Ordinance - 289ORDINANCE NO.289 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, )L4KIl+G A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO.147 OF SAID CITY, PURSUANT TO SECTION.15 THEI;EOF. THE CITY COUNCIL OF THE CITY OF TITEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. The petition of the Covina School District having been filed in the office of the CityPIanning Commission pursuant to Section 15 of Ordinance No.147 of the City of West 0 Covina establishing zones or districts and regulating therein the use of land, height of buildings and yard spaces, adopted on the 21st day of January, 1948, asking that a conditional variance be made affecting the property described in said petition and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to such petition; the Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended use thereof that do not generally apply to the property or classes of uses in the same zone or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No.147; This Council, therefore, grants a conditional variance frogi the provisions of said Ordinance No.147, but only so far as such variance is necessary to permit the following described real property, to wit; -1- All that portion of Trots 43, 44 and 45, Tract No.930, Map Book 17 pages 38 and 39, Records of Los ..Angeles County, described as follows: Beginning at the southwest corner of said Lot 45;thence north 00 24' 15" east 192 ft. along the west line of said lot to the..true point of beginning; thence North 00 24' 15" east along the west line of lots 43, 44 and 45, 673.69 feet; thence south 89' 351 45" east 220 feet; thence south 00 24' 15" west 29.78 f eet;..thence easterly along the arc of a.curve concave to the north having a • radial bearing at its point of beginning north 20 45116" west, the radius of said curve being 2032.50 feet and said arc length being 374.57 feet; thence south 0024115" west 890.94 feet parallel with the said west lines of Lots 43, 44 and 45 to a point in the south line of said lot 45; thence north 890 35' 0011 west 372 feet along said south line; thence north 00 2.4' 15" east 192 feet; thence north 89° 35' 00" west 218 feet to the true point of beginning, containing 10.695 acres, more or less, except streets to be used f or the purpose of establishing, maintaining and con- ducting an elementary public school and uses incident thereto. This conditional variance is granted upon the following terms and conditions: (1) That the necessary widening of Hollenbeck Street be deeded to the City of West Covina. (2) That the area for a 60' street (proposed Rio Verde Drive) be deeded to the City of West Covina. (3) That prior to the issuance of a permit for the building of said public school all street improvements outlined in Section 49 of Ordinance No.22,51 including utilities and sidewalks, shall be installed accordingly to meet the approval of the City Engineer; this to include street improvements along Cortez Street to the intersection of Hollenbeck Street, the improvements along Rio Verde Drive to be installed when the remaining property is developed. In lieu of the actual installation of said improvements petitioner may -2- furnish to the City a surety bond guaranteeing such installation, the amount of such bond to be determined by the City Engineer. (4) That vehicular access rights along Hollenbeck Street be deeded to the City of Nest Covina and that access to the parking lot be confined to Rio Verde Drive. • (5) That a 50 foot building set -back be provided on 0 Hollenbeck Street, and Street. (6) That adequate screen planting be provided along Cortez SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances of the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
