Ordinance - 141ORDINANCE NO. 141 AN ORDINANCE AMENDING ORDINANCE NO. 31, ENTITLED "AN ORDINANCE PROVIDING FOR THE CREATION IN THE CITY OF WEST COVINX OF ZONES CONSISTING OF VARIOUS DISTRICTS AND PRESCRIBING THE CLASSES OF BUILDINGS, STRUCTURES AND IMPROVEMENTS IN TFM SAID SEVERAL ZONES AND USES THEREOF" BY ADDING TiERETO FOUR NEW SECTIONS TO BE NUMBERED SECTION 2.5, SECTION 2.6, SECTION 3.5, AND SECTION 3.6. • The City Council of the City of West Covina do ordain as follows: SECTION 1. Ordinance No. 31, entitled "An Ordinance providing for the creation in the City of West Covina of Zones consisting of various districts and prescribing the classes of buildings, structures and improvements in the said several zones, and -the uses thereof" is hereby amended by adding thereto four new sections to be numbered Section 2.51, Section 2.6, Section 3.59 and Section 3.6. SECTION 2.5. The following described portion of the City of Nest Covina is hereby declared to be no longer'%" zone, and is created as and declared to be in the A-1 zone: All that property within the City of West Covina, lying Northerly of the following described line: Beginning at the intersection of the Southerly line of Garvey Boulevard with the Easterly boundary line of the City of Test Covina; thence . Westerly along said southerly line to the center line of Walnut' Wash; thence westerly following the center line of Walnut Wash to the Northerly prolongation of the Easterly boundary at line of Tract No. 14265 in the City of Test Covina, County of Los Angeles, State of California, as per map recorded in Book 292, pages 33, 34, and 35 of Maps in the office of the County Recorder of said County; thence Southerly along said prolonged line and said last mentioned Easterly boundary line to the Southeasterly corner of said Tract; thence Westerly along the Southerly boundary line of said Tract to the Southwesterly corner of said Tract; thence Northerly along the Westerly boun- dary line of said Tract to said center line of Walnut Wash; thence Westerly along said center line to.the Northerly prolongation of the Westerly line of Lot 199 of E. J. Baldwin's 5th Subdivision, as per map recorded in Book 12 pages 134 and 135 of Maps in the office of the County Recorder of said County; thence Northerly in a direct line to the Northwest corner of Lot 179 of said E. J. Baldwin's 5t h Subdivision;' thence Northerly_in a direct line 0 to the intersection of the Northerly line of Garvey Boulevard with the Westerly line of Lot 7, Block 29, of the Phillips Tract in the City of West Covina, County of Los Angeles; State of Cali- fornia, as per map recorded in Book 9, pages 3 and 4 of Miscel- laneous Records in the office of the County Recorder of said County; thence Northerly along the Westerly line of said Lot 7 and its prolongation Northerly to the center line of Workman Avenue; thence Westerly in a- direct line to the Northeast cor- ner of Lot 3, W. R. Rowland Tract in the City of West Covina, County of Los Angeles, as per map recorded in Book 42, page 45 of Miscellaneous Records in the office of the County Recorder of said County; thence Westerly along the Northerly line of said Lot 3 and said Northerly line produced Westerly to the Westerly line of Irwindale Avenue; thence Northerly along said last-men- tioned Westerly line to the Northeast corner .of Lot 1 of Reichard Tract as per map recorded in Book 10 page 121 of Maps in the office of the County Recorder of said County; thence Westerly in a direct line to the Northwest corner of said Lot 1; thence Northerly in a direct line to the Northeast corner of said Tract No. 13876 as per map recorded in Book 285 pages 17, 189 and 19 of Maps, in the office of the County Recorder of said County; thence Westerly in a direct line to the Northwest corner of said Tract No. _ 13876; thence Southerly in a direct line to the South- east corner of Lot 19 Tract No. 9911, as per map recorded in Book 1419 page 12 of Maps, in the office of the County Recorder of said County; thence Westerly along the Southerly line of said Lot 1 and its prolongation Westerly to the Southerly prolongation of the Westerly line of Lot 2 of said Tract No. 9911; thence Northerly in a direct line to the Northeast corner of Tract No. 13723 as per map recorded in Book 280 pages 31, 32, and 33 of Maps in the office of the County Recorder of said County and the Westerly boundary line of the City of West Covina. SECTION 2.6: The following of Nest Covina is hereby declared is created and declared to be in described portion of the City to be no longer "A" zone, and the A-2 zone. All that portion of the City of Test Covina, lying South- easterly of the following described line: Beginning at the Southwest corner of Lot 285 of E. J. Baldwin's 5th Subdivision in the City of West Covin4 County of Los Angeles, State of California, as per map recorded in Book 12 pages 134 and 135 of Maps, in the office of the County Re- corder of said County; thence Northerly in a direct line to the Northwest corner of Lot 199, said E. J. Baldwin's 5th Sub- division; thence continuing Northerly along the Northerly pro- longation of the Westerly line of said Lot 199 to the center line of Walnut Wash; thence Easterly following the center line of Walnut Wash to the Westerly boundary line of Tract No. 14265 as. per map recorded in Book 292, pages 33, 34, and 35 of Maps in the office of the County Recorder of said County; thence Southerly along said boundary line to the Southwesterly corner of said Tract; thence Easterly along the Southerly boundary lire of said Tract to the Southeasterly corner of said Tract; thence Northerly along the Easterly bomdary line of said Tract and the Northerly prolongation of said Easterly boundary line to the said center line of Walnut Wash; thence Easterly along said center line to the Southerly line of Garvey Boulevard; thence Easterly along said Southerly line to the Easterly boundary line of the City of West Covina. . SECTION 3.5, added to said Ordinance as f ollows : (1) In Class A-1 residential district only the follow- ing uses shall be permitted: (a) Single family dwellings of a permanent charac- ter placed in a permanent location. There shall be only one kitchen in a single family dwelling. (b) Accessory buildings, including a private gar- age. All such garages -or subordinate struc- tures shall be erected and maintained only as accessories to the -dwelling situated on the said lot or building site. (c) private greenhouses, horticultural collections, Poultry for domestic, non-commercial use, not to exceed fifty, public parks, flower and vege- table gardens, and fruit trees. (d) One unlighted sign pertaining only to the sale, lease, or hire of only the particular building, property, or premises upon which displayed, which Ssign shall not exceed eight square feet in area; or one sign or placard only to advertize pro- fessional -calling or home occupation, the suf- face area of.which sign shall not exceed two square feet. No other advertisement signs, structures or devises shall be permitted in any class A-1 area; provided, however, that nothing herein contained shall prohibit the temporary use of placards offering the premises for sale or rental. (e) public schools (f) Home occupations such as that of the physician, surgeon, dentist, chiropractor, osteopath, chiropodist, attorney, studio artist, or,mu- sioian, minister of religion, dressmaker, seam- stress, and similar homr- or professional occu- pations, provided that there shall be no employed assistance in arty way connected with the operation of such home or professional occupation. (2) Building site area required: (a) The minimum building site area for each single t family dwelling shall be 15,000 square feet, provided this limit shall not apply to lots or building sites of less area, if separately recorded and shown as such in the office of the County Recorder before the effective date of this Ordinance; No more than one single family dwelling shall be erected or maintained on said premises. (b ) No building site area shall be less than feet in width. (c) "Building site area" as used herein shall mean any parcel of real property, whether designated by lot number or described by metes and bounds, where the same is shown as a unit upon 'the tax roll. (3) No single family dwelling house, exclusive of the garage area, whether such Eprage shall be attached to and made a part of the house, or whether it shall be separate and apart, shall contain a ground floor area of less than 1200 square feet. SECTION 3.6, added to said Ordinance as follows: • (1) In Class A-2 residential district only the following uses shall be permitted: (a) Single family dwellings of a permanent charac- ter placed in a permanent location. That -W&IEREAS the .City Council of the City of West Covina is contemplating the adoption of a general zoning ordinance the entire city of West ®ovina as soon as public hearings can be completed thereon,* and WHEREAS, the creation of zone variances and the creation or construction of buildings or structures contrary thereto would defeat or seriously injure the ultimate execution of said plan and the purposes of such proposed ordinance before the same can be prepared in detail; the City Council of said City therefore find and determine that for the immediate preservation of the public health, peace, safety, comfort, convenience, interest, and welfare, an emergency exists and this ordinance is enacted as an emergency .measure and ordinance, and that the same shall take effect immediately upon the same being posted by the City' Clerk of the City of West Covina in the manner required by law and by the ordinances of the City of West Covina.
