feet of the northeasterly one-half of Lot 95 of E.J.Baldwints • 2nd Subdivision of a portion of the Rancho La 'Puente, as per map recorded in Book 71 Page 7 of Maps, records of said.county of Los Angeles, the southwesterly line thereof being parallel with the southwesterly line of said Lot 95 for the purpose of the expansion of an existing electrical distri- bution substation, subject, however, to the following conditions: (1) That all street improvements outlined in Section 49 of Ordinance No.2259 including utilities, be installed accordingly and meet the approval of the City Mngineer. (2) That the area required by the City for the widening of Merced Avenue as heretofore planned be deeded to the City of West Covina. (3) That suitable planting and landscaping be installed and maintained to adequately screen the structure, subject to the is approval of the City engineer. (4) That no signs other than notice of hazard or identifi- cation shall be placed on the premises. (5) That drainage from the premises be carried to Merced Avenue or applicant shall provide drainage letters from adjacent property owners. (6) That bonds, fees and deposits for street improvements be posted before building permits are issued. -2- SECTION 2. The City Clerk shall certify to the adoption of this Ordinance,and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same in three places within the City, in the manner required by the laws and ordinances in the City of • West Covina, ane thirty (30)-days from and after the final passage thereof said Ordinance shall take effect and be in f orce.
