Ordinance - 272ORDINANCE NO.272 AN ORDINANCE OF --THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION.14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND AMENDING SAID ORDINANCE NO.147 (Kagy and Manson). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. WHEREAS, Ordinance No.147 of the City of West • Covina, known as the Zoning Ordinance, classifies certain properties described as the area located at and upon the south side of Garvey Boulevard between California and Glendora Avenues as Zone R-A, with potential commercial classifications as defined by the provisions of said Ordinance No.1479 and particularly Section 149 paragraph A, subparagraph (1), item (3) thereof; and WHEREAS, the City Planning Commission of the City of West Covina has caused to be prepared a precise plan for the development of the above described area to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on August 3, 19539 conduct duly advertised public hearings as prescribed by law and duly considered said precise plan; and • WHEREAS,by Resolution No.114 the said Planning Commission on August 3, 1953, approved said plan and recommended to the,City Council the adoption thereof, subject to the conditions hereinafter enumerated; and WHEREAS, the City Council of the City of West Covina did on August 24, 1953, hold and conduct a duly advertised public hearing as prescribed by law and considered said precise plan thereat and duly adopted said plan, subject to theistipulations hereinafter enumerated; -1- S NOW,THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan for the development of the real property located at or upon the south side of Garvey Boulevard between California and Glendora Avenues in the City of West Covina, heretofore approved and adopted by the City Planning Commission and by the City Council as aforesaid, be and the same is hereby adopted as an Official Precise Plan, under and pursuant to the provisions of Ordinance No.147 of the City of West Covina, for the areas hereinafter specifically described, subject to.the following -conditions: (1)-That the area for streets..,.. be deeded to the city -of West Covina as required by Ordinance No.248; (2) That all street improvements outlined in Section 49 of Ordinance No.225 including utilities be installed accordingly and meet the approval of the City Engineer. This to include street lights and sidewalks; (3) That all improvements conform to precise plan adopted by Ordinance No.248; (4) That a legal description of the area to be rezoned and area to be deeded be furnished; (5) That adequate water supply and fire protection be provided as required by Ordinance No.237; (6) That all bonds, fees and deposits for improvements be posted • before building permits are issued;- (7) That the area conform to proposed State Division of Highways' right-of-way; and.(8) That a driveway twenty (20) feet wide be provided on either side of the building lot until permanent access is provided to the rear parking area. -2- That Section 3 of Ordinance No.147 of the City of West Covina, known as the Zoning Ordinance, adopted January 21, 1948, be and the same is hereby amended by -adding thereto, as a part of the Zoning Map of the City of West Covina, .the following: The hereinafter described real property, to wit: That por. of E.J.Baldwints Fourth Sub. of pt. of • the Rancho La Puente, in -the City -of West Covina, County of Los .Angeles,State -of California, as recorded -in Book 6, Page 186 of Maps, in the office of the County Recorder of said County and described as follows: Beg at a pt.in the SEly line of Lot 169 in the NWly line of Glendora Ave.,distant S,44° 40' 30" West 703.16 ft. from the.most Ely.corner of said Lot 169; th N440 40' 30" E along said'SEly line, 125.13 ft; th N 470 58' 30" W 360.02 ft; th N O1' 03' 30" E_. 182.66 ft. to a.pt. in the Nly line of Lt.169.distant S 88056' 20" E thereon 537,66 ft. from the inter- section of said N1y line with that certain course described as N 430 45' 30" E 10,43 ft. in deed to James W.Rasmussen and Mabel I.Rasmussen recorded in Bk.206241 Pg.37 O.R.of said County; th N 88° 56' 30" W along said N1y line 110 ft.; th S O10 03' 39" W .. 252.63 ft. more or less to a line which is par. with the hereinbefore described line having a bearing of N 470 53' 30" W and the NW1y prolongation thereof and which passes through the pt.of beg.; th S 47*58130" East 331,.38 ft. to the pt.of beginning, be and the same is hereby excepted from the particular zone in which such real property has otherwise been placed and designated by the provisions of this section, and all such real property and territory is hereby granted a variance so as to establish said real property and territory as a part of Zone C-3 under the provisions of said Ordinance No.147, subject, however, to the conditions hereinabove enumerated. CITY OF WEST COVINA_ ) ROBERT FLOTTEN, being by me first duly sworn, deposes and says: That he is the City Clerk of the City of West Covina, California; a citizen of the United States, and over the age of 21 years; that on the 3 Tipday of September, 1953, he posted three copies of Ordinance No.272 of the City of West Covina, entitled "AN ORDINANCE OF THE -4- CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPMENT OF CERTAIN PROPERTIES IN SAID CITY, PURSUANT TO SECTION 14 OF ORDINANCE NO.147 OF THE CITY OF WEST COVINA, AND AMENDING SAID ORDINANCE NO.147 (Kagy and Manson)," in three public places in said City, to wit: One at the Police • Office, 1444 West Garvey Boulevard, one in front of the West Covina School House, and one at the northwest corner of Puente Street and Lark Ellen Boulevard.
