Ordinance - 267ORDINANCE NO.267 AN ORDINANCE OF TIM CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, )LIMING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO.147 OF SAID CITY, PURSUANT TO SECTION 15 THEREEOF. THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. The petition of West Covina School District having been filed in the office of the City Planning Commission pursuant to Section 15 of Ordinance No.147 of the City of West Covina • establishing zones or districts and regulating therein the use of land, height of buildings and yard spaces, adopted on the 21st day of January, 1948, asking that a conditional variance be made affecting the property described in said petition and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to such petition; the Council determines that there are exceptional or extraordinary cir- cumstances or conditions applicable to the property involved and to the intended use thereof that do not generally,apply to the property or classes of uses in the same zone or district in which said property is located, and will not be inconsistent with the • general purposes of Ordinance No.147; This Council, therefore, grants a conditional variance from the provisions of said Ordinance No.147, but only so far as such variance is necessary to permit the following described real property, to wit: PARCEL 1. That portion of the Rancho La Puente, in the City of West Covina, county of Los Angeles, State of California, described as follows: -1- Commencing at a 2 inch iron pipe on the westerly line of Irwindale Avenue, 60 feet wide, as shown in County Surveyor's Field Book 364, Pages 146 and 147 in the office of the County Surveyor of said County, distant North 40 44' 57t1 East along said westerly line 496.57 feet from an angle point in said westerly line, said 2 inch iron pipe bearing North 88° 231 4811 West from a point in the westerly line of the parcel of land conveyed to D.C.Nensing by deed recorded in Book 36 Page 169 of Deeds, distant -southerly along said last mentioned westerly line, 940.083 feet from a stone monument marking the northwesterly corner of said par- cel of land conveyed to D.C. Lensing; thence North 88° 23' 4891 West 626.04 feet to a 2 inch iron pipe, marking the true point of beginning for this description; thence South 40 49' 1211 West 686.36 feet to a 2 inch iron pipe; thence North 88' 23' 4801 West 634.50 feet to the easterly line of the parcel of land marked i1John Lang" on a Licensed Surveyors heap filed in Book 31 Page 48 of Records of Surveys of said County; thence along said easterly line and its northerly prolongation North 3°57' 52t1 East 685.86 feet to 'a line which 'bears North 880 23' 4811 West from the true point of beginning; thence South 88.0 23' 48t1 East 644.76 feet to the true point of beginning. Said property is shown as Parcel B on map recorded December 12,1940, in Book 50 Page 38 on Record of Surveyors. ALSO an easement for road purposes over that portion of said Rancho La Puente included within a strip of land 12 feet in width extending from the Easterly line of the parcel of land first herein described, to the westerly line of Irwindale Avenue, as hereinbefore described, the southerly line of said 12 foot strip of land being the easterly prolongation of the southerly line of said parcel of land first herein described.. _ PARCEL 2. • That portion of the Rancho La Puente, in the City of West Covina,County of Los Angeles, State of California, described as follows: Commencing at a 2 inch iron pipe on the westerly line of Irwindale Avenue 60 feet wide, as shown on County Surveyor's Field Book 364 pages 146 and 147 in the office of the County Surveyor of said County, distant North 40 441 5711 East along said westerly line, 496.57 feet from an angle point in said westerly line, said 2 inch iron pipe bearing North 88' 23' 48f1 West from a point in the westerly line of the parcel of land conveyed to D.C.Hensing by deed recorded in book 36 page 169 of Deeds, distant southerly along said last mentioned Westerly line, 940.083 feet from -2- i .a stone monument marking the northwesterly corner of said parcel of land conveyed to D.C.Mensing; thence North 880 231 4811 West 626.04 feet to a 2 inch pipe, marking the northeasterly corner of the parcel of land first described in the deed to Henry Shinichi Oshiro recorded April 23, 1941, in Book 18336 page 324 of Official Records; thence along easterly line of the parcel of land described in said deed South 40 491 1211 West 686.36 feet to a 2 inch pipe; thence South 88' 231 4811 East 629.07 feet to said Westerly line of Irwindale Avenue; thence along said Westerly line, North 4° 051 52P1 East 189.57 feet to the hereinbefore mentioned angle point in said Westerly line�;'thence along said westerly line, North 40 441 5711 East 496.57 feet to the point of beginning. EXCEPT the northerly 263.09 feet thereof, measured at right angles to the northerly line of said land. ALSO EXCEPTING therefrom "the precious metals and ores thereof" as excepted from the partition deed between John Rowland Sr. and William Workman in the partition deed recorded in Book 10 Page 39 of deeds. and being located on the west side of Irwindale Avenue and north of Workman Avenue, to be used for the purpose of establishing, maintaining and conducting an elementary public school, and uses incident thereto. This conditional variance is ;ranted upon the following terms and conditions: 1. That the plot plan or layout conform to the block • study adopted for this area. 2. That Nora Avenue be connected to the street area shown on map, in front of the school, with a minimum 601 street. 3. That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City Engineer. 4. That areas for streets be deeded to the City of West Covina. MM 5. That the School District request the opening of 1' Lots No.101, 102, 103 and 104 in Tract No.12002 for street and highway purposes. 6. That a 1' lot at the north end of the extension of Nora Avenue be deeded to the City of West Covina in fee simple. SECTION 2, The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) ftdays from the passage thereof, shall cause the sane to be posted with the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances of the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. e -t;ity or, west uovina ATTEST: City Clerk I HEREBY CERTIFY that the foregoing Ordinance was adopted • at a regular meeting of the City Council of the City of West Covina, held on the 24th day of August, 1953, by the affirmative vote of at least three Councilmen, to wit: AYES,:' 'Councilmen IRANX DELAY C.
