Ordinance - 339y ORDINANCE NO.339 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING.A.PRECISE.PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN.SAID CITY, PURSUANT TO.SECTION.14 OF ORDINANCE NO. 147 OF THE CITY OF WEST COVINA, ADN AMENDING SAID_ORDINANCE NO.147 (E.L.Wood). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance N0.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain properties described as the area located at the southwest corner of Garvey Boulevard and California Avenue, as Zone R-A,-with potential commer- cial classification as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 49 subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on May 3, 1954, May 17, 1954, June 7, 1954, and August 2, 1954, conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and • WHEREAS, by Resolution No.184 the said Planning Commission on August 2, 1954, approved said plan and recommended to the City Council the adoption„thereof, subject to the conditions hereinafter enumerated; and 'WHEREAS, the City Council of the City of West Covina did on August 23, 1954, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter -1- enumerated: NOW,THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan No.27 for the development of the real property located at the southwest corner of Garvey Boulevard and California Avenue, in -the City of 'West Covina, heretofore approved and adopted by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas herein- after specifically described, subject to the following conditions: (1) That the area required for street widening according to said Precise Plan be deeded to the City of West Covina; (2) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers; (3) That the precise plan adopted for the C-2 central business area be revised to accomodate Precise Plan No.27; (4) That adequate water supply and fire protection be • provided as required by Ordinance No.237; (5) That adequate facilities for the removal of storm water be provided to meet the approval of the City Engineer; (6) That all bonds, fees, and deposits be posted before building permits are issued; (7) That the subject area conform to the proposed right- of-way of the Division of Highways and the revised Precise Plan No.27 (July 1954) adopted for this area; -2- (8) That development of this property be commenced within two years from the date of adoption of this Ordinance; (9) That an additional 30 foot entrance from service road near the northeast corner of the building be provided, and (10) That a 5 foot sidewalk along service road and California Avenue be included and shown on said plan. That Section 3 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Asap of the City of West Covina, the following: The hereinafter described real property, to wit.. Lot 156 of E.J.Baldwints Fourth Subdivision of a part of the Rancho La.Puente, in the City of West Covina, as per map -recorded in Book 8 Page 186 of Naps, in the office of the County Recorder of said County. , EXCEPTING that portion thereof lying west of a line drawn from a point in the southerly line of said Lot 156, distant 518.86 feet.easterly from the southwesterly corner thereof, to a point in the northerly line of said Lot 156, distant 685.68 feet easterly,:from the northwesterly corner thereof. ALSO EXCEPTING therefrom that portion conveyed to the State of California.by deed recorded in Book 19360 Page 49 Official Records of said County, described as follows: Commencing at the most easterly corner of said Lot 156, thence north 89*19, 40" West along the north line of said Lot 156, to a point which bears south 890 191 40" east 685.68 feet from the north- westerly corner of said Lot 156; thence southwesterly along the northwesterly line of the portion of Lot 156 conveyed to Harry S.Goode et ux, by deed recorded in Book 11074 Page 267, Official Records, to its intersection with a line which is parallel with and distant 20.00 feet southerly, at right angles, from the said north line of Lot 156; thence south 890 19, 401, east along said parallel line to a point distant North 890 19, 40" west thereon 189.35 feet from the southeasterly line of said Lot 156; thence south 00 401 20" west 4.00 feet; thence south 800 431 031t east 107.92 feet; -thence south 270 44, 35" east 22.47 feet to a point in the westerly line of Vincent Avenue, 66�feet wide, as described in the deed to the City of West Covina, recorded in Book 122272, Page 263, Official Records, distant thereon South 40 241 5011 west 40.00 feet from said parallel line distant southerly.20 feet at right angles -3- 0 • from the north line of said Lot 156; thence along said westerly line south 40 24, 50" west 47.09 feet to its intersection with the southeasterly line of said Lot 156; thence along said southeasterly line north 41' 281 50" east to the point of beginning. ALSO EXCEPTING the southwesterly 6 acres of above described portion of Lot.15.69 be and the same -is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of.this section, and all such real property and territory is hereby granted a variance so as to establish said property and territory as a part of Zone C-1, under the provisions of said Ordinance No.147, subject, however, to all of the conditions hereinbefore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the passage thereof said Ordinance shall take effect and be in f Yr r-c - May o e City W s ovina ATTES . /:�) City Clerk I HEREBY CERTIFY THAT the foregoing Ordinance.was adopted at a regular meeting of the City Council of the City of West Covina, held on the 27th day of September, 1954, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen DAMES W.
