Ordinance - 281ORDINANCE N0.281 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IV -EST COVINA, CALIFORNIA, MCING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE N0.147 OF SAID CITY, PURSUANT TO SECTION 15 THEREOF. THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. The petition of the Covina School District having been filed in the office of the City Planning Commission pursuant to Section 15 of Ordinance No.147 of the City of West Covina establishing zones or districts and regulating therein the use of land, height of buildings and yard spaces, adopted on the 21st day of January, 1948, asking that a conditional variance be made affecting the property described in said petition and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to such petition; the Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended use thereof that do not generally apply to the property or classes of uses in the • same zone or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No.147; This Council,'therefore, grants a conditional variance from the provisions of said Ordinance No.147, but only so far as such variance,is necessary to permit the following described real property, to wit: -1- Lot 8 in Block 18 of the Phillips Tract, in the City of West Covina and portion of Lot 7 in Block 18 of the Phillips 'Tract, in the City of West Covina being 1.53 acres commencing at the Northeast corner of Lot 7, Block 18; thence West 1.77 chains; thence South 40471 West 48.68 feet; thence East 16.4 feet; thence South to the North line of Rowland Avenue; thence East thereon to the East line of said Lot produced South; thence North to beginning, part of vacated • street adjoining on the South; and located on the northwest corner of Rowland and Lark Ellen Avenues to be used for the purpose of establishing, maintaining and conducting an elementary public school and uses incident thereto. This conditional variance is granted upon the following terms and conditions: (1) That the necessary widening of Lark Ellen Avenue be deeded to the City of West Covina; (2) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This. to include sidewalks; (3) That an eight foot easement be provided along the • westerly edge of the property; (4) That vehicular access to the school site be confined to Rowland Avenue and that the access rights along Lark Ellen Avenue be deeded to the City of West Covina; (5) That in accordance with the policy of the City Council along Lark Ellen Avenue regarding palm trees, a $50.00 per tree deposit with the City for future maintenance or removal of trees -2- be required. (6) .That a plot plan of the building site and proposed streets be furnished the Building Department; and (7) That the plot plan conform to the block study adopted for this area. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances of the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. 1 Mayor : the `CZ y of we Covina ATTEST: �rrc 1 C 1 e rk l�r o y • I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the 26th day of October, 1953, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen FRANK DELAYBETT C.
