Ordinance - 2751 ORDINANCE NO.275 AN OP,DINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, GRANTING VARIANCE TO PE U IT THE CONSTRUCTION AND MAINTENANCE OF A CHURCH AND SCHOOL UPON PIZOPERTY LOCATED ON GLENDORA AVENUE SOUTH OF SERVICE AVENUE, IN THE CITY OF WEST COVINA (Roman Catholic Archbishop). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS:. SECTION 1., WHEREAS, there was filed the petition of the Roman Catholic Archbishop of Los Angeles, California, requesting a variance under the provisions of Ordinance No.147 of the City of West Covina to permit the establishment of a Church and School upon property owned by the applicant and located on Glendora Avenue south of Service Avenue in said City; and WHEREAS, after due notice as required by the provisions of Ordinance No.147 of the City of West Covina, public hearings were duly held on such application by and before the City Planning Commission and the City Council and all interested parties were given a full opportunity to be heard; and WHEREAS, in the opinion of this Council the proposed variance to provide for the use as a Church and School of the hereinafter described real property would not be detrimental to the public • welfare nor injurious to surrounding property and would not adversely affect the comprehensive general plan of the City; NOW, THEREFORE, BE IT ORDAINED that the aforesaid petition for a ,variance be approved and granted and that the hereinafter described real property be permitted to be used for a Church and School, as provided in said Zoning Ordinance for the following reasons; 1. The variance requested by petitioner is not contrary to good planning practice, and if permitted as herein recommended -1- and subject to the conditions hereinafter enumerated, would have no harmful effect on the properties in the same general area. That the real property herein involved is located in the City of West Covina, County of Los Angeles, State of California, and is more particularly described as: That portion of Lot 166 of E.J.Baldwin's Fourth • Subdivision of part of the Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as per map recorded in book 8, page 186 of maps, in the office of the County Recorder of said County, described as follows: Beginning at the most easterly.corner of said Lot 166; thence northwesterly along the northeasterly line of said Lot 166, to a point that is distant thereon 448.77 feet southeasterly from the most northerly corner of said lot; thence South 41° 53' West 450 feet; thence southeasterly parallel with said northeasterly line to a point in the southeasterly line of said Lot 166, that is distant thereon 450 feet southwesterly from said most easterly corner of Lot 166; thence northeasterly Along said southeasterly line, 450 feet to the point of beginning. EXCEPTING THEREFROM the southeasterly 220 feet of the northeasterly 120 feet thereof. ALSO EXCEPTING therefrom the "precious metals and ores thereof" as excepted from the..partition between John Rowland, Sr. and William Workman, in the partition deed recorded in book 10 page 39 of Deeds, • and located on Glendora Avenue south of Service Avenue, for the purpose of erection of a Church and School, subject, however, to the following conditions: (1) That the widening of Glendora Avenue and area for future streets be deeded to the City of West Covina. (2) That the applicant also dedicate the necessary right- . of -way for the widening of Glendora Avenue required from that parcel of land located in the northeasterly corner of the subject - 2 - ri property but not made a part of the proposed development, and which excluded parcel runs a distance of approximately one hundred and twenty feet along the frontage of Glendora Avenue. (3) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly • and meet the approval of the City Engineer. This to include street lights and street improvements on Glendora Avenue in front of the 120' x 220' parcel. Sidewalks to be required on Glendora .Avenue only. (4) That the block study adopted for this area be revised to conform with streets as indicated on plot plan for this variance. (5) That before development of the proposed project is begun, the applicant shall submit for approval of the Building Department a plot plan of the development indicating thereon the following: (a) Adequate playground area to serve the proposed school, based on the standard of one hundred square feet of playing area per pupil to be accomodated by the school; (b) The ultimate capacity of church and hall with adequate • provisions for parking facilities to accomodate the number of persons using the church and recreation hall; (c) That proposed screening to consist of planting strip and fence. (6) That all bonds, fees and deposits required for improve- ments be posted before building permits are issued. (7) That satisfactory drainage letters or easements from the adjoining property owners be provided the City. -3- (8) That all future streets indicated on the plan be at least sixty feet wide with the exception of the northwest indicated street leading to Tract No.19318. (9) That all driveways shown on the plot plan shall be not less than twenty feet wide. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) • days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
