Ordinance - 321ORDINANCE NO.321 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN.SAID CITY, PURSUANT TO SECTION.14 OF ORDINANCE NO.147 OF THE.CITY OF WEST COVINA,AND AMENDING SAID ORDINANCE NO.147 (Sylvan Shulman). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain prop- erties described as the area located south of Garvey Boulevard and west of California Avenue, in the City of West Covina, as Zone R-A, with potential commercial classifications as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph A, subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on April 19,1954, and on May 3, 1954, conduct duly advertised public hearings as pres- cribed by law and duly considered said precise plan; and WHEREAS, by Resolution No.165 the said Planning Commission son May 3, 1954, approved said, plan and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on May 24, 1954, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: -1- NOW,THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan for the development of the real property located south of Garvey Boulevard and west of California Avenue, in the City of West Covina, as amended in.accordance with the provisions of said Resolution No.165 and conforming thereto but excluding the masonry wall therein required, heretofore approved and adopted by the City Planning Commission and by the -City Council, as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of -Ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to the following conditions: (1) That area for future streets and widening be deeded to the City of West Covina. (2) That all street improvements outlined in Section 49 of Ordinance No.225 including utilities be installed accordingly and meet approval of City -Engineer. This to include streets lights, sidewalks and sanitary sewers. (3) That the Precise Plan adopted for the C-2 Central SBusiness Area be revised to accomodate the revised Precise Plan No.26. (4) That street widths surrounding the subject area con- form with the adopted precise plan for C-2 Central Business Area. (5) That adequate water supply and fire protection be provided as required by Ordinance No.237. (6) That the subject area conform with proposed right-of- way of the State Division of Highways. (7) That all bonds,fees and deposits for improvements be posted before building permits are issued. -2- That Section 3 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 2191948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: PARCEL 1: That portion of Lot 144 of E.J.Baldwin's Fourth • Subdivision.of part of the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as per map recorded in Book 81 Page 186 of Naps, in the office of the County Recorder of said County, bounded as follows: Beginning at the most Easterly corner of said Lot 144; thence Southwesterly along the Southeasterly line of said Lot 1293.92 feet; thence Northwesterly parallel with the Southwesterly line of said Lot 386.5 feet; thence North- easterly parallel with said Southwesterly line 958.25 feet, more or less, to the Northerly line of said Lot; thence Easterly along said Northerly line to the point of beginning. PARCEL 2: That portion of Lot 156 of E.J.Baldwin's Fourth Subdivision.of part of the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as per map recorded in Book 81 Page 186 of Maps, in the office of the County Recorder of said County lying west of a line drawn from a point in the Southerly line of said Lot, distant 518.86 feet easterly from the Southwest corner thereof to a point in the Northerly line of said Lot, distant 685.68 feet, -Easterly from the Northwest corner thereof. -Except .082 ac. to State. PARCEL 3: The Northerly 227.5 feet of Lot 155 of E.J.Baldwin's Fourth Subdivision of part of the Rancho La Puente, in the City of West Covina; County of Los Angeles, State of California, as per map recorded in Book 89 Page 186 of Maps, in the office of the County Recorder of said County described as follows: Beginning at the most Northerly corner of said Lot 1559 thence Southeasterly along the Northeasterly line of said Lot 927.36 feet to the most Easterly corner thereof; thence Southwesterly along the Southeasterly line of said Lot 227.5feet• th@ ce Northwesterly parallel with the Northeasterly linesaind Lot 927.36 feet to the Northwesterly line thereof; thence Northeasterly along said Northwesterly line 227.7 feet to the place of beginning. PARCEL 4: The Southwest 6 Acres of that portion of Lot 156 of E.J.Baldwinls Fourth Subdivision of part of the Rancho La Puente, City of West Covina, as per map recorded in Book 81 Page 186 of Haps,i.n .the office of the County Recorder of said County,described in Deed reeprded December 911943 in Book 20495, Page 186 of Official Records. -3- be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said real property and territory as a part of Zone C-2 under the provisions of said Ordinance No.147, subject, however, to the conditions hereinabove en- umerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City.in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the passage thereof said Ordinance shall take effect and be in force. e Uity of West Covina ATTEST• ^ City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted • at a regular meeting of the City Council of the City of West Covina, held on the 28th day of June,1954, by the affirmative vote of at least three Councilmen, to wit: 11 AYES: Councilmen JAMES W.
