Ordinance - 251ORDINANCE NO.251 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, .CALIFORNIA, REGULATING THE.DISTRIBUTION OF HANDBILLS WITHIN SAID CITY AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: SECTION 1. It shall be unlawful for any person, firm or corporation to distribute, throw or deliver, or cause to be distri- buted, thrown or delivered, any paper, advertisement, handbill, • circular,card, booklet,poster, dodger, advertising sample or waste paper upon any public street, alley, parkway,sidewalk or other public place in the City of West Covina, or upon or in any private premises, yard, residence or dwelling or upon any vacant property or premises or upon or in any automobile or other vehicle of another person, firm or corporation, or to or among pedestrians or persons in, along or upon any public street, alley, sidewalk or other public place within said City of West Covina; provided, however, that nothing in this section contained shall be so construed as to prohibit the placing or depositing of any such matter in a box or receptacle, other than a mail box, which is maintained upon private property or premises for the purpose of receiving such matter, when and if such box or receptacle has printed thereon the • word "advertising" in letters not less than one inch in height, or to prohibit the delivery or distribution of any complete news- paper or other printed matter which has been entered or is capable of being entered as second class matter., in the United States mails under the provisions of the United States Post Office regulations of March 3, 1879, as amended, and other applicable United States statutes or regulations. SECTION 2, It shall be unlawful for any person, firm. or corporation to paint, mark, paste, fasten, or in any other manner -1- affix to or cause to be painted, marked, pasted, fastened or in any other manner affixed to or on any curb, street, sidewalk, lamp post, street sign post, or any sign erected -for the purpose of - directing,or warning traffic or to or on any telephone, telegraph, or electric light pole, tree or shrub in any park, public street, alley, parkway or sidewalk, any sign, poster or advertisement of • any kind, or to erect or place or cause to be erected or placed any such sign, poster or advertisement upon any public street, alley, parkway or other public property, without first obtaining a written permit so to do from said. City Council, or to erect or _. place or cause to be erected or placed any such sign or advertise- ment upon any private premises or property without the written consent of the owner or occupant or person in charge thereof, provided that nothing in this Section contained shall be so con- strued as to prohibit the erection and maintenance of official warnings or direction signs by any department of the City of West Covina or to legal notices posted in the places and manner prescribed by law. Nothing in this Section contained shall be so construed as to apply to permanent signs painted on buildings or signs advertising the business painted on buildings or signs advertising the business conducted on the premises nor to prohibit or otherwise regulate the delivery of any matter hereinabove described by the United States Postal Service, SECTION 3. That any pers,pn, firm or corporation as principal, officer, agent, clerk or employee, whether acting for himself or itself or for another person, firm or corporation, violating any of the provisions of this Ordinance, shall be deemed guilty of a -2- misdemeanor, and upon conviction thereof shall be punishable by a.fine not exceeding $300.00 or by imprisonment in the County Jail of the County of Los Angeles, State of California, for a period not exceeding three months or by both such fine and imprisonment. SECTION 4. The City Clerk shall certify to the adoption • of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be posted with the names of the members voting for and against the same in three places within the City, in the manner required by the laws and ordinances in the City of West Covina, and thirty (30) days from and after the final passage thereof said Ordinance shall talra pffAnt and hp in f nrnp _ I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of tfine City Council of the City of West Covina, on the 25th day of May,1953, by the affirmative vote of • at least three Councilmen, to wit: AYES; Councilmen BERT C.
