Ordinance - 277ORDINANCE NO.277 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, GRANTING VARIANCE TO PEMMIT THE CONSTRUCTION AND MAINTENANCE OF A HOSPITAL AND MEDICAL CLINIC UPON PROPERTY LOCATED ON THE SOUTHWEST CORNER OF ORANGE AVENUE AND GARVEY BOULEVARD 9 IN THE CITY OF WEST COVINA (West Covina Medical Center). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS; SECTION 1. WHEREAS, there was filed the petition of the West Covina Medical Center requesting a variance under the pro- visions of Ordinance No.147 of the City of West Covina to permit the establishment of a hospital and medical clinic upon property owned by the applicant and located on the southwest corner of Orange .Avenue and Garvey Boulevard in said City; and WHEREAS, after due notice as required by the provisions of Ordinance No.147 of the City of West Covina, public hearings were duly held on such application by and before the City Planning Commission and the City Council and all interested parties were given a full opportunity to be heard; and WHEREAS, in the opinion of this Council the proposed variance to provide for the use as a hospital and medical clinic of the hereinafter described real property would not be detrimental to • the public welfare nor injurious to surrounding property and would not adversely affect the comprehensive general plan of the City; NOW, THEREFORE, BE IT ORDAINED that the aforesaid petition for a variance be approved and granted and that the hereinafter described real property be permitted to be used for a hospital and medical clinic, as provided in said Zoning Ordinance for the following reasons: 1. The variance requested by petitioner is not contrary to -1- good planning practice, and if permitted as herein recommended and subject to the conditions hereinafter enumerated, would have no harmful effect on the properties in the same general area. That the real property herein involved is located in the City of West Covina, County of Los Angeles, State of California, and is more particularly described as: Beinning at a point in the southeasterly line of -said Lot 113 distant thereon Borth 41" 241 58" East 151.61 feet from the most southerly corner of said lot; thence along said southeasterly line, South 410 241 5811 West 43.61 feet; thence along the northerly line of the land described'in Parcel 3 of Certificate No.W-211 on file in the office of the Registrar of Titles, South 86044/0711 West 28.13 feet to a point in the northeasterly line of the land described in Parcel 2 of said Certificate, being a curve concave Northeasterly having a radius of 900 feet, • radial line of said curve to said point bears South 42° 411 21t1 West; thence Northwesterly along said curve through a central angle of 12' 361 33", a distance of 198.06 feet to a point which bears South 67° 581 58" West 41.73 feet from a point that is distant North 480 351 0211 West 197.27 feet from the point of beginning; thence North 670 581 58t1 East 41.73 feet and South 480 351 0211 East 197.27 feet to the point of beginning. That portion of Lot 113 of E.J.Baldwin's Fourth Subdivision, in the City of Vest Covina, as per map recorded in Book 8 page 186 of Maps, in the office of the County Recorder of said County, described as follows: • Beginning at a point in the southeasterly line of said Lot 113, distant thereon North 41° 241 58t1"East 161.61 feet from the most southerly corner of said lot;: thence North 48° 351 0211 West 192.27 feet to the true point of beginning; thence North 670 581 5819 East 113.28 feet; thence South 48° 35' 02" East 141.61.feet to a point in the southeasterly line of said lot distant thereon North 410 241 58f0 East 262.93 feet from said most southerly corner of said lot; thence along said southeasterly line South 41° 241 5811 West 154.93 feet; thence along the northerly line of the land described in Parcel 3 of Certificate No.W-211 on file in the office of the Registrar of Titles, South 860 441 07" West 28.13 feet to a point in the northeasterly line of the land described in parcel 2 of said Certificate, being a curve concave Northeasterly having a radius of 900 feet, -2- a radial line of said curve to said point bears South 42° 41' 21" West; thence Northwesterly along said curve, through a central angle of 12° 36' 33" a distance of 198.06 feet to a point which bears South 67' 58' 58" West from the true point of beginning; thence North. 67* 58' 5811 East 52.91 feet to said true point of beginning. Said land is registered under the Land Title Law. That portion of Lot 113 of E.J.Baldwin's 4th Subdivision, • in the City of West Covina, County of Los Angeles, State of California, as shown on 11ap recorded in Book 8, Page 186; of Maps, in the office of the Recorder of said County, described as follows: Beginning at a point in the Southeasterly line of said Lot distant North 410 24' 58" East 262.93 feet from the most Southerly corner of said Lot; thence North 48*35102" West 141.61 feet; thence North 60 01' 18" East 140.07 feet to a point in the Southerly line of the land of the State of California described in Certificate of Title NO.HP-4750 on file in the office of" the Registrar of Titles of said County, said Southerly line being a curve concave Southerly and having a radius of 722.74 feet, a radial line at said point bears North 150 14' 38" East; thence Easterly along said Southerly line through a central angle of 40 08' 07" a distance of 52.16 feet to the beginning of a reverse . curve in said Southerly line, concave northerly and having a radius of 271 feet; thence Easterly along said curve through a central angle of 26° 34' 35" a distance of 125.70 feet; thence South 260 42' 22" East 79.03 feet to an angle point in the boundary line of said land on the said South- easterly line of Lot 113; thence South 410 24' 581 West 178.06 feet to the point of beginning. PARCEL 2: Beginning at a point on the Southeasterly line of said Lot 113, distant thereon North 410 15' 27" East 440.99 feet from the most Southerly corner of said Lot, said point being the most Southerly corner of said above described land acquired by the State of California; thence along the Southwesterly line of said land North 26® 51' 53" West 34.82 feet; thence from a tangent that bears South 2*02119" East, along a curve concave Westerly, having a radius of 93 feet, through an angle of 43° 17' 4611, a distance of 70.28 feet; thence South 489 44' 33" East, 7.00 feet to said Southeasterly line; thence along said Southeasterly line, North 410 15' 27" East, 50.80 feet to the point of beginning. That portion of Lot 113 of E.J.Baldwin's Fourth Subdivision, in the City of West Covina, as per map recorded in book 8 page 186 of Taps, in the office of the County Recorder of said County, described as follows. - Beginning at a point in the southeasterly line of said lot 113, distant North 410 24' 58" East 161.61 feet from the southerly corner of said lot; thence along said southeasterly line, North 410 24' 58" East 101.32 feet; thence North 480 35' 02" West 141.61 feet to the true point of beginning; thence south 67° 58' 58" West 113.28 feet to a point distant North 48° 35' 02" West 192.27 feet from the first point of beginning; thence North 6° O1' 18" East 202.50 feet to the southerly line of the land described in Certificate of Title YIP-4750 on file in the office of the Registrar of Titles of said County, said southerly line being a curve concave Southerly having a radius of 722.74 feet; thence Easterly thereon through a control angle of 7° 58' 00" a distance of 100.49 feet to a line which bears North 60 01' 18" East from a true point of beginning; thence South 6' O1' 18" West 140.07 feet to the true point of beginning. Said land is registered under the Land Title Law. and located on the southwest corner of Orange Avenue and Garvey Boulevard, for the purpose of erection of a hospital and medical clinic, subject, however, to the following conditions; • , • (1) That the use of the property conform with the proposed Division of Highways right-of-way. (2) That all street improvements outlined in Section 49 of Ordinance No.2259 including utilities that:are not proposed for installation by State Division of Highways, be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks. (3) That provisions for the parking of vehicles on the site for the clinic and hospital be in accordance with the provi- sions of Zoning Ordinance No.147, this to be in the ratio of one parking space per bed for the hospital. (4) That adequate water supply and fire protection as required by Ordinance No.237 be provided. (5) That the project be developed in accordance with the X plot plan submitted and made a part of the Zone Vairance Application No.75. (6) That all bonds, fees and deposits be posted with the City of West Covina before permits are issued. SECTION 2, The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same in three places within the City, -in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
