Ordinance - 278ORDINANCE NO.278 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFO�'.NIA, AMENDING ORDINANCE NO.147 OF SAID CITY, KNOWN AS THE ZONING ORDINANCE, AND CIUNGING TIC,' ZONING MAP ATTACHED THERETO AND 1++MADE A PART THEREOF (Frank H. Bandy) . THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 3 of Ordinance No.147 of the City of West Covina, entitled "AN ORDINANCE ESTABLISHING ZONES IN THE CITY OF WEST COVINA, AND THERREIN REGULATING THE USE OF LAND, HEIGHT OF BUILDINGS AND YARD SPACES;'ADOPTING A MAP SHOWING THE BOUNDARIES OF SAID ZONES; DEFINING THE TERMS USED IN THIS ORDINANCE; PROVIDING FOR ITS ADJUSTMENT, AMENDMENT AN!) ENFORCE11ENT; PRESCRIBING PENALTIES FOR VIOLATIONS .AND REPEALING ORDINANCES OR PORTIONS OF ORDINANCES IN CONFLICT THEREWITH", adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property located on the southeast corner of Garvey Boulevard and Glendora Avenue, in the City of West Covina, and more particularly described as follows, to wit: A portion of Lot 171 of E.J.Baldwin's Fifth Subdivision of a portion of Rancho La Puente as recorded in Book 12, pages 134 and 135 of Maps, records of said County, all described as follows: Beginning at the intersection of the easterly line of said Lot 171 with the southerly line of Garvey Avenue 157 feet wide as shown on map of Tract 17325 as recorded in Book 430 pages 10 and"ll of Maps, records of Los Angeles County, California; thence, along said southerly line, North 89° 19' 40" West 15.30 feet to the southeasterly line of Glendora Avenue, 60 feet wide, as shown on map of said Tract No.17325; thence, along said southeasterly line South 44' 17' 20" West 254.87 feet to the most northerly corner of said Tract No.17325; thence along the northeasterly line of said Tract No. 17325, South 450 42' 40" East 135.00 feet to the -1- 0 southeasterly line of Tract 17325; thence, along said southeasterly line, South 44° 17' 20" West 125.00 feet to a line that is parallel with the center line of the "Future Street" 52 feet wide, shown on map of said Tract No.17325 distant there- from 34.00 feet measured northeasterly at right angles; thence, along said parallel line and said line produced, South 45° 42' 40" East 199.70 feet to the beginning of a tangent curve, concave northeasterly and having a radius of 50.89 feet; thence southeasterly, along said curve through a central angle of 43 36' 5411, a distance of 38.74 feet to the easterly line of said Lot 171 of E.J. Baldwin's Fifth Subdivision; thence along said easterly line, North 00 39' 50" East 519.95 feet, more or less, to the point of beginning. INCEPTING that portion of above described as follows: A portion of Lot 171 of E.J.Baldwin's Fifth Subdi- vision of a portion of Rancho La Puente as recorded in Book 12, pages 134 and 135 of Maps, records of Los Angeles County, California, described as follows: Beginning at the most northerly corner of Tract No. 17325 as recorded in Book 430, pages 10 and 11 of Maps, records of said County; thence, along the northeasterly line of said Tract No.17325 and said line produced, South 45° 42' 40" East 264.05 feet to the easterly line of said Lot 171 of E.J.Baldwin's Fifth Subdivision; thence, along said easterly line North 0° 39' 50" East 186.50 feet to a line that is parallel with said northeasterly line of Tract No.17325, distant therefrom 135.00 feet, measured at right angles; thence, along said parallel line, North 45° 42' 40" West 135.38 feet to the southeasterly line of Glendora Avenue, 60 feet wide, as shown on map of said Tract No.17325; thence, along said southeasterly line, South 440 17' 20" West 135.00 feet to the point of beginning, City of West Covina, County of Los Angeles, State of California, located at the southeast corner of Garvey Boulevard and Glendora Avenue be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said property and territory as a part of Zone C-1 under the provisions -2- of said Ordinance No.147 subject to the following conditions; (1) That the widening of Glendora Avenue and the area for future streets be deeded to the City of West Covina; (2) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed 0 accordingly and meet the approval of the City Engineer; this to include street lights and sidewalks; (3) That all improvements conform to Precise Plan No.10 adopted for this area; (4) That a legal description be furnished for the two parcels; (5) That adequate water supply and fire protection, required in Ordinance No.237, be provided; (6) That the area conform to State Division of Highways' proposed right-of-way; and (7)„!'hat all bonds, fees and deposits be posted with the City of West Covina before building permits be issued. SECTION 2, The City Clerk shall certify to the adoption • of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance MIC C shall take effect and b ATTEST: City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Nest Covina, held on the day of October, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen FRANK DELAY BERTC. Bandy)", in three public places in said City, to wit: One at the Police Office, 1444 West Garvey Boulevard, one in front of the West Covina School house, and one at the no thwest corner of Puente Street and Lark Ellen Boulevard.
