Ordinance - 341ORDINANCE NO.341 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA., ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO. 147 OF.THE CITY OF WEST COVINA, AND A31ENDING SAID ORDINANCE N0.147 (Garrett W.Batelaan). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain properties described as the area located 600 feet south of Garvey • Boulevard and on the southeast side of Sunset Avenue, in the City of West Covina, County of Los Angeles, State of California, as Zone R-A, with potential commercial classifications as defined by the provisions of said Ordinance N0.147, and particularly Section 14, paragraph A, subparagraph (1), item (3) thereof; and ifflEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area tp encourage the proper utilization of such properties; and HEREA.S, the said Planning Commission did on June 21, 1954, and July 6, 1954, and also on August 30,1954, conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and WHEREAS, by Resolution No.188 the said Planning Commission on August 16,1954, approved said plan as revised and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on September 13, 1954, hold and conduct a duly advertised public hearing as prescribed by law and considered said preiise plan thereat and duly adopted said plan, subject to the stipulations hereinafter -1- enumerated; NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan for the development of the real property located as aforesaid and more par- ticularly described as: The Northeasterly 680.42 feet of Lot 143 of E.J.Baldwin's Fourth Subdivision of a portion of.Rancho La Puente. Except that portion lying south of the center line of Walnut Creek Channel, 75 feet wide as described in deed recorded in Book 7442, Page 165 Official Records as amended in accordance with the provisions of said Resolution No. 188 and conforming thereto, heretofore approved and adopted by the City Planning Commission and by the City Council, as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to the following conditions: (1) That the area for the widening of Sunset Avenue and area for other streets shown on the plan be deeded to the City of West Covina. (2) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and • meet the approval of the City Engineer. This to include street lights, sidewalks, and sanitary sewers. (3) That the plan conform with the proposed right-of-way of the State Division of Highways. (4) That the plan conform with the proposed right-of-way of the Los Angeles County Flood Control District. (5) That the street layout conform with adopted over-all Precise Plan for C-2 Central Business District and that street -2- • sections conform with those shown thereon. (6) That adequate water supply and fire protection be provided as required by Ordinance No.237. (7) That all bonds, fees and deposits be posted before building permits are issued. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the passage thereof said Ordinance shall take effect and be in force. 3fayor1 y of' West Cov ATTEST: City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the llth day of October, 1954, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen JAMES W.
