AN ORDINANCE AMENDING ORDINANCE NO. 87 ENTITLED
"AN ORDINANCE OF THE CITY OF WEST COVINA, COUNTY
OF LOS ANGELES, STATE OF CALIFORNIA, ADOPTING -A
BUILDING CODE TO REGULATE THE -CONSTRUCTION, ERECTION,
ENLARGEMENT, RAZING, ALTERATION, REPAIRING, REMOVAL,
MAINTENANCE, MOVING, USE AND HEIGHT OF BUILDINGS
OR STRUCTURES IN THE SAID CITY OF WEST COVINA" BY
ADDING THERETO FOUR.NEW SECTIONS, TO BE NUMBERED
SECTION 79 SECTION 89 SECTION 9 AND SECTION 10.
The City Council of the City of West Covina, State of
California, do ordain as follows:
SECTION 1: Ordinance No. 87, entitled oAn Ordinance of
the City of best Covina, County of Los Angeles, State of
California, adopting a building code to regulate the construc-
tion, erection, enlargement, razing, alteration,.repairing,
removal, maintenance, moting, use and height of buildings
or structures in the said city of West Covina", is hereby
amended by adding thereto four new sections to be numbered
Section 79 Section 8, Section 9 and Section 10.
SECTION 7: 'The Building Code of the County of Los Angeles'
as printed on pages 17 to 391 inclusive, in that certain book
entitled "Los Angeles County Building Laws", 1945 edition,
thitee (3)-copies of which are on file in the office of the
City Clerk of the said City of West Covina, is hereby adopted
as the Building Code of the City of West Covina.
SECTIONBc- The City of West Covina is hereby declared to
be divided into various fire zones in order to provide for
the public peace, health, safety and general welfare.
(a) The following described portion of the city of West
Covina is hereby declared to be, and is created, as Fire Zone
Number Onex
All C-2 zones as established by the "Zoning Map of
the City of West Covina", as provided in Section 3 of Ordinance
No. 147 and amendments thereto.
(b) The following described portion of the City of best
,;''Covina is hereby declared to be, and is created, as Fire Zone
Number Two.
All C-3 zones as established by the "Zoning Map
of the City of West Covina, as provided in Section 3 of Ordinance
No. 147 and amendments thereto.
(c ) The following described portion of the City of West
Covina is hereby declared to be, and is created, as Fire Zone

Number Two A.
All C-1 and R-3 zones as established by the "Zoning
Map of the City of West Covina", as provided in Section 3
of Ordinance No. 147 and amendments thereto.
, SECTION 9: No building or structure shall hereafter be
erected, constructed or moved into or within Fire Zone Number
Two A which shall not comply with the requirements hereinafter
set forth in this section.
1. Type IV Buildings.
(a) No "Type IV buildings", having a floor area
greater than 7500_.square feet, shall be erected, constructed
or moved into or within Fire Zone Number Two A.
(b ) All "Type IV buildings", having a floor area
greater than 1000 square feet, erected, constructed or
moved into'or within Fire Zone Number Two A, shall have a
rated Fire�esistive Period for exterior walls as set forth
in Chapter 43 of the Los Angeles County Building Laws, 1945
edition, adopted by this ordinance, which said Fire -Resistive
Period shall be not less than two (2) hours,; provided,
however; that any such exterior walls which are less than
three (3) feet from adjacent property lines, or less than
six (6) feet from any building or structure on the same prop-
erty, then the exterior walls thereof shall have a Fire -
Resistive Period of not less than four (4) hours.
2. Type V Buildings.
(a) No "Type V buildings", having a floor area
greater than 7500 square feet, shall be erected, constructed,
or moved into or within Fire Zone Number Two A'.
(b ) All "Type V buildings", erected, constructed
or moved into or within Fire Zone Number Two A, shall have
a rated Fire -Resistive Period for exterior walls as set forth
in Chapter 43 of the Los Angeles County Building Laws, 1945
edition, adopted by this ordinance, which said Fire -Resistive
Period shall be not less than two (2) hours; provided, however:
that any such exterior walls which are less than three F feet
from adjacent property lines, or'less than six (6) feet from
any building or structure on the same property, then the
exterior walls thereof shall have a rated Fire -Resistive Period
of not less than four (4) hours, as set forth in Chapter 43
of the Los Angeles County Building Laws, 1945 edition.
(o b All buildings or structures of "Type V buildings"
shall be covered with a "fire -retardant" roofing as specified
in Section 4305 of the Los Angeles County Building Laws, 1945-
edition, adopted by this ordinance.

3. Alterations. No wrype IV Building"in excess of
one thousand square feet (1000 sq. ft.) in floor area nor
any building of ""Type V Building" except as specified in
Subsection (b) of Subsection 1, of Section 9 already erected
in Fire 'Zone No. 2-A, shall hereafter be altered, raised,
enlarged, added to or moved except as follows:
1. Such building may be made to conform to the
provisions of Subsection (b) of Subsection 1, of Section 9;
2. Changes, alterations and repairs to the inter-
ior of such building or the front thereof facing a public
street may be made provided such changes do not increase the
fire hazard of such building.
3. Roofs, of such buildings may be covered only
with. a "Fire Retardant" roofing as specified in Section 4305.
4. Such building may be moved entirely outside the
limits of Fire Zone No. 2-A.
5. Such building may be demolished.
6. Combustible -finish on the outside of walls may
be replaced by, or covered with exterior plaster as speci-
f ied in -Chapter 47.
A. Occupancies Prohibited. No Group E Occupancies
except garages shall be permitted in Fire Zone No. 2-A.
SECTION -1.0: 4)No "Type IV" Building shall be erected,
constructed or moved into or within the City of West Covina
except a permit authorizing such building to be erected,
constructed or moved into, or within, the City of West Covina
shall first -have been issued by the Chief Building Inspector
of the said City of West Covina. The Building Inspector
is hereby authorized to issue such a permit when he shall
have found that the following conditions exist:
.(a) That the "Type IV" building to be erected, con-
structed, or Moved into or within the City of West Covina
will not endanger the public health and general welfare of
the -City of West Covina.
(b) That such building does not present a materiab fire
hazard to said City.
(c) That the same does not:.create a hazard to persons
or travel upon any public thoroughfare within the City of
West Covina.,
2. If any section, sub -section, clause or phrase of
.this ordinance, is, for any reason, held to be unconstitu-
tional, such decision shall not affect the validity of the
remaining portions of this Ordinance. The Council hereby
declares that it would have passed this Ordinance and each
section, subsection, sentence, clause and phrase thereof,
irrespective of the fact that any one or more of the sec-
tions., subsections, sentences, clauses, or phrases
•
might be declared unconstitutional.
3. Any person, firm, or corporation, whether as
owner, agent, servant, or occupant, who shall fail to
comply with the provisions of this Ordinance, shall be
deemed guilty of a misdemeanor, in addition to other
matters herein contained, and upon conviction thereof
shall be punished by a fine not exceeding #300,00 or
by imprisonment in the County Jail of Los Angeles County
for a. term not exceeding ninety (90) days, or by both
such fine and imprisonment.
