Ordinance - 269r V ORDINANCE NO.269 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO.147 OF SAID -CITY, PURSUANT TO SECTION 1.5 THEREOF. THE CITY COUNCIL OF THE CITY -OF WEST COVINA DOES ORDAIN AS FOLLOWSs SECTION 1. A petition signed by Merced Avenue Church of Christ, having been filed in the office of the City Planning Commission pursuant to Section 15 of Ordinance No.147 of the City Council of the 10 City of West Covina establishing zones or districts and regulating therein the use of land, height of buildings and yard spaces, adopted on the 21st day of January, 1948, asking that a conditional variance be made affecting the property described in said petition and setting forth the specific.reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to such petition; the Council determines that there are exceptional -or --extra- ordinary circumstances or conditions applicable to the property involved and to the intended use thereof that do not generally apply to the property or classes of uses in the same zone or district in which said property is located, and will not be inconsistent with • the general purposes of Ordinance No.147; This Council, therefore, grants a conditional variance from the provisions of said Ordinance No.147, but only so far as such variance is necessary to permit the following described real property, to -wits A portion of Lot 5, Block 16, Phillips Tract, as per map recorded in Book 9, Pages 8 and 4 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, as more particularly described in the aforesaid petition, -1- to be used for the purpose of establishing, maintaining and conducting a church. This conditional variance is granted upon the following terms and conditions; (1) That the necessary widening of Merced Avenue be deeded to the City of West Covina; (2) That a one-half future street be provided along the northwesterly side of the property and improved at the time Merced Avenue is improved; (3) That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include improvements along Merced Avenue before any building permit is issued; (4) That a'suitable plot plan be provided to the Building Inspector showing parking ratio of one car for each five persons accomodated; (5) That said plot plan conform to the Los Angeles County Flood Control District proposed right-of-way; (6) That suitable landscaping be required to meet the approval of the City Engineer; and (7) That upon any violation of any of the provisions of this Ordinance, the uses herein permitted shall cease and terminate and the property • above described shall revert to and become a part of the zone in which the property is now situated. SECTION 2.
