Ordinance - 317ORDINANCE NO.317 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A.PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN.SAID CITY, PURSUANT TO_SECTION.14 OF ORDINANCE NO.147.OF THE CITY OF.WEST COVINA,.AND AMENDING SAID ORDINANCE NO.147 (King). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, classifies certain •properties described as the area located on the west side of Irwindale Avenue at Puente Avenue, as Zone R-A, with potential commercial classification as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph 41 subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared.a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on April 5, 1954 and April 19, 19549 conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and WHEREAS, by Resolution No.156 the said Planning Commission on April 19, 1954, approved said plan and recommended to the City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on May 10, 1954, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations hereinafter enumerated: 1541 • NOW,'THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan No. 18 for the development of the real property located on the west side of Irwindale Avenue at Puente Avenue, in the City of West Covina, heretofore approved and adopted by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to the following conditions: (1) That the area for Yaleton and Puente, and the widening of Irwindale, including returns, be deeded to the City of West Covina. (2) That -all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City "Engineer. This to include sidewalks and street lights. (3) That the Block Study P-46 be revised to accomodate Precise Plan No.18. (4) That a 6 foot masonry wall be constructed along the southern boundary of the property and around the northerly and westerly lines of the northerly service station site. Said wall to be constructed when the adjacent area is developed to residential uses. (5) That adequate water supply and fire protection be provided as required by Ordinance No.237. (6) That all bonds, fees and deposits for improvements be posted before building permits are issued. -2- (7) That the 5 foot drainage easement along the south property line be improved to adequately remove the surface drainage on the subject area. That Section 3 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21,1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: That portion of La Puente Rancho, known as John Reed Tract 13.68 acres on West line of Irwindale Avenue, com.N. 14.73 chs. from S. line of Covina School District; Thence No. on SD West line.,16.04 chs.; thence N.870 W. 569.94_feet; thence S. 16.11 chains; thence S.880 301 E. 55.66 feet to beginning, be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said property and territory as a part of Zone C-1, under.the provisions of said Ordinance No.147, subject, however, to all of the.conditions hereinbef ore enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from ; and after the passage thereof said Ordinance shall take effect and be in force. est uovina -3-
