AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, MAKING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS
OF ORDINANCE NO.147 OF SAID CITY, PURSUANT.TO SECTION 15 THEREOF
(Omaha Water Company Zone Variance Application No.114). .
THE CITY COUNCIL OF THE CITY OF NEST COVINA DOES ORDAIN AS FOLLOWS:
SECTION 1. The petition of Omaha Water Company having been
filed in the office of the City Planning Commission pursuant to
Section 15 of Ordinance No.147 of the City of West Covina establishing
• zones or districts and regulating therein the use of land, height of
buildings and yard spaces, adopted on the 21st day of January, 1948,
as amended, asking that a conditional variance be made affecting the
property described in said petition and setting forth the specific
reasons therefor and the circumstances in connection therewith, and,
recommendation having been made by the planning Commission to this
Council, and a full investigation and consideration of the facts
having been made by this Council pertinent to such petition; the
Council determines that there are exceptional or extraordinary cir-
cumstances or conditions applicable to.the property involved and to
the intended use thereof that do not generally apply to the property
or classes of uses in the same zone or district in which said property
is located, and will not be inconsistent with the general purposes
• of Ordinance No.147;
This Council, therefore, grants a conditional variance from
the provisions of said Ordinance No.147, but only so far as such
variance is necessary to permit the following described real property,
to Wit:
Lot No.4 Tract 14013, and commencing at the NW corner of
Lot 3 Tract 14013; thence 1004, west 40 feet with a
uniform depth of 50 feet north 880 56 t west part of Lot
2289 E.J.Baldwin's 5th Subdivision

and located on the north side of Herring Avenue 400 feet west
of Lark Ellen. Avenue, to be used for the purpose of erecting
and maintaining water -well installations on said property.
This conditional variance is granted upon the following
terms and conditions:
(1) That a five (5) foot solid fence or masonry wall be
constructed and maintained around the well site and suitable land-
scaping be installed and maintained to insure compatible relation-
ship between well site and adjoining residential areas.
(2) That existing building'on property herein described
be removed and replaced by one that conforms to surrounding neigh-
borhood; that the set -back line of fence or wall conform to set-
back of adjoining residences; that all unused poles be removed
from property.
(3) That all said requirements'be complied with and completed
within eighteen (18) months of the effective date of this ordinance.
(4) That any proposed change in the original pumping
installations, whether from irrigating to domestic uses, or to
increase the horse -power of motors in use, or otherwise, be first
. submitted for approval by the City Council. That there shall be
furnished to the City by petitioner forthwitha report in writing,
including decibel readings of the operations of existing motor or
motors, .to be placed on file with the Building Inspector.
SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance, and prior to the expiration of fifteen (15)
days from the passage thereof, shall cause the same to be posted
with the names of the members voting for and against the same, in
three places within the City, in the manner required by the laws

and ordinances of the City of West Covina, and thirty (30) days
from and after the final passage thereof said ordinance shall take
effect and be in force.

at a regular meeting of the City Council of the City of West Covina,
