Ordinance - 342ORDINANCE NO.342 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, MAKING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE N0.147 OF SAID CITY, PURSUANT.TO SECTION 15 THEREOF (Omaha Water Company Zone Variance Application No.113). . THE CITY COUNCIL OF THE CITY OF WEST COVINA-DOE'S ORDAIN AS FOLLOWS: SECTION 1. The petition of Omaha Water Company having been filed in the office of the City Planning Commission pursuant to Section lb of Ordinance No.147 of the City of West Covina • establishing zones or districts and regulating therein the use of land, height of buildings and yard spaces, adopted on the 21st day of January, 1948, as amended, asking that a conditional variance be made affecting the property described in said petition and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consider- ation of the facts having been made by this Council pertinent to such petition; the Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended use thereof that do not generally apply to the property or classes of uses in the same zone or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No.147; This Council, therefore, grants a conditional variance from the provisions of said Ordinance No.147, but .only so far as such variance is necessary to permit the following described real property, to wit: West 38 feet of Lot 196 of -E. J.Baldwin ' s Fifth Subdivision -1- and located on the north side of Service Avenue 200 feet west of Pima Avenue, to be used for the purpose of erecting and main- taining water -well installations on said property. This conditional variance is granted upon the following terms and conditions: (1) That a five (5) foot solid fence or masonry wall be constructed and maintained around the well site and suitable land- scaping be installed and maintained to insure compatible relationship between well site and adjoining residential areas. (2) That existing building on property herein described be removed and replaced by one that conforms to surrounding neigh- borhood; that the set -back line of -fence or wall conform to set -back of adjoining residences; that all unused poles be removed from property. (3) That all said requirements be complied with and completed within eighteen (18) months of the effective date of this ordinance. (4) That a deposit in an amount established by the City Engineer for street improvements, curbs, gutters and pavement be posted and deposited with the City of West Covina and that an inspection • fee be provided by petitioner for the installation of said improvements. (5) That any proposed change in the original pumping in- stallations, whether from irrigating to domestic uses, or to increase the horse -power of motors in use, or otherwise, be first submitted for approval by the City Council. That there shall be furnished to the City by petitioner forthwith a report in writing, including decibel readings of the operations of existing motor or motors, to be placed on file with the Building Inspector. -2- SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances of the City of West Covina, and thirty (30) days from • and after the final passage thereof said ordinance shall take effect and be in force. i ot" the Lity of Zest Covina ATTEST - City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the llth day of October, 1954, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMES W.
