AN ORDINANCE PROVIDING FOR THE LEASING
OF CITY SIGNS.
The City Council of the City of I'Ve st Covina
does ordain as follows:.
Section 1. DEFINITION OF TERMS:
For the purpose of this Ordinance certain
words and terms are defined..
"City": means the City of Ifle st Covina.
ttperson" shall mean .any person, firm,
association, _private corporation or municipal
corporation.
"Signtt:: means any sign, billboard, banner -
or placard used for identification., announcement,;
advertisement or"directional purposes.
";Streettt: A public or private thoroughfare
which -affords a principal means of access to
abutting property.
"Structurett: means anything constructed or
erected which requires location on the ground or
attached to something having a location on the
ground.

Section 2.
No person shall erect a sign structure upon
any property owned or controlled by the City without
first having procured a lease of the property from
the City. Failure to comply with any and all
regulations of this ordinance shall constitute a f
'separate violation of this ordinance for each and
every day that such sign shall be so maintained..
Section 3.
Before any lease shall be granted for the
erection and maintenance of a sign upon property of
the city, application therefor shall be made to
the City Clerk.
Section 4.
The City Clerk shall provide a reasonable form
for such application and such form shall set forth
the following matters, in addition to those which
the City Clerk shall deem necessary to carry out
the purposes and intent of this ordinance.

The application form shall set forth the
following information:
The location of the sign within the city;
The size of the sign;
The nature of the lettering;
The materials of which the sign shall be
constructed, and
attached thereto there shall be a sketch
of said sign.
Section 5.
The City Clerk ishereby authorized to execute
on behalf of the City a lease or sub -lease for sign.
purposes of property owned_ or controlled'by the City
when the City Clerk shall find that all of the
following conditions shall exist:
• (a) That the said premises leased shall be
used only for the erection and maintenance of a sign.
(b) That the location of said sign shall not
obstruct the view upon any street to such an extent
that the same shall create a traffic hazard, and for
this purpose the location of the sign shall be ap-
proved by the Superintendent of Streets.
(c) That the said sign .shall not. be erected
in such a manner as to be unsightly or detrimental
to property in the. vicinity thereof.
(d) That the said sign shall not have an area
greater than thirty two (32) square feet on any one
side.
(e) That the said sign shall be constructed in
such a manner as not to endanger life or property,
and for such purpose the construction of the sign
shall be approved by the Building Inspector..
(f ) That the said lease shall not have a term
longer than one year and shall be subject to term-
ination without notice upon the determination by the
City Clerk that the lease, or the sign erected upon
the leased ,premises shall be in violation of this:
ordinance.
(g) Each sign erected upon the premises leased
•Z hereunder shall_ have designated thereon the words:
"West Covina City" in such a manner as the City Clerk
shall designate in order to establish a uniformity
among signs erected upon premises leased from the city.
Section 6.
The rental for the premises leased hereunder
for sign purposes. shall be payable semi-annually.
The amount of the rental shall be _..such as to reason-
ably compensate the city for the use of said premises,
but in no event shall the rental be less than Five
Dollars ($5.00) per month, and provided further, that,
in no event shall the rental be less than the amount.
paid by the city for the use of any such premises..
Section 7.
The City Clerk may provide for the rental of
signs to the lessees under the terms of this
ordinance when such signs shall be within the
possession of the city. The rental for such
signs shall be as follows:
(a) For the first six(6) months period or --
fraction thereof, the sum of the reasonable-.
cost of such sign,. together with the
additional sum of twenty per cent (20f) to
cover the cost of the administration of
this ordinances'.
(b) For a subsequent six (6) months period
the sum reasonably necessary to maintain said
sign in a clean and neat condition,;. together
with the additional amount of twenty per
cent (20%) to cover the cost of the adminis--
tration of this ordinance..
Section 8.
In the event that any sign shall be erected
or maintained in violation of this ordinance,;
the City Clerk may direct the removal of such sign
without notice. In .the event that the lessee
shall deem that such removal shall be without
cause, the lessee may within thirty (30) days
make written appeal to the City Council. The
findings of the City Council after notice to
the lessee and due hearing, shall be final.
• Section 9.
Any person violating any of 'the provisions
of this ordinance shall be deemed guilty of -a
misdemeanor, and upon conviction thereof shall
be punishable by a fine of not more than Three
Hundred Dollars (300.00) or by imprisonment
in the County Jail for a period of not more than-.
ninety (90) days,.. or both such fine and im=
prisonment. Each such personal shall be deemed
guilty of a separate offense: for every day
during any portion of which any violation of
any provision of this ordinance is committed,
continued or permitted by. such person, and
shall be punishable therefor as provided for
in this ordinance::, and any use, occupation or
building or structure. maintained contrary to
the provisions hereof shall constitute a public
nuisance.

section 10.
. This ordinance shall take effect from and after
thirty (30) days after its passage and before the
expiration of fifteen (15) days after its passage
it shall be posted with the names of the members
voting for and against the same, in three places
within the city, in the manner required by the laws
and ordinances of the City of West Covina.
