Ordinance - 313ORDINANCE NO. 313 AN ORDI'INANCE OF THE CITY COUNCIL OF TFM CITY OF WEST COVINA, CALIFORNIA, N.AKING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO.147 OF SAID CITY, PURSUANT TO SECTION 15 THEREOF, (Covina School District). THE CITY COUNCIL OF TI-M CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. The petition of the Covina,.School District having been filed in the office of the City Planning Commission ,. pursuant to Section 15 of Ordinance No.147 of the , C4i.ty of West Covina establishing zones or districts and regulating therein the use of land, height of buildings and yard spaces, adopted on the 21st day of January, 1948, asking that a conditional variance be made affecting the property described in said petition and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to.this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to such petition; the Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the -intended use thereof that do not generally apply to the property or classes of uses in the.same zone • or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No.147; This Council, therefore, grants a conditional variance from the provisions of said Ordinance No..147, but only so far as such variance is necessary to permit the following described real property, to wit-. -1- The Southerly 322 feet of Lot 3,B1ock 16 of the Phillips Tract in the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as recorded in Miscellaneous Records No.9.9 Pages 3 and 4 in said County. to be used for the purpose of increasing the existing Junior High School facilities located east of Phillips Avenue and south of Puente.Avenue, in the City of West Covina, and uses incident thereto. This conditional variance is granted upon the following terms and conditions; (1) That the area for future streets be deeded to the City of West Covina. (2) That all street improvements outlined in Section 49 of Ordinance No.2.25, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include -street lights and widewalks. (3) That a one foot lot at the easterly end of Eckerman Avenue be deeded to the City of West Covina in fee simple. (4) That a building permit from the City of West Covina is be secured. (5) That all bonds, fees and deposits be posted before building permits are issued. (6) That a future half street be provided on the easterly property line in addition to those shown for Phillips Avenue and Eckerman Avenue. (7) That the extension of Danes Drive be deleted through the school property. -2- SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances of the City of West Covina, and thirty (30) days from and after the passage thereof said Ordinance shall take effect and 0 be in force. School District)", in three public places in said City, to wit: One at the Police Office, 1444 West Garvey Boulevard, one in front of the West Covina School House, and one at the northwest corner of Puente Street and Lark E1 Boulevard.
