Ordinance - 276ORDINANCE NO.276 .AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF' ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND AMENDING SAID ORDINA.NCE NO.147 (Bowker and Broadwell). TAE CITY COUNCIL OF TIE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS; SECTION 1. WHEREAS, Ordinance No.147 of the City of West • Covina, known as the Zoning Ordinance, classifies certain properties described as the area located at or upon the west side of Glendora Avenue opposite Vine Avenue as Zone R-A, with potential commercial classifications as defined by the provisions of said Ordinance No.147, and particularly Section 14, paragraph A, subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on August 3,1953, conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and t WHEREAS, by Resolution No.118 the said Planning Commission on August 17,1953, approved said plan and recommended to the City Council the adoption thereof, subject to the condition hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on September 14,1953, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to the stipulations -1- C� 49 hereinafter enumerated; NOW,TIEi ORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan for the development of the real property located at or upon the west side of Glendora Avenue at Fine Avenue, in the City of West Covina, heretofore approved and adopted by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to the following condition: That the setback shown on the plan as fourteen feet be increased to fifteen feet. That Section 3 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by adding thereto, as a part of the Zoning Map of the City of West Covina, the following: The hereinafter described real property, to wit: PARCEL #1. That portion of Lots 162 and 163 of E.J. Baldwin's Fourth Subdivision as recorded in Book 8 page 186 of daps, records of Los Angeles County, California, described as follows: Beginning at the most northerly corner of said Lot 162; thence North- easterly along the Northwesterly line of said Lot 163, 107.97 feet; thence Southeasterly parallel with the Southwesterly line of said Lot 163, 1193.22 feet to the Southeasterly line thereof; thence Southwesterly along the Southeasterly line of said Lots 163 and 162, 313.07 feet; thence Northwesterly parallel with the Southwesterly line of said Lot 163, 1187 feet more or less to the Northwesterly line of said Lot 162, thence Northeasterly along the Northwesterly line of said Lot 162, 205 feet more or less to the point of beginning. Excepting therefrom the Northwesterly 618.00 feet thereof. -2- PARCEL #2. That portion of Lot 163 of the Fourth Subdivision (E.J.Baldwin's) described as follows: Commencing N 42° 56' 15" 107.99 feet from the most Southerly corner of Lot 163; thence North 480 07' West 575.22 feet; thence North 410 53' East 124.98 feet, thence South 480 07' East to the Southeasterly line of said lot, thence Southwesterly thereon 124.98 feet to the point of beginning. PARCEL #3. Lot 163 of E.J.Baldwin's Fourth Sub- division in the Rancho La Puente, in the City of West Covina, County of Los Angeles as per map recorded in Book 8 pages 186 and 187 of Pups, in the office of the County Recorder of said County. Excepting therefrom the Southwesterly 232.97 feet thereof and the Northeasterly 366.73 feet thereof. Also excepting therefrom the Northwesterly 618.00 feet thereof. be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said real property and territory as a part of Zones C-1_and R-3 under the provisions of said Ordinance No.147, subject, however, to the conditions hereinafter enumerated, to wit: (1) That the Applicant deed the necessary right-of-way for the widening of Glendora Avenue to the City of West Covina; • (2) That all street improvements outlined in Section 49 of Ordinance No.225 including utilities, be installed accordingly and meet with the approval of the City Engineer. This to include street lights and sidewalks. Improvements must be installed as the street frontages are developed; (3) That all buildings and improvements conform to the Precise Plan No..13 as adopted for this area; -3- (4) That satisfactory drainage letters or easements from adjoining -property owners be provided; (5) That the northwesterly one hundred fifty (150) feet and the northeasterly one hundred twenty-four (124) feet of Parcels #1 and #2 herein described and the northwesterly one hundred fifty (150) feet and the northeasterly one hundred fifty • (150) feet of Parcel #3 herein described be restricted to uses permitted only in the R-3 zone as indicated on the Precise Plan; (6) That adequate water supply and fire protection required by Ordinance No.237 be provided; and (7) That all fees and deposits as required by Ordinance No.225 and -Ordinance No.235 be posted before building permits are issued. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof,shall cause the same to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from • and after the passage thereof said Ordinance shall take effect and be in force.
