Ordinance - 169ORDINANCE NO. I & y AN ORDINANCE OF THE CITY OF 17EST COVINA REQUIRING RER11IT FOR THE EXCAVATION OR CONSTRUCTION OF ANY BRIDGE OR CULVERT OR THE CONNECTION OF ANY DR I VE WAY IN OR TO ANY OF THE STREETS OF THE SAID CITY OF 'NEST COVINA. The City Council of the City of West Covina do ordain as follows: Section 1. It shall be unlawful for any person, firm, or corporation, as principal or agent; to make any excavation, or' to construct any bridge or culvert, or to connect any driveway, in or to any of the streets of the City of ,,!est Covina, by or under private contract, or individually, unless permit from the Super - intendant of Streets therefor is first secured. Sbch' excavation, construction of bridges or culverts and/or driveways as herein referred to, shall be deemed and is hereby declared to include the grading or regrading, the macadamizing or remacadamizing, the gravelling or regravelling, the oiling or reoiling, and the pav- ing or repaving of any such excavation, bridge, culvert and/or dri-veiijay, or the construction or reconstruction of any of the said excavations; bridges, culverts and/or driveways, in any street, sidewalk, crosswalk, driveway, curb, gutter and entrances to driveways over gutters. Section 2. Any permit granted by the Superintendant of Streets :for the making of any such excavation, construction of any bridge or culvert,,or the connection of any driveway, by or under private contract, or individually, shall be deemed to have been granted subject to the terms of this Ordinance, and the per- mit therefor shall not be transferrable. Said excavation, or construction of any bridge or culvert or the connection of any driveway to any of the streets of the said City shall be made under the direction and to the satisfaction of the Superintendant of Sfreets, , and all work shall, during its progress and on its completion, conform to the likes and levels which may from time to time be given by the City Engineer. Section 3. The Superintendant of Streets shall be given at least twenty-four (24) hours notice in writing of the time of commencement of the work of making any such excavation, or of the construction of any such bridge or culvert, or of the connection of any driveway to any of the streets of said City, in order that he may procure and assign an inspector to inspect the same; and in case the services of the City Engineer are required for laying out any portion of said work, twenty-four hours notice shall be given said City Engineer of the time when such services shall be required; and such work shall not be commenced until after such notice has been given and the neces- sary engineering work completed. 4 0 Section. 4. ' Before any permit herein provided -is is- sued to any person, firm, or corporation, such person, firm or corporation shall make written application therefor to the Super - intendant of Streets, which application shall be accompanied by the fee or fees as hereinafter set forth, to -Bruit: (a) ' Construction or reconstruction in any street, road, and/or alley of a driveway approach or entrance, the sum of 3 Dollars (-3.b0); /u _-----� (b) Excavation in the dirt surface of any dedicated �;`% street, road, and/or alley, the sum of One Dollar (1.00) per one hundred (100) square feet, or fraction thereof; (c) Excavation in the'rock and oil, and/or asphalt surface of any' dedicated street, road, and/or alley, ,the sum of Fifty Cents (w.50) peVsquare foot; (d) Excavation in the concrete surface of any dedi- cated street, road, and/or alley, the sum of One Dollar ($p1.00) per square foot; (e) Construction or re -construction of any bridge and/ or culvert a sure as determined by the Superintendant of Streets which shall be necessary to defray the costs of the necessary engineering work and inspection, which in no.event shall be less than one-half (2) of One per cent (1g) of the reasonable cost of the construction of said bridge and/or culvert, nor more than two per cent (25�,) thereof.; provided, however, that said fee shall not be less than the sum of Five Dollars ($5.00). Section 5. It shall be the duty of the Superintendant of Streets to duly inspect and supervise during the progress of the work, such work as shall be made pursuant to the provisions of this ordinance. Section 6. Any person_, firm or corporation, as principal or agent, who shall violate any of the provisions of this Ordi- nance, shall be deemed guilty of a mi sderieanor and upon conviction thereof shall be ounisned by a fine of not to exceed One Hundred Dollars (y 100.00), or by imprisonment for a period not to exceed thirty (30) days, or by both such fine and imprisonment. Section 7. This Ordinance shall take effect thirty days after the date of its adoption, and prior to the expiration of fifteen days from the passage hereof shall be published once in the 1lest Covina Tribune; a newspaper printed and published in the City of ;hest Covina,' County of Los Angeles, State of California.
