Ordinance - 264ORDINANCE NO.264 � AN ORDINANCE OF TIC; CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A PRECISE PLAN FOR THE DEVELOPI:MM OF CERTAIN PROPERTIES IN SAID CITY AND AMENDING OIMINANCE NO.147 OF THE CITY OF WEST COVINA AND THE ZONING IiAP OF SAID CITY, PROVIDING FOR A VALIANCE FOR R-3 USES THEREIN (Alfred E.Strand). THE CITY COUNCIL OF THE CITY OF WEST COVINA DOE'S ORDAIN AS FOLLOWS. - SECTION 1. WHEREAS, the City Planning Commission has caused to be prepared a Precise Plan for the development of those certain • properties within the boundaries of the area in said City hereinafter described, to encourage the proper utilization of such properties; and WHEREAS, the said Planning Commission did on May 18,1953, and June 15,1953, conduct duly advertised public hearings, as pres- cribed by law, and duly considered said Precise Plan; and WHEREAS, by appropriate resolution, the said Planning Com- mission duly approved said plan and recommended to the City Council the adoption thereof and concurrently a variance under the provisions of Section 14 of Ordinance No.147 of said City for the use of said property for R-3 uses as shown on said plan; and WHEREAS, the City Council of the City of West Covina did on July 13,1953, hold and conduct a duly advertised public hearing, as • prescribed by law, and considered said Precise Plan and Variance thereat, and adopted and approved said plan and the variance afore- said, subject to the stipulations hereinafter set forth; NOW, THEREFORE, the City Council of the City of West Covina does ordain as follows: That that certain Precise Plan for the development of the area hereinafter described within said City and the variance for the use of said property for R-3 uses as in said plan indicated, heretofore approved and adopted by the City Planning Commission and by the City Council as aforesaid, be and the same -1- is hereby adopted as an Official Precise Plan for the development of the area hereinafter specifically described, in conformity with the variance herein concurrently approved and under and by virtue of the provisions of Ordinance No.127 of the City of West Covina, as amended, and of the applicable provisions of the Conservation and Planning Act of the State of California, subject, however, to (a) All street improvements as outlined in Section 49 of Ordinance • No.225 including utilities to be installed accordingly and meet with the approval of the City Engineer; that this requirement shall also include one-half of the alley along the subject property and all street requirements required on the plan that the California Division of Highways will not itself install; (b) That the plot plan or precise plan submitted herewith be made a part of this Variance; (c) That the proposed dwelling units to be put on the subject property shall conform to all the yard requirements of Ordinance No.147, and (d) That the applicants are to improve and grant to the City for sidewalk purposes a strip of land not less than five feet wide parallel to the east boundary of the property and extending southerly to the entrance designated as "paved area" on the plan® That the boundaries of the areas comprising said Precise Plan are • within the City of West Covina and are more particularly described as follows: Lot 66 of Tract No.11502 as recorded in Book 234, pages 37 and 38 of daps, and located at the southeast corner of Willow Avenue and the alley just south of Garvey Boulevard SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with -2- the names of the members voting for and against the same, in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the passage thereof said Ordinance shall take effect and be in force. e ui ATTEST. ^� � City Clerk est Covina I HEREBY CERTIFY -that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of West Covina, held on the loth day of August, 1953, by the affirmative vote of at least three Councilmen to wit: AYES: Councilmen FRANK DELAY C.
